REGULAR MEETING MINUTES OAKDALE CITY COUNCIL September 27, 2022 CALL TO ORDER A regular meeting of the City Council of the City of Oakdale was held on September 13, 2022, at Oakdale City Hall, 1584 Hadley Avenue, Oakdale, Minnesota. The meeting was called to order by Mayor Paul Reinke at 7:03 PM. CALL OF ROLL On a call of roll, the following were present: Mayor Paul Reinke Council Members: Jake Ingebrigtson Susan Olson Colleen Swedberg Kevin Zabel Staff Present: Christina Volkers, City Administrator Rachel Tierney, Kennedy & Graven, Assistant City Attorney Katie Robinson, Deputy City Clerk Andrew Gitzlaff, Community Development Director Lori Pulkrabek, Communications Manager Jason Zimmerman, Finance Director Nick Newton, Police Chief Kevin Wold, Fire Chief Jim Romanik, Public Works Manager PLEDGE OF ALLEGIANCE APPROVAL OF THE AGENDA A MOTION WAS MADE BY COUNCIL MEMBER OLSON, SECONDED BY COUNCIL MEMBER SWEDBERG, TO APPROVE THE AGENDA AS AMENDED FOR THE MEETING OF SEPTEMBER 27, 2022. 5 AYES APPROVAL OF MINUTES A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER OLSON TO APPROVE THE SPECIAL WORKSHOP MINUTES OF AUGUST 31, 2022. 5 AYES REGULAR MEETING MINUTES SEPTEMBER 27, 2022 PAGE TWO A MOTION WAS MADE BY COUNCIL MEMBER SWEDBERG, SECONDED BY COUNCIL MEMBER OLSON TO APPROVE THE WORKSHOP MEETING MINUTES OF SEPTEMBER 13, 2022. 5 AYES A MOTION WAS MADE BY COUNCIL MEMBER OLSON, SECONDED BY COUNCIL MEMBER SWEDBERG TO APPROVE THE REGULAR MEETING MINUTES OF SEPTEMBER 13, 2022. 5 AYES PROCLAMATIONS Mayor Reinke proclaimed the month of October 2022 as Domestic Violence Awareness Month and encouraged the community to wear purple on Friday, October 21, 2002 to create awareness about domestic violence in our community. OPEN FORUM None CONSENSUS MOTIONS a) Request that the City Council waive reading and adopt Resolution 2022-98, Approving the appointment of persons noted in the attached Resolution to serve as elections judges at the November 8, 2022 General Election. b) Request that the City Council cancel the City Council Work Session and Regular Meeting scheduled for December 27, 2022; however, should an additional meeting be needed before year-end, more discussion will be held to determine an appropriate date. c) Request per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE- 031, Section 5.0, that the City Council appoint Marti Benson as a full-time probationary Administrative Assistant effective October 5, 2022, at a rate of pay consistent with the city base pay schedule, condition on passing appropriate background and reference check(s). d) Request per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE- 031, Section 5.0, that the City Council appoint Derrick Barr as full-time probationary Police Officer effective September 28, 2022, at a rate of pay consistent with the City base pay schedule. e) Recommend that the City Council waive reading and adopt Resolution 2022-99, setting a public hearing for certifying delinquent utility, nuisance charges, and inactive accounts to Washington County for inclusion on 2023 property taxes. f) Request that the City Council approve a noise variance to allow for live music at 2844 Hilo Avenue North for a private party during the hours of 6:30 PM – 8:00 PM on Saturday, October 8, 2022. REGULAR MEETING MINUTES SEPTEMBER 27, 2022 PAGE THREE g) Request that the City Council approve ordering the vehicles and equipment identified for replacement in 2023, as outlined in the preliminary 2023-2032 Vehicle and Equipment Replacement Plan. h) Request the City Council approve and appoint Malloy, Montague, Karnowski, Radosevich & Company (MMKR) as the City’s external auditing firm for audit services. i) Request the City Council waive reading and adopt Resolution 2022-101, approving a variance to Section 19-4(e) of the Noise Ordinance to allow Washington County to work from 7:00 a.m. to 7:00 p.m. on Sunday October 2. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER INGEBRIGTSON TO APPROVE CONSENT AGENDA ITEMS A THROUGH I AS PRESENTED. 5 AYES OATH OF OFFICE – MAYOR REINKE TO SWEAR IN NEW POLICE OFFICER DERRICK BARR Mr. Barr has worked as a Community Service Officer since April, 2022, recently completed his college course work and passed the Police Officer licensure exam. Prior to working in Oakdale, Derrick worked as an emergency dispatcher for Dakota County and has also worked as a volunteer firefighter for Prescott, WI. ADVISORY BOARDS AND COMMISSIONS Economic Development Commission (no meeting, Council Liaison, Susan Olson) Environmental Management Commission (met on 9/19/22, Council Liaison, Kevin Zabel) Council Member Zabel shared that the EMC continued with a discussion on the Bike and Pedestrian plan, they also did a trial run of what the open houses will look and feel like for the residents that will attend those open houses. Planning Commission (no meeting, Council Liaison, Colleen Swedberg) Parks and Recreation Commission (met on 9/20/22, Council Liaison, Jake Ingebrigtson) Council Member Ingebrigtson stated that Community Sr Development Specialist Shannon Reidlinger walked the Parks and Recreation Commission through the Bike and Pedestrian plan and updated them on where the city is at in the process. She also led an informational exercise and asked for any feedback that would enhance the experience for our residents at the open houses. Tree Board (met on 9/20/22, Council Liaison, Mayor Reinke) REGULAR MEETING MINUTES SEPTEMBER 27, 2022 PAGE FOUR Although Mayor Reinke was absent the topics of discussion were an emerald ash borer update, arbor tree give-away update and the appointment of a new Tree Board Member. Appointment to Tree Board: Bender a) It is requested that the City Council approve the appointment of Michael Bender to serve on the Tree Board, term to end June 30, 2025 A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER OLSON TO APPROVE THE APPOINTMENT OF MICHAEL BENDER TO SERVE ON THE TREE BOARD, TERM TO END JUNE 30, 2025 5 AYES AWARD OF BID None STAFF REPORTS Community Development Jeffery Charn – Variance for a Side Yard Setback Encroachment a) Request to approve a Variance through Resolution 2022-97 to allow a setback of two (2) feet along the northern lot line on the property addressed 3887 Hallmark Avenue North, with condition included in resolution. A MOTION WAS MADE BY MAYOR REINKE, SECONDED BY COUNCIL MEMBER INGEBRIGTSON TO APPROVE A VARIANCE THROUGH RESOLUTION 2022-97 TO ALLOW A SETBACK OF TWO (2) FEED ALONG THE NORTHERN LOT LINE ON THE PROPERTY ADDRESSED 3887 HALLMARK AVENUE NORTH, WITH CONDITION INCLUDED IN RESOLUTION. 3 AYES 2 NOS Zang Vang and Mary Yang –Conditional Use Permit for an Oversized Accessory Structure b) Request to approve a Conditional Use Permit through Resolution 2022-96 regarding oversized accessory structure for the property addressed 2147 Helena Road North, with conditions included in resolution. A MOTION WAS MADE BY COUNCIL MEMBER INGREBRIGTSON, SECONDED BY COUNCIL MEMBER ZABEL TO APPROVE A CONDITIONAL USE PERMIT THROUGH RESOLUTION 2022-96 REGARDING OVERSIZED ACCESSORY STRUCTURE FOR THE PROPERTY ADDRESSED 2147 HELENA ROAD NORTH WITH CONDITIONS INCUDED IN RESOLUTION. 5 AYES Amend Final Plat for Willowbrooke 6th Addition REGULAR MEETING MINUTES SEPTEMBER 27, 2022 PAGE FIVE a) Request that City Council waive the reading and adopt Resolution 2022-100, approving the Amended Final Plat with conditions as outlined in the resolution. A MOTION WAS MADE BY COUNCIL MEMBER SWEDBERG, SECONDED BY COUNCIL MEMBER INGEBRIGTSON TO APPROVE THE AMENDED FINAL PLAT WITH CONDITIONS AS OUTLINED IN THE RESOLUTION. 5 AYES CITY ATTORNEY No report ADMINISTRATOR'S REPORT No report COUNCIL PRESENTATIONS Mayor Reinke shared three updates; 1. There were two Business Retention, Expansion and Attraction (BREA) visits since the last Council meeting. The locations visited were Park Tool on 9/16/22 and Animal Emergency and Referral Center of MN on 9/20/22. 2. Farmer’s Market Wednesday, September 28, 2pm – 6:30pm, the Farmer’s Market will run through October 12, 2022. 3. Ballot Questions – the community will see two (2) questions on the ballot this voting period for Local Option Sales Tax (L.O.S.T.), one of the questions is for the expansion and remodel of the current Police Department facility and one is for the construction of a new Public Works facility. The Mayor pointed out there will be an open house held on October 3 at 7:30pm at the Oakdale City Hall for residents of the community to come and ask questions and /or raise concerns on the proposed L.O.S.T ballot question. CLAIMS (Recommendation: Approve Claims for the period September 13, 2022 to September 27, 2022 of in the amount of $2,064,441.85) A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER SWEDBERG TO APPROVE CLAIMS FOR THE PERIOD SEPTEMBER 13, 2022 TO SEPTEMBER 27, 2022 IN THE AMOUNT OF $2,064,441.85. 5 AYES ADJOURNMENT A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER SWEDBERG TO ADJOURN THE MEETING AT 7:46PM Respectfully Submitted, Katie Robinson Deputy City Clerk
