REGULAR MEETING MINUTES OAKDALE CITY COUNCIL November 14, 2023 CALL TO ORDER A regular meeting of the City Council of the City of Oakdale was held on November 14, 2023, at Oakdale City Hall, 1584 Hadley Avenue, Oakdale, Minnesota. The meeting was called to order by Mayor Kevin Zabel at 7:00 PM. Mayor Zabel invited comments from the audience. No comments were heard. CONSENSUS MOTIONS City Administrator Chris Volkers recommended that the Council pull and table consensus item d) to allow staff to provide further information. Council Member Morcomb pulled consensus item d). A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER WILLENBRING TO APPROVE CONSENSUS MOTIONS A-C, AS PRESENTED: a) Request that the City Council waive reading and adopt Resolution 2023-109, Designating 2024 Polling Locations, per Minnesota Statutes 204B.16. Request that the City Council authorize the Mayor and City Administrator to sign and execute the Joint Powers Agreement for Election Services with Washington County. b) Request that the City Council waive reading and adopt Resolution 2023-112, adoption of the Washington County All-Hazard Mitigation Plan. c) Request that the City Council waive reading and adopt Resolution 2023-115, approving the Memorandum of Agreement between the City of Oakdale and Minnesota Teamsters Public and Law Enforcement Employee’s Union Local #320, relating to Health Care Savings Plan (HCSP) Participation. 5 AYES Consensus item d) Request that the City Council approve the issuance of a Tobacco Sales License for the current term to expire on December 31, 2023, to A&M Trading LLC dba Super Smokedale at 7141 10th Street North. A MOTION WAS MADE BY COUNCIL MEMBER MORCOMB, SECONDED BY COUNCIL MEMBER INGEBRIGTSON TO TABLE CONSENSUS MOTION D FOR FUTURE CONSIDERATION AT THE NOVEMBER 28, 2023 REGULAR CITY COUNCIL MEETING. 5 AYES 2 ADVISORY BOARDS AND COMMISSIONS Economic Development Commission (11/1/23 meeting cancelled, Council Liaison Her) Environmental Management Commission (no meeting, Council Liaison Zabel) Planning Commission (met on 11/2/23, Council Liaison Ingebrigtson) Council Member Ingebrigtson reported that the Planning Commission reviewed the Department of Natural Resources (DNR) shoreland setback requirements, specifically related to Tanners Lake. Parks and Recreation Commission (met on 10/17/23, Council Liaison Morcomb) Council Member Morcomb reported that the Parks and Recreation Commission welcomed two new commissioners and heard a presentation from the Oakdale Pickleball Club. Tree Board (no meeting, Council Liaison Willenbring) AWARD OF BID None STAFF REPORTS COMMUNITY DEVELOPMENT a) Oakdale Farm Fourth Addition – Final Plat Community Development Director Andy Gitzlaff explained that Larson Family Real Estate, LLLP, the property owner, requests Final Plat approval for Oakdale Farm Fourth Addition. He noted that as part of the Site Plan approval for this property, a development agreement was previously prepared and approved by the City Council, and a park dedication payment was also fulfilled as part of the Oakdale Farm 3rd Addition final plat. Mr. Gitzlaff reviewed the conditions of approval listed in the resolution. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER HER TO WAIVE READING AND ADOPT RESOLUTION 2023-116, APPROVING THE FINAL PLAT FOR OAKDALE FARM 4TH ADDITION, SUBJECT TO CONDITIONS LISTED IN THE ATTACHED RESOLUTION. 5 AYES b) Oakdale Pedestrian and Bicycle Plan Approval Community Development Specialist Max Lohse reviewed the phases and goals of the Plan, the community engagement events that were held to obtain feedback, and thanked all those who helped with the creation and finalization of the Plan. Mayor Zabel noted that the development of the Plan was a long process, but the end result provides a holistic look at the City’s bicycle and pedestrian facilities and amenities. He thanked everyone that was involved with the Plan. 3 A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER MORCOMB TO ADOPT THE OAKDALE PEDESTRIAN AND BICYCLE PLAN. 5 AYES ENGINEERING a) Change Order for City Project P2023-05; Willowbrooke Trails, and Amending the 2023 Budget City Engineer Jesse Farrell noted that Alliant Engineering provided the final design of the trail improvements, and the City Council awarded the contract, in the amount of $149,779, to Hobs Excavating, Inc. at the May 23, 2023 regular City Council meeting. During the course of construction, there was an unexpected discovery of soils with poor structural qualities. Mr. Farrell explained that the soil correction is necessary to avoid premature pavement failures, and future costly repairs. Additionally, the soil correction caused a disturbance that required a level of restoration, and hydroseeding was the most cost-effective solution. Mr. Farrell requested that the Council approve the Change Order and revise the 2023 budget. Of note, the original funding was moved from debt to Park Capital Fund reserves as this fund can absorb the $30,219.48 Change Order. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER WILLENBRING TO WAIVE READING AND ADOPT RESOLUTION 2023-114, APPROVING THE CHANGE ORDER FOR CITY PROJECT P2023-05 (WILLOWBROOKE TRAILS) WITH ALLIANT FOR HOBS EXCAVATING, INC. WORK, AND AMENDING THE 2023 BUDGET. 5 AYES CITY ATTORNEY No report ADMINISTRATOR'S REPORT a) Updating City Council Advisory Boards and Commissions Governing Documents Ms. Volkers explained that the four actions for Council consideration are related to a lengthy process to review and merge all board and commission policies, ordinances, and bylaws for consistency. She noted that the Council had input on the proposed changes as these are the City Council’s advisory boards and commissions. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER HER TO REPEAL THE CURRENT CITY ADVISORY BOARDS AND COMMISSIONS BYLAWS IN THEIR ENTIRETY. 5 AYES A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER WILLENBRING TO WAIVE READING AND ADOPT ORDINANCE NO. 914, AMENDING THE CODE OF ORDINANCES FOR THE CITY OF OAKDALE, CHAPTER 6 – SOLID WASTE AND ENVIRONMENT, ARTICLE 1 – ENVIRONMENTAL MANAGEMENT COMMISSION; CHAPTER 8 – ECONOMIC DEVELOPMENT; CHAPTER 15 – PARKS AND RECREATION, ARTICLE 1 – PARKS AND RECREATION COMMISSION; CHAPTER 16 – PLANNING AND DEVELOPMENT, ARTICLE 1 – PLANNING COMMISSION; AND CHAPTER 22 – TREES, ARTICLE 7 – TREE BOARD. 4 5 AYES A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER MORCOMB TO AMEND CITY POLICY MIS-013: BOARDS AND COMMISSIONS APPOINTMENT AND REAPPOINTMENT PROCESS, AND RENAME AS CC-002: CITY COUNCIL ADVISORY BOARDS AND COMMISSIONS. 5 AYES A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER WILLENBRING TO WAIVE READING AND ADOPT RESOLUTION 2023-111, AUTHORIZING PUBLICATION OF ORDINANCE NO. 914 BY TITLE AND SUMMARY. 5 AYES COUNCIL PRESENTATIONS Mayor Zabel made announcements about the following: • Officials from Oakdale and North St. Paul along with Ramsey and Washington Counties, welcomed State Legislators to the intersection of Highways 120 & 36. Cities and Counties are asking the State to dedicate funding to redo this dangerous intersection. Thank you to those that came out to see the problem firsthand. • The Art Discovery Fair is taking place on Saturday, November 18th from 10 AM – 3 PM at the Discovery Center. • Fall photo submissions are being accepted until November 30th for the Oakdale Fall Photo Contest. More information can be found at www.oakdalemn.gov. • Winter parking restrictions began November 1st, and will remain in effect until April 1st. No on- street parking is permitted from 12 AM – 5 AM every day. Additionally, no on-street parking is permitted any time following 2” or more of snow until the snow removal has been completed. Residents are able to fill out a Temporary On-Street Parking Request through the Police Department. • Thanksgiving is next week, and City Hall will be closed on Thursday and Friday.
