REGULAR MEETING OAKDALE CITY COUNCIL April 26, 2022 CALL TO ORDER A regular meeting of the City Council of the City of Oakdale was held on April 26, 2022, at Oakdale City Hall, 1584 Hadley Avenue, Oakdale, Minnesota. The meeting was called to order by Mayor Paul Reinke at 7:01 PM. OPEN FORUM CONSENSUS MOTIONS a) Authorize the Mayor and City Administrator to enter into a partnership agreement with the OACC and SPACC to implement the BRE&A program for the City of Oakdale. b) Authorize the Mayor and City Administrator to enter into the Cooperative Agreement between the City of Oakdale and Washington County relating to the Construction Cost for County State Aid Highway 14 Signal and Trail Project. c) Authorize the Mayor and City Administrator to execute a Contract for Professional Services between the City of Oakdale and Toole Design Group to complete the Bike and Pedestrian Plan Update. d) It is requested per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE- 031, Section 5.0, that the City Council appoint Nicholas Koren as a Public Works Seasonal Worker with an effective date of May 16, 2022, at a rate of pay equal to $16.00/hour. e) It is requested per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE- 031, Section 5.0, that the City Council appoint Ethan Kalin as a Public Works Seasonal Worker with an effective date to be determined, at a rate of pay equal to $16.00/hour. f) Authorize the Mayor and City Administrator to enter into a short-term agreement with Expert T to provide EMS billing services for claims initiated prior to April 1, 2022. g) Authorize the Mayor and City Administrator to enter into an agreement for 2022 Lawn Care service with Twin Property Maintenance in the amount of $6,469.98. h) Authorize the Mayor and City Administrator to sign the attached Subordinate Funding Agreement 3 to the Master Funding Grant Agreement between the Metropolitan Council and the City of Oakdale up to an amount not to exceed $134,495. i) Waive reading and adopt Resolution 2022-xxx, Approving, executing and implementing the2022- 2024 labor agreement, Memorandums of Agreement between the City of Oakdale and Law Enforcement Labor Services, Local 197, for the period of January 1, 2022 to December 31, 2024. j) Approve a temporary variance to Section 19-4(c) of Chapter 19 – Noise to allow Vets for Music to amplify sound in the form of live music on July 9th, 2022 between the hours of 12pm and 6pm at a Walton Park on July 9, 2022. 2 REGULAR MINUTES APRIL 26, 2022 PAGE THREE A MOTION WAS MADE BY COUNCIL MEMBER ZABEL SECONDED BY COUNCIL MEMBER INGEBRIGTSON TO APPROVE CONSENT AGENDA ITEMS A THROUGH J 5 AYES. ADVISORY BOARDS AND COMMISSIONS Economic Development Commission (no meeting) Environmental Management Commission (met on 4/18, liaison Council Member Zabel) Council Member Zabel was unable to attend. Planning Commission (no meeting) Parks and Recreation Commission (met on 4/19, liaison Council Member Ingebrigtson) Council Member Ingebrigtson reported there is no new business however, work on the Walton Ballfield lighting is on-going and the skateboard park is planned to be completed before Summerfest. Tree Board (no meeting) CITY ATTORNEY JIM THOMSON No report STAFF REPORTS Public Works Public Works Manager, Jim Romanik brought forth the Resolution for the Emerald Ash Borer Grant Acceptance in the amount of $100,000 for approval. This is the last piece to complete the approval process for this grant with the RCA was approved by the Council on December 14, 2021 without the Resolution. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL SECONDED BY COUNCIL MEMBER SWEDBERG TO WAIVE THE READING AND ADOPT RESOLUTION 2022-XXX, ACCEPTING GRANT FUNDS IN THE AMOUNT OF $100,000 FROM THE STATE OF MINNESOTA DNR TO THE CITY OF OAKDALE AND APPROVING THE APPROPRIATE BUDGET ADJUSTMENTS. 5 AYES. Community Development – MnDOT Presentation 3 REGULAR MINUTES APRIL 26, 2022 PAGE FOUR East Area Manager, Adam Josephson from MnDOT provided a presentation highlighting findings of the I-94 / 494 / 694 Interchange Study. There are two parts to this project, one being the Gold Line (Bielenberg/Helmo and 4th Street Bridges) and the second is the I-94 Pavement plan that will run from Century Avenue to the St. Croix River (approximately 10 miles). The I-94 project will include a concrete overlay, an Eastbound Auxiliary Lane from the 494/694 interchange to Woodbury Drive (approximately 1.9 miles), noise walls in two locations, storm water ponds, repair/replacement of culverts and other miscellaneous repairs. Mr. Josephson also gave detail in regards to a Hwy 36 resurfacing project which is scheduled to take place from April – September 2022. There will be weekend directional closures from Little Canada to Stillwater in both directions, but staggered as to keep the flow of traffic going. Although Century Avenue at Highway 36 will remain open there will be four ‘no access’ points onto Highway 36, those points are at Highlands Trail North, Demontreville Trail North, Keats Avenue North and Lake Elmo Avenue / CR 17. In regard to the Highway 120 project, there is a Planning and Environment Linkages Study Process. MnDOT heard from the public and a few main concerns were; the roadway needs to be safer for people to walk/roll/bike, there is too much congestion related to vehicle volumes, lack of adequate turn lanes, changing of speed limits and cars parked on the road. There will be five main steps to this study process, Reason for the Study (complete), Defining Corridor Problems (complete), Identify Potential Alternative, Evaluate Potential Alternatives and PEL Study Final Report. Currently the next step in the process is Identify Potential Alternatives. Funding options for these projects include an Infrastructure Investment and Jobs Act (IIJA) Federal Transportation Bill which provides 5 years of appointment for federal FY2022 to federal FY2026, a Rebuilding American Infrastructure with Sustainability and Equity (RAISE) Discretionary Grant Program and Promoting Resilient Operations for Transformative, Efficient and Cost-Saving Transportation (PROJECT) Grants. Along with the listed funding options above there are also MnDOT regular program funding such as pavement preservation, spot safety improvements, HSIP (Highway Safety Improvement Program) and Jurisdictional Transfer. ADMINISTRATOR'S REPORT No report COUNCIL PRESENTATIONS Council Member Zabel reminded everyone Saturday (April 30, 2022) is the City of Oakdale’s 46th Arbor Day and Keller Williams Realty (Larry Eberhard) is hosting a shred -it event the same day in the City Hall parking lot. Mayor Reinke stated that signing up for the MnDOT updates is a great way to stay connected to the progress of on-going projects. 4 REGULAR MINUTES APRIL 26, 2022 PAGE FIVE AWARD OF BID Brian Bachmeier of Bolton & Meck shared with Council that a total of three bids were collected for City Project R2022-01. Miller Excavating, Inc. came in with the most economical bid at $3,842,225.33. The Engineer’s estimate for the construction work was $3,743,040.70. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL SECONDED BY COUNCIL MEMBER SWEDBERG TO WAIVE THE READING AND ADOPT RESOLUTION 2022-XXX AWARDING CITY PROJECT R2022-01 “STREET IMPROVEMENTS” CONTRACT TO MILLER EXCAVATING, INC. IN THE AMOUNT OF $3,842,225.33 AND AUTHORIZE THE MAYOR AND CITY ADMINISTRATOR TO EXECUTE CONTRACT.5 AYES CLAIMS A MOTION WAS MADE BY COUNCIL MEMBER ZABEL REQUESTING THAT THE CITY COUNCIL APPROVE CLAIMS FOR THE PERIOD APRIL 9, 2022 TO APRIL 22, 2022 IN THE AMOUNT OF $1,001,280.37.
