April 9, 2024
CALL TO ORDER
A regular meeting of the City Council of the City of Oakdale was held on April 9, 2024 at Oakdale City Hall,
1584 Hadley Avenue North, Oakdale, Minnesota. The meeting was called to order by Mayor Kevin Zabel
at 7:00 PM.

a) Proclamation: Fair Housing Month
Mayor Zabel proclaimed the month of April, 2024 as “Fair Housing Month”.
CONSENSUS MOTIONS
a) Request that the City Council waive reading and adopt Resolution 2024-36, accepting municipal re-
cycling grant funds in the amount of $52,478 from Washington County to the City of Oakdale, and
authorizing the Mayor and City Administrator to execute the 2024 Washington County Municipal Re-
cycling Grant agreement.
b) Request that the City Council approve the issuance of a purchase order by the City Administrator for
picnic tables from Flagship Recreation through the Minnesota State Contract in a total amount not to
exceed $31,722.98 for City Project P2023-04 (Willowbrooke Commons).
c) Request that the City Council authorize the Mayor and City Administrator to sign and execute the
amendment to Real Property Donation Agreement with 3M.
d) Request that the City Council approve a one-year extension, with an expiration date of May 7, 2025,
for Rios de Agua Viva to obtain a building permit for the proposed church at 7287 Stillwater Boulevard
N.
e) Request that the City Council authorize the Mayor and City Administrator to sign and execute the
encroachment license agreement with Impact Apartments I, LLC.
f) Request that the City Council waive reading and adopt Resolution 2024-35, accepting the improve-
ments and authorizing final payment for City Project R2023-02 (Street Overlay) to Bituminous Road-
ways, Inc. in the amount of $40,034.35.
g) Request that the City Council approve the renewal of liquor licenses to the listed businesses herein
for the period April 10, 2024 – March 31, 2025 on the condition that the license is approved by the
State of MN.
h) Request that the City Council approve the purchase of a Maclean MV 5 Municipal Tractor from ABM
Equipment & Supply for an amount not to exceed $169,817 through the State of Minnesota Cooper-
ative Purchasing Venture which includes the trade-in of City Vehicle 3317, in the amount of $14,000,
and trade in of an 84” Maclean snow blower, in the amount of $5,200, and authorize the Mayor and
City Administrator to accept the quote for such.

Council Member Ingebrigtson stated that training on general advisory board responsibilities and
planning/zoning was completed with members of Planning Commission; and that there was an
application for an accessory dwelling.

STAFF REPORTS
POLICE
a) Liquor Sales License Renewal Request – Oak Liquor
Police Chief Nick Newton reviewed the Request for Council Action regarding Oak Liquor.
Council Member Ingebrigtson asked if the establishment passed any compliance checks in
2023. Chief Newton stated that no other compliance checks were done in 2023 aside from the
two that were failed.
Mayor Zabel invited the applicant, Toua Lor, to speak on the matter if desired. Prior to Mr. Lor’s
comments, Assistant City Attorney Rachel Tierney provided clarity on the recommendation before
the Council. She recommended that if it is the decision of the Council to deny the license, then
the license denial should be carried over to the subsequent meeting and staff are directed to
prepare a resolution outlining the basis of denial. Then Mr. Lor is provided the right to a hearing.
Mr. Lor explained the timeline that led to the lapse in licensing, explaining that a new owner
transfer fell through at the last minute, and it was past the deadline to renew the liquor license.
He also acknowledged the order by the Police Department to stop liquor sales, but felt it would
be a hardship on the business to comply.
Council Member Her asked if there was any path forward for the applicant to get back into
compliance. Attorney Tierney addressed the options available to the City. Council Member Her
said that even though the applicant’s lapse in transaction lead to challenges, he implored the
Council to find a solution other than barring them from being licensed to do business in Oakdale.

Mayor Zabel stated that as a City, Oakdale has a City Code to defend, and that it should be
respectful of all licensees who do follow the rules. Council Member Ingebrigtson stated although
he understands the circumstances, he also does not support making any exception.

WILLENBRING TO DENY ISSUANCE OF A LIQUOR SALES LICENSE FOR THE CURRENT TERM TO OAK
LIQUOR INC. DBA OAK LIQUOR AT 1801 GENEVA AVENUE NORTH AND BRING BACK FINDINGS IN
RESOLUTION FORMAT FOR FORMAL ACTION AT THE NEXT COUNCIL MEETING ON APRIL 23, 2024. THE
LICENSEE CONTINUES TO BE UNLICENSED SINCE APRIL 1, 2024.

PUBLIC WORKS – UTILITIES
a) Request for Additional Funds for City Project U2024-03 (Lift Station 11 Emergency Generator
Replacement)
Utilities Division Superintendent Mike Kothe presented the request for purchase and why addi-
tional funds are needed.

WAIVE READING AND ADOPT RESOLUTION 2024-37, APPROVING THE REQUEST FOR ADDITIONAL FUNDS
FOR CITY PROJECT U2024-03 (LIFT STATION 11 EMERGENCY GENERATOR REPLACEMENT), FOR THE
PURCHASE OF AN EMERGENCY GENERATOR REPLACEMENT, IN A TOTAL AMOUNT OF $129,500,
THROUGH THE SOURCEWELL COOPERATIVE PURCHASING CONTRACT, AND AMENDING THE 2024
BUDGET AND AUTHORIZING THE MAYOR AND CITY ADMINISTRATOR TO SIGN AND EXECUTE THE QUOTE
FOR THE EQUIPMENT PURCHASE.

CITY ATTORNEY
a) On-Site Gambling Premises Permit Request – White Bear Lake Area Hockey Association
Assistant City Attorney Tierney explained the request by White Bear Lake Area Hockey Association.
At the Councils request last meeting, City Attorney Jim Thompson drafted a Resolution for the City
as is needed for denial of the request for a premises permit in Oakdale.
Kevin Bergerson, Gambling Manager for the WBLAHA, stated that the majority of proceeds go to
the Association, but they give back to a lot to charities as well. He added that allowing this request
would also benefit The Burrow as well as the City of Oakdale.
Mayor Zabel made comments about the current ordinance language, and hoped the City will
continue to work on a more open, and emerging policy related to charitable gambling in Oakdale.

COUNCIL PRESENTATIONS
Mayor Zabel made announcements about the following:
• Washington County is hosting four Open Book meetings in April, including one at Oakdale City Hall
on Wednesday, April 10th from 5 to 7 PM.
• Next week is Park Clean Up Week, and the City is looking for volunteers. Parks may be cleaned
any time during Park Clean Up Week, April 22nd through 28th. Garbage bags are provided, and
each participant will receive a complimentary thank you gift. To volunteer, call Oakdale Recreation
at 651-747-3860.
• All trees have been reserved for the Pete Graske Arbor Day Tree Giveaway on Saturday, April 27th
at Walton Park.
• A free mobile paper shredding event sponsored by Eberhard Group Real Estate will be held on
Saturday, April 27th from 9 AM to Noon in the northeast corner of the City Hall parking lot.
• The Maplewood Oakdale Lions Club will again host the Citywide Garage Sale from Thursday, May
2nd through Saturday, May 4th. To add your sale to the list, visit the Maplewood Oakdale Lions Club
