REGULAR MEETING MINUTES OAKDALE CITY COUNCIL August 8, 2022 CALL TO ORDER A regular meeting of the City Council of the City of Oakdale was held on August 8, 2022, at Oakdale City Hall, 1584 Hadley Avenue, Oakdale, Minnesota. The meeting was called to order by Mayor Paul Reinke at 7:01 PM. CALL OF ROLL On a call of roll, the following were present: Mayor Paul Reinke Council Members: Jake Ingebrigtson Susan Olson Colleen Swedberg Kevin Zabel Staff Present: Christina Volkers, City Administrator Rachel Tierney, City Attorney Katie Robinson, Deputy City Clerk Andrew Gitzlaff, Community Development Director Lori Pulkrabek, Communications Manager Jason Zimmer, Finance Director Nick Newton, Police Chief Kevin Wold, Fire Chief Mike Kothe, Utilities Division Superintendent PLEDGE OF ALLEGIANCE APPROVAL OF THE AGENDA A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER INGEBRIGTSON, TO APPROVE THE AGENDA AS AMENDED FOR THE MEETING OF AUGUST 8, 2022. 5 AYES APPROVAL OF MINUTES A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER SWEDBERG TO APPROVE THE SPECIAL WORKSHOP MINUTES OF JULY 19, 2022. 5 AYES A MOTION WAS MADE BY COUNCIL MEMBER SWEDBERG, SECONDED BY COUNCIL MEMBER OLSON TO APPROVE THE WORKSHOP MEETING MINUTES OF JULY 26, 2022. 5 AYES A MOTION WAS MADE BY COUNCIL MEMBER OLSON, SECONDED BY COUNCIL MEMBER SWEDBERG TO APPROVE THE REGULAR MEETING MINUTES OF JULY 26, 2022. 5 AYES REGULAR MEETING MINUTES AUGUST 8, 2022 PAGE TWO PROCLAMATION Mayor Reinke proclaimed September 1, 2022 to be “Building and Code Professional Appreciation Day” OPEN FORUM None CONSENSUS MOTIONS a) It is requested that the City Council approve a noise variance to allow amplified music (run by a DJ) at 6738 29th Street North; for a private party during the hours of 12 p.m. – 10 p.m. on Saturday, September 17, 2022. b) It is requested that the City Council approve a noise variance to allow a live band for a private party at 6129 Upper 44th Street North, on Saturday, September 17, 2022 during the hours of 3 p.m. – 7 p.m. c) It is requested that City Council waive the reading and adopt Resolution 2022-84 and authorize the Mayor and City Administrator to enter into a professional services agreement with Educational Resource Partners for consulting services related to OpenGov permitting, licensing, code enforcement, and online forms and approving the associated budget amendment. d) It is requested that City Council authorize the Mayor and City Administrator to execute the Property Use Agreement between D.T. Meisinger Development Inc. (Meisinger) and the City of Oakdale for use of a portion of the City owned property at Tanner’s Lake. e) It is requested per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Steven Reeves as a full-time probationary Street Maintenance crew member effective August 15, 2022, at a rate of pay consistent with the city base pay schedule. f) It is requested per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Kevin O’Neill as full-time probationary Firefighter/EMT effective September 12, 2022, at a rate of pay consistent with the City base pay schedule. g) It is requested per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Nicholas Danley as full-time probationary Firefighter/Paramedic effective September 12, 2022, at a rate of pay consistent with the City base pay schedule. h) It is requested per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Andrew Atwater as full-time probationary Firefighter/Paramedic effective September 12, 2022, at a rate of pay consistent with the City base pay schedule. i) It is requested per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Andrew Tuuri as full-time probationary Firefighter/Paramedic effective September 12, 2022, at a rate of pay consistent with the City base pay schedule. j) It is requested that the City Council of the City of Oakdale waive reading and adopt Resolution 2022- 85, Electing to not waive the statutory tort limits relating to the liability coverage provided by the League of Minnesota Cities Insurance Trust. REGULAR MEETING MINUTES AUGUST 8, 2022 PAGE THREE Council Member Ingebrigtson requested to pull Consensus item D A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER SWEDBERG TO APPROVE CONSENT AGENDA ITEMS A – C and E – J. 5 AYES Council Member Ingebrigtson requested to pull Consensus item D; Council Member Ingebrigtson stated there was no attempt to collect a fee to allow Meisinger Development to use a portion of the City owned property at Tanner’s Lake. He stated he is not opposed to having developers use City property, however not at the tax payer’s expense when it’s for the developer’s own gain. Mayor Reinke addressed Council and asked for feedback. Council Member Olson asked if it is legal for the City to collect such a fee; to which City Administrator’s Volkers replied; yes, it is legal for a City to collect a fee, however, we are not recommending to collect a fee at this time for this use. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER SWEDBERG TO APPROVE CONSENT AGENDA ITEMS D AS PRESENTED. 4 AYES 1 NO It was suggested that staff put this on a future council workshop for further discussion regarding the possibility of creating a fee for use of city land. City Administrator Volkers confirmed this instruction. ADVISORY BOARDS AND COMMISSIONS Economic Development Commission (met on 8/3/22, Council Liaison, Susan Olson) Council Member Olson gave a brief update on the August 3 rd meeting and reported that EDC gave a brief update on the BREA (Business Retention Expansion and Attraction) project and discussed future tours of community businesses and who would be attending; they did a presentation on Oakdale and Washington County Community Profiles and performed a brief demonstration on “Size-Up Small Business Tool”. This tool is used by small businesses to compare data such as revenues and staffing levels, market area and customer data, etc. Environmental Management Commission (no meeting, Council Liaison, Kevin Zabel) Planning Commission (8/4/22 meeting cancelled, Council Liaison, Colleen Swedberg) Parks and Recreation Commission (met on 7/19/22, Council Liaison, Jake Ingebrigtson) Council Member Ingebrigtson shared that the Parks and Recreation Commission reviewed the possible Willowbrooke amenities and possible uses for the park space. Tree Board (no meeting, Council Liaison, Mayor Reinke) AWARD OF BID None REGULAR MEETING MINUTES AUGUST 8, 2022 PAGE FOUR STAFF REPORTS Public Works Bid Rejection for City Project U2022-04; Water Tower 2 Painting (3888 Hadley Avenue North) a) It is requested that Council reject Classic Protective Coatings, Inc. and re-bid later this year. City Administrator Volkers explained that the bid received from Classic Protective Coating, Inc. is 21% – 24% higher than the Engineer’s estimate and suggested rejecting this bid due to lack of available funding and hold off until February 2023 and re-bid the project. Mayor Reinke supports the rejection of the bid, having nothing to do with the contractor or character of the contractors, but solely based on the fact that the bid is significantly higher than what is budgeted for the project. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER INGEBRIGTSON TO REJECT THIS BID AND RE-BID LATER THIS YEAR / EARLY 2023 FOR PROJECT COMPLETION IN 2023. 5 AYES CITY ATTORNEY None ADMINISTRATOR'S REPORT L.O.S.T. Ballot Language a) Approve Resolution 2022-86 as outlined including approval of the language for inclusion on the November 8, 2022 General Election ballot and to submit to the Washington County Auditor by August 16, 2022, authorize appointment of election judges, and set Special City Council meeting to canvass results. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER SWEDBERG TO APPROVE RESOLUTION 2022-86 AS OUTLINED INCLUDING APPROVAL OF THE ALTERNATE LANGUAGE FOR INCLUSION ON THE NOVEMBER 8, 2022 GENERAL ELECTION BALLOT AND TO SUBMIT TO THE WASHINGTON COUNTY AUDITOR BY AUGUST 16, 2022, AUTHORIZE APPOINTMENT OF ELECTION JUDGES, AND SET SPECIAL CITY COUNCIL MEETING TO CANVASS RESULTS. 5 AYES City staff will upload the alternate language in the packet on the website. Request for Special Workshop, August 31, 2022. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER OLSON TO APPROVE THE REQUEST FOR A SPECIAL WORKSHOP ON AUGUST 31, 2022. 5 AYES COUNCIL PRESENTATIONS Council Member Swedberg extended a big thank you to all the staff that have been working so diligently on the 2023 budget, acknowledging it takes a lot of time and dedication, stating “keep up the great work”. Mayor Reinke shared that he believes the Night to Unite (aka National Night Out) turned out great in the City of Oakdale for those neighborhoods that participated. He also extended a huger thank you to the Police and Fire departments for making it to each neighborhood that requested them to visit their gathering. REGULAR MEETING MINUTES AUGUST 8, 2022 PAGE FIVE The Mayor also reminded everyone of the following upcoming events; • Tuesday, August 9, 2022, is Election Day and residents can vote at the City Hall between the hours of 7 a.m. – 9 p.m. You can also find your nearest polling place by visiting our website’s Election and Voting page. • Wednesday, August 10, 2022, the Farmer’s Market will be held in the City Hall parking lot from 2pm- 6pm. This event takes place every Wednesday through October 12, 2022. • The final “Movies in the Park” event is scheduled for Friday, August 12, 2022. The featured movie will be “Raya and the Last Dragon”, the movie starts at dusk and will be viewed at the Richard Walton Bandshell.
