City Hall, 255 South Lincoln, O’Fallon, Illinois as well as on Zoom, a video/audio conferencing platform on

Items Requiring Council Action:
2.1 Amendments to Chapters 30, 31, and 32 of the O'Fallon City Code
City Administrator Grant Litteken presented some proposed changes to the City Code. Several updates
were recommended for the City’s Administrative and Public Safety Code provisions. The amendments are
intended to modernize existing practices, clarify administrative procedures, and align the City Code with
the current operational structure of the organization. The significant changes were summarized in the staff
report attached to the board packet. Staff also explained a few of the redlined changes in the ordinance
that were also attached. These changes included how a member of a committee can introduce a matter as
new business for consideration at a future committee meeting (Section 30.07), if member is attending via
electronic means, said member shall have camera on and be visible (Section 30.09) and that the Mayor
shall pay the entire costs of the total premiums of the health care plan and the City will not contribute to the
cost of coverage (Section 31.017)

3.2 Discussion of IML Fact Sheet: Compensation of Municipal Officials: City Administrator Grant
Litteken explained the IML Fact sheet: Compensation of Municipal Officials which was included in the
board packet. The sheet explains the process required to change the pay of council members and other
elected officials. Council must pass and codify an ordinance 180 days prior to the election of those being
elected for that particular term, which would mean by October, 2026 to take effect with the May, 2027
term. Due to the staggered terms, the other elected officials must wait until the following election cycle to
have the pay rate adjusted. Council member Rosenberg asked if they voted to make the change, could they
delay the implementation and make the new rate changes effective in May 2029 so that all Council
members would get the pay increase all at the same time. Mr. Litteken said that was doable. This was
information only, no vote at this time was requested.

A RESOLUTION AUTHORIZING A TRANSFER FROM RESERVES AND BUDGET
AMENDMENTS FOR FUNDS WITH EXPENDITURES IN EXCESS OF BUDGETED

WHEREAS, the City of O’Fallon passed Ordinance Number 4262, an Ordinance
budgeting for all corporate purposes of the city of O’Fallon, St. Clair County, Illinois for the
fiscal year beginning May 1, 2025, and ending April 30, 2026
WHEREAS, the following funds have expenditures in excess of budgeted amounts at the
end of Fiscal Year 2026:
TIF Greenmount - first payment for HSHS TIF development costs were not budgeted
($307,825.00),
TIF Scott Troy Rd - development costs were higher based on property tax received
($13,861.00),
IMRF - payments were underestimated ($117,523.00),

WHEREAS, there are revenues or cash reserves available to fund these excess
expenditures;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL, OF THE CITY OF O’FALLON, ST. CLAIR COUNTY, ILLINOIS AS
FOLLOWS;
That the City of O’Fallon’s Director of Finance is hereby authorized to do the necessary
transfers from reserves and budget amendments for the following funds: TIF Greenmount, TIF
Scott-Troy Road, IMRF, EMS, SSA1 Georgetown, Police Seized Funds, and Police Trust.
This Resolution shall become effective immediately upon its adoption by City Council.

Background: The sample ballot language below is the result of direct feedback received from City Council members
during the June 29, 2026, Committee of the Whole meeting. Council requested revised language that begins with the word
"Shall" and reduces the overall word count by removing details describing the services and resources the new library
would provide.
The revised language has been reviewed by the City Administrator, the Mayor, Bernardi Securities, and Miller Canfield
(bond counsel). Like the previous version, this draft is legally sound and meets all requirements for a non-binding
referendum.
Under Illinois election timelines, the City Council must approve the referendum language no later than August 16, 2026,
for the question to appear on the November 3, 2026 ballot. Following City Council approval, the final filing must be
submitted to St. Clair County no later than August 28, 2026.
Proposed Ballot Language
Shall the City of O'Fallon, St. Clair County, Illinois, use $5 million of reserves and increase property taxes to repay
general obligation bonds in an amount not to exceed $17,500,000 for the purpose of constructing and equipping a new
public library? If approved, the estimated additional cost for the median-valued O'Fallon home ($296,000) would be
approximately $127 per year (about $10.60 per month). Actual amounts will vary based on a property's assessed value,
future interest rates, and changes in the City's equalized assessed valuation.
Legal Consideration, if any: Attached is the resolution prepared by Miller Canfield who is serving as bond
counsel for the referendum. This is the official document that will need to file with the County once Council it
is approved and after it is signed by all necessary parties.

Council of the City of O’Fallon, St. Clair County, Illinois, held at
the O’Fallon Council Chambers, 255 South Lincoln, in said City, at
6:00 p.m., on the 3rd day of August, 2026.
The meeting was called to order by the Mayor and upon the roll being called,
Eric Van Hook, the Mayor, and the following Council Members were physically present at said
location:

accordance with and to the extent allowed by rules adopted by the City Council to attend the
meeting by video or audio conference:

The City Council then considered the adoption of a resolution providing for the submission

A RESOLUTION providing for and requiring the submission of an
advisory question to the voters of the City of O’Fallon, St. Clair
County, Illinois, regarding the constructing and equipping of a new
public library in and for the City at the general election to be held
on the 3rd day of November, 2026.
WHEREAS, pursuant to the provisions of Section 6 of Article VII of the Constitution of
the State of Illinois (the “State”), the City of O’Fallon, St. Clair County, Illinois (the “City”), is a
home-rule unit and may exercise any power or perform any function pertaining to its government
and affairs including, but not limited to, the power to tax and incur debt; and
WHEREAS, the City Council of the City (the “City Council”) does hereby find and
determine that the constructing and equipping of a new public library in and for the City (the
“Project”) would provide a quality community benefit; and
WHEREAS, before the City Council approves the Project and subsequent incurrence of
debt by the City, a portion of the cost of which is to be repaid through an increase in property taxes,
an advisory question therefor (the “Advisory Question”) will be submitted to the voters of the City
and be approved by a majority of the voters of the City voting on the Advisory Question at an
election to be held in and for the City; and
WHEREAS, it is deemed advisable, necessary, and in the best interests of the City that the
Advisory Question be submitted to the voters of the City at an election to be held and conducted
in accordance with the general election law:
NOW, THEREFORE, Be It Resolved by the City Council of the City of O’Fallon, St. Clair
County, Illinois, as follows:
Section 1. Incorporation of Preambles. The City Council hereby finds that all of the
recitals contained in the preambles to this Resolution are full, true, and correct and does incorporate
them into this Resolution by this reference.

Section 2. Need for Project. It is necessary and in the best interests of the City that the
City Council be authorized to provide the Project.
Section 3. Submission to Voters. The Advisory Question shall be submitted to the
voters of the City in accordance with the general election law at the general election to be held on
Tuesday, the 3rd day of November, 2026, between the hours of 6:00 o’clock A.M. and 7:00 o’clock
P.M. on said day (the “Election”).
Section 4. Voting Precincts and Polling Places. The Election shall be held in the
voting precincts and at the polling places established by the County Board (the “County Board”)
of the County of St. Clair, Illinois (the “County”), for voters of the City at the Election.
Section 5. Election Notice. The County Clerk of the County (the “County Clerk”) shall
give notice of the Election (the “Notice”), in accordance with the general election law by
(i) publishing the Notice once not more than 30 nor less than 10 days prior to the date of the
Election in a local, community newspaper having general circulation in the City, and (ii) posting
a copy of the Notice at least 10 days before the date of the Election at the principal office of the
County Clerk.
Section 6. Local Notice. The City Clerk of the City shall post a copy of the Notice at
the principal office of the City at least 10 days before the date of the Election.
Section 7. Newspaper of General Circulation. It is hereby found and determined that
the Belleville News-Democrat is a local, community newspaper having general circulation in the
City as required by Section 12-5 of the Election Code of the State, as supplemented and amended
(the “Election Code”).
Section 8. Form of Notice. The Notice shall appear over the name or title of the County
Clerk and shall be substantially in the following form:

Section 10. Election Judges. The Election shall be conducted by the election judges
appointed by the County Board to act in the precincts at which the Advisory Question will be
submitted to the voters of the City.
Section 11. Filing of Resolution. After the adoption hereof and not less than 68 days
prior to the date of the Election, the City Clerk of the City shall certify a copy hereof to the County
Clerk in order that the advisory question set forth herein may be submitted to the voters of the City
at the Election.
Section 12. Canvass of Election. The Election shall be held and conducted and the
returns thereof duly canvassed, all in the manner and time as provided by the general election law.
Section 13. Severability. If any section, paragraph; clause, or provision of this
Resolution shall be held to be invalid or unenforceable for any reason, the invalidity or
unenforceability of such section, paragraph, clause, or provision shall not affect any of the
