REGULAR MEETING OAKDALE CITY COUNCIL April 12, 2022 CALL TO ORDER A regular meeting of the City Council of the City of Oakdale was held on April 12, 2022, at Oakdale City Hall, 1584 Hadley Avenue, Oakdale, Minnesota. The meeting was called to order by Mayor Paul Reinke at 7:00 PM. PROCLAMATIONS Mayor Reinke presented two proclamations. The first recognizing April as Parkinson’s Awareness Month and the second recognizing April as Autism Acceptance Month. OPEN FORUM Mario Cocchiarella is the owner of Maplewood Development Company and developer of the Willowbrooke Project. Mr. Cocchiarella stated he purchased the property from 3M. He expressed his concern for the Willowbrooke development. He claimed that half of the land was supposed to be dedicated to park land and open space. He is concerned with some of the amendments/zoning to the Comprehensive Plan, particularly the multi-family units being added. He feels some of the things he has committed to are now changing, such as changing commercial designations to multi-family. He asked that the City Council take another look at this. CONSENSUS MOTIONS a) Waive reading and adopt Resolution 2022-xxx, Accepting the improvements, and authorizing final payment for City Project 2021-01 (2021 Street Improvements) in the amount of $156,939.84. b) Approve the Summerfest Vendor Application Fees for Non-Food Vendor to $125 for 2022 and waive reading and adopt Resolution 2022-xxx adding the Non-Food Vendor Application Fee of $125 to the Fee Schedule c) Authorize the Mayor and City Administrator to enter into an agreement with Flaherty & Hood, P.A. at a cost of $5,000 for lobbying services to guide the city’s efforts in gaining legislative approval for additional authority for L.O.S.T. to $42M and 40-year maximum. d) Waive reading and adopt Resolution 2022-xxx supporting the authority to amend the sales and use tax authorized by the legislature in 2021 in order to fund specific capital improvements providing regional benefit such as a police facility and public works facility, to establish the duration of the tax and the revenue to be raised by the tax, and to authorize the city to issue bonds supported by the sales tax revenue. e) Authorize the Mayor and City Administrator to sign and execute the three-year agreement with Companion Animal Control. f) Authorize the Mayor and City Administrator to sign the agreement between SafeAssure and the City of Oakdale for Training. g) Per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Robert Kodluboy as a full-time probationary Utilities Maintenance crew member effective April 18, 2022, at a rate of pay consistent with the City base pay schedule.  h) Per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Matthew Williams as a full-time probationary Street and Fleet Superintendent effective April 13, 2022, at a rate of pay consistent with the City base pay schedule. i) Per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Luke McClanahan as a full-time probationary City Planner effective May 2, 2022, at a rate of pay consistent with the City base pay schedule, condition on passing appropriate background check(s). j) Authorize the Mayor and City Administrator to enter into an agreement with the University of Minnesota to perform a Local Option Sales Tax Analysis. k) Waive reading and adopt Resolution 2022-xxx approving the interfund transfer and consolidation of funds as presented for fiscal year 2021. l) Authorize the Mayor and City Administrator to sign the proposal between SEH and the City of Oakdale for the preparation of electrical plans to replace the electrical system at Richard Walton Park Ballfields 5-8 Rewiring. m) Amend the Master Services Agreement with Stantec and approve allocation of developer contributions / park dedication proceeds received in the Willowbrooke Capital Project Fund for the Parks Programming, Master Plan and Design Task Order with Stantec. n) Waive reading and approve a Resolution 2022-xxx for the Oakdale Athletic Association (OAA) to conduct lawful gambling at J.W.’s Bierstube located at 7121 10th Street. o) Waive the reading and adopt Resolution 2022-xxx authorizing the support for the Regional Solicitation Funds application for the construction of a Multiuse Trail Bridge over I-694 and authorizing the City Administrator to execute such agreements necessary to receive and use funding. p) Authorize the Mayor and City Administrator to enter into the Cooperative Agreement between the City of Oakdale and Washington County relating to the Construction Cost for County State Aid Highway 14 Signal and Trail Project. q) Per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Derrick Barr as a full-time probationary Community Service Officer effective April 13, 2022, at a rate of pay consistent with the City base pay schedule. r) Per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Daniel Rogers as a full-time probationary Community Service Officer effective April 13, 2022, at a rate of pay consistent with the City base pay schedule. s) Authorize the Mayor and City Administrator to enter into an agreement with Executive Management Systems, Inc. for Management Team Development. Council Member Zabel asked that consensus motion item “p” be removed. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL SECONDED BY COUNCIL MEMBER SWEDBERG TO APPROVE CONSENT AGENDA ITEMS A THROUGH O AND R THROUGH S. 5 AYES. Council Member Zabel stated the reason he is pulling item “p” is that after reading through the materials he feels there are some discrepancies and missing information. He is hoping to table this until it has been fixed so Council can have a full understanding of the costs associated with this project. Exhibit B was missing from the agreement. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL TO TABLE THIS ITEM UNTIL THE APRIL 26, 2022 REGULAR CITY COUNCIL MEETING, SECONDED BY COUNCIL MEMBER INGEBRIGTSON. 5 AYES. ADVISORY BOARDS AND COMMISSIONS Economic Development Commission (no meeting) Environmental Management Commission (no meeting) Planning Commission met on April 7, 2022. Liaison Council Member Swedberg said that two main items were passed. The first was the church along Stillwater Blvd. and Hamlet. They have a parking issue and have decided that rather than have valet parking, they will use an 18-passenger van from Canvas Health’s parking lot. Parking may not be an issue for a while since they have less than 650 parishioners and the parking spaces planned is 935. This agenda item passed Planning Commission with two contingencies; that they provide a written record that they can use Canvas Health’s parking lot, and in the event that Canvas Health moves it location, the church has something else in place for parking. Council Member Swedberg also stated that there were residents who had a problem with all of the off-street parking. The Planning Commission would like to have the city engineer look at that. The second item Council Member Swedberg mentioned was the 4Front Technology, multi-family development. The Comprehensive Plan would need to be changed and the Council would need to amend the PUD to accommodate the development. If approved by the City Council, l it would need to go to Metropolitan Council. Parks and Recreation Commission (no meeting) Tree Board (no meeting) CITY ATTORNEY JIM THOMSON No report STAFF REPORTS ADMINISTRATOR'S REPORT No report COUNCIL PRESENTATIONS Council Member Swedberg stated that there will be a landscape revival June 4, 2022 from 9am to 1pm at fire station 1, which is a new location. There will be an opportunity to buy native plants and there will be exhibitors. There will be a food truck too. Council Member Olson reminded everyone to get a yearly skin cancer check. It could save your life. Mayor Reinke wanted to wish everybody a celebratory holiday, a Happy Easter and Passover. Enjoy, be safe and take care.
