CALL TO ORDER
A regular meeting of the City Council of the City of Oakdale was held on May 9, 2023, at Oakdale City Hall,
1584 Hadley Avenue, Oakdale, Minnesota. The meeting was called to order by Mayor Kevin Zabel at 7:00
PM.

a) Stormwater Pollution Prevention Plan (SWPPP)
Consulting Engineer Brian Bachmeier presented the Annual Report for the 2022 Municipal
Separate Storm Sewer System (MS4).
Mayor Zabel opened the public hearing and welcomed comments from the audience. No
comments were heard. Mayor Zabel closed the public hearing.
OPEN FORUM
a) Proclamation: Public Works Week
Mayor Zabel proclaimed the week of May 21st – 27th as “Public Works Week”.
b) Proclamation: National Police Week
Mayor Zabel proclaimed the week of May 14th – 20th as “National Police Week”.
c) Certificate of Recognition: Tree Board Member
Mayor Zabel thanked resigning Tree Board Member Stan Karwoski for his service to the City for
the last 25+ years. Commissioner Karwoski was presented with a certificate of recognition.
Mayor Zabel invited comments from the audience. No comments were heard.
CONSENSUS MOTIONS
a) Request that the City Council approve the reappointment of the below noted individual to the
IPMC Board of Appeals.
Bob Stiglich Term to Expire: December 31, 2025
b) Request that the City Council authorize the Mayor and City Administrator to enter into an
agreement with Hugo’s Tree Care for tree stump removal services in the amount of $26,090.63.

c) Request per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031,
Section 5.0, that the City Council appoint John Dardis and Joshua Hyde as Public Works
Seasonal Workers with an effective date of May 15, 2023, at a rate of pay equal to $17.00/hour
and $16.50/hour, respectively.
d) Request that the City Council approve the issuance of a temporary on-sale liquor license to the
Protez Foundation for their event to be held on May 21, 2023 at their location, 3510 Hopkins
Place.

ADVISORY BOARDS AND COMMISSIONS
Economic Development Commission (met on 5/3/23, Council Liaison Her)
Council Member Her reported that the Economic Development Commission gave an update on
the Business Retention, Expansion, and Attraction (BREA) program.
Environmental Management Commission (no meeting, Council Liaison Zabel)
Planning Commission (5/4/23 meeting cancelled, Council Liaison Ingebrigtson)
Parks and Recreation Commission (no meeting, Council Liaison Morcomb)
Tree Board (no meeting, Council Liaison Olson)
AWARD OF BID
a) City Project R2023-01: 2023 Street Improvements
Mr. Bachmeier explained that pursuant to Council authorization, bids were collected for City
Project R2023-01. Five contractors submitted bids for the work. Miller Excavating, Inc. submitted
the low bid of $4,005,933.33 which was slightly higher than the Engineer’s estimate of
$3,933,000.00, and more than the budgeted amount for the project. Due to this, Mr. Bachmeier
noted the amended budget to accommodate for this. He added that the final project cost may
come in lower than the estimate therefore there may be another amended budget at the
conclusion of the project. He recommended awarding the contract to Miller Excavating, Inc. and
stated that part of the recommendation is also to authorize the Mayor and City Administrator to
enter into a service contract agreement with SEH, Inc. for construction management and
inspection.
Mayor Zabel expressed his concern with the cost of this project, and the use of general
obligation (GO) bonds to cover the overage amount. He requested that the portion of the request
about amending the 2023 budget be taken out so staff could look at other internal ways to fund
the project.

City Administrator Chris Volkers stated that staff has done research and the recommendation
before the Council is based off of that research. She indicated that Council has the authority to
table the recommendation and look for other ways to fund the project. Council Member
Morcomb noted that if this project gets delayed that could create a chain effect resulting in the
delay of other City projects. Council Member Ingebrigtson noted that in this case he is supportive
of staff’s recommendation for the use of GO bonds. Council Member Her was supportive of the
recommendation as presented.
A MOTION WAS MADE BY COUNCIL MEMBER MORCOMB, SECONDED BY COUNCIL MEMBER
INGEBRIGTSON TO WAIVE READING AND ADOPT RESOLUTION 2023-52, AWARDING THE BID FOR CITY
PROJECT R2023-01 (2023 STREET IMPROVEMENTS) TO MILLER EXCAVATING, INC. IN THE AMOUNT OF
$4,005,933.33 AND AMENDING THE 2023 BUDGET; AS WELL AS AUTHORIZING THE MAYOR AND CITY
ADMINISTRATOR TO SIGN AN ENGINEERING SERVICE CONTRACT WITH S.E.H. FOR CONSTRUCTION
RELATED ENGINEERING SERVICES IN AN AMOUNT NOT TO EXCEED $385,000).

a) Amending the Site Plan Conditions for Impact Apartments and Approving a Temporary Property Use
Agreement with Norhart Construction Relating to City Owned Property on Outlot A of the Helmo
Station Addition
After a brief discussion, it was determined that a portion of this agenda item will be tabled until
the final terms of the agreement have been established.

RESOLUTION 2023-53, AMENDING THE SITE PLAN CONDITIONS FOR IMPACT APARTMENTS AND TO
TABLE THE AUTHORIZATION OF THE MAYOR AND CITY ADMINISTRATOR TO SIGN A TEMPORARY
PROPERTY USE AGREEMENT BETWEEN NORHART CONSTRUCTION AND THE CITY OF OAKDALE, FOR THE
STAGING OF CONSTRUCTION EQUIPMENT AND MATERIALS ON OUTLOT A OF THE HELMO STATION
ADDITION.

ADMINISTRATOR'S REPORT
a) Award of Contract for Construction Management at Risk Services for City Project B2024-01
(Construction of New Public Works Facility)
Ms. Volkers provided a brief overview of the proposed award of contract for Construction
Management at Risk services and noted staff’s recommendation to award the contract to Kraus-
Anderson (K-A) Construction. She highlighted a few of the agreement terms that differed from the
K-A RFP response dated April 3, 2023.

Council Member Ingebrigtson thanked City staff (past and present) for their work on this project
as well as Oakdale residents for approving the local option sales tax.
In response to Council Member Olson’s question about K-A’s role in the cleanup of the site, Ms.
Volkers stated that as the City’s partner they will work in tandem with the City and the architect,
and the City has hired outside who will represent the City’s interest in ensuring that the site meets
the Minnesota Pollution Control Agency standards.
Council Member Olson noted that she does not support building the Public Works facility on this
piece of land, but does support the overall project.

AUTHORIZE THE MAYOR AND CITY ADMINISTRATOR TO ENTER INTO AN AGREEMENT WITH KRAUS-
ANDERSON CONSTRUCTION COMPANY FOR CONSTRUCTION MANAGEMENT AT RISK SERVICES FOR CITY
PROJECT B2024-01 (CONSTRUCTION OF A NEW PUBLIC WORKS BUILDING), IN ACCORDANCE WITH THEIR
PROPOSAL DATED APRIL 3, 2023.

COUNCIL PRESENTATIONS
Mayor Zabel made announcements about the following:
• Public Works is flushing out fire hydrants this week. If tap water appears discolored, it is still
safe to drink, but residents should let it run for a few minutes and it should clear up. There is
a tentative map of the flushing schedule on the City’s website.
• Throughout the month of May, the City is looking the other way on the grass height ordinance
so residents that want to participate in No Mow May can do so. Participation is voluntary. More
information can be found on the City’s website.
• The Oakdale Spring Photo Contest is now open. Residents can submit photos taken in the City
by May 31, 2023. More information can be found on the City’s website.
• Residents can submit nominations for the Acorn Award through the City’s website until June
30, 2023.
