REGULAR MEETING MINUTES OAKDALE CITY COUNCIL August 14, 2024 CALL TO ORDER A regular meeting of the City Council of the City of Oakdale was held on August 14, 2024 at Oakdale City Hall, 1584 Hadley Avenue North, Oakdale, Minnesota. The meeting was called to order by Mayor Kevin Zabel at 7:00 PM. Ms. Wilson thanked the City and her fellow commissioners for all she learned during her time on the Environmental Management Commission. b) Certificate of Recognition: Economic Development Commissioner – Dave Halper Mayor Zabel read a message from Dave Halper stating how he enjoyed his time on the Economic Development Commission, and is impressed by the dedication of City staff and the City Council. Mayor Zabel thanked Mr. Halper for his service. Mayor Zabel invited comments from the audience. No comments were heard. CONSENSUS MOTIONS Mayor Zabel pulled consensus item c). A MOTION WAS MADE BY COUNCIL MEMBER WILLENBRING, SECONDED BY COUNCIL MEMBER INGEBRIGTSON TO APPROVE CONSENSUS MOTIONS A, B, AND D-G, AS PRESENTED: a) Request per City of Oakdale Code of Ordinances, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Neil Hiatt as full-time proba- tionary Public Works Lead Worker – Utilities effective September 4, 2024, at a rate of pay con- sistent with the City base pay schedule. 2 b) Request per City of Oakdale Code of Ordinances, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Connor Papenfuss as full-time probationary Utilities Technician effective August 15, 2024, at a rate of pay consistent with the City base pay schedule. d) Request per City of Oakdale Code of Ordinances, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Jeffrey Robinson as full-time probationary Police Officer effective August 29, 2024, at a rate of pay consistent with the City base pay schedule. e) Request that the City Council authorize the Mayor and City Administrator to enter into a coopera- tion agreement with Washington County for the Community Development Block Grant effective October 1, 2024, to September 30, 2027. f) Request that the City Council authorize the Mayor and City Administrator to enter into an agree- ment with Stensland Inspections to provide building inspection support services through Decem- ber 31, 2026. g) Request that the City Council waive reading and adopt Resolution 2024-67, Accepting Grant Funds in the amount of $31,000 from the MPCA and the MN DNR to the City of Oakdale and authorize the City Administrator to execute documents accordingly. 5 AYES CONSENSUS ITEM C): REQUEST PER CITY OF OAKDALE CODE OF ORDINANCES, CHAPTER 2, ARTICLE IV, SEC.2-36 (C) AND PER CITY PERSONNEL POLICY PE-031, SECTION 5.0, THAT THE CITY COUNCIL APPOINT JAKE FOSTER AS FULL-TIME PROBATIONARY ASSISTANT CITY ADMINISTRATOR EFFECTIVE SEPTEMBER 11, 2024, AT A RATE OF PAY CONSISTENT WITH THE CITY BASE PAY SCHEDULE. Mayor Zabel mentioned that this position has not been filled for a number of years, but has become a need for the City due to its tremendous growth. He briefly touched on Mr. Foster’s experience and welcomed him into his new role. A MOTION WAS MADE BY MAYOR ZABEL, SECONDED BY COUNCIL MEMBER INGEBRIGTSON TO APPROVE CONSENSUS MOTION C, AS PRESENTED. 5 AYES ADVISORY BOARDS AND COMMISSIONS Economic Development Commission (met on 8/7/24, Council Liaison Her) Council Member Her reported that the Economic Development Commission discussed the Park System Plan Update and received an update on the Business Retention, Expansion, and Attraction visits. Environmental Management Commission (no meeting, Council Liaison Zabel) Planning Commission (met on 8/1/24, Council Liaison Ingebrigtson) 3 Mayor Zabel attended in Council Member Ingebrigtson’s place. Mayor Zabel reported that the Planning Commission had two public hearings, one for the Planned Unit Development Amendment of the MWF Properties site at 390 Helmo Ave N, and the other for the Oakdale Marketplace Planned Unit Development Amendment and the Oakdale Station Planned Unit Development Amendment. Parks and Recreation Commission (no meeting, Council Liaison Morcomb) Tree Board (no meeting, Council Liaison Willenbring) AWARD OF BIDS a) Award Public Works Facility Bids and Amendment to Kraus-Anderson Guaranteed Maximum Price Agreement Don Theisen, Owner’s Representative for the new Public Works facility, started out by complimenting various agencies and individuals who have worked on the project and helped move it along. He presented the project site update and the bid process. Of note, the base bid and recommended Alternate Bids (22-foot addition to fleet storage space, fuel island, precast black aggregate, and exterior precast paint) meet the project budget. Mr. Theisen explained that there are 31 contracts to award, with the City holding five non-union contracts and Kraus-Anderson holding the remaining union contracts. Ken Francois, Construction Project Manager with Kraus-Anderson Construction Company, reviewed the bid results in great detail. There were 142 bids received across 31 divisions of work. Mr. Francois noted that the following will be rebid: Specialty Doors, Cranes and Hoists, and the Fabric Supported Air Structure (Salt Shed). All contracts held by Kraus-Anderson will be included in the Guaranteed Maximum Price of $24,383,980. Mr. Theisen reviewed the project budget update and the project schedule. There were two additional sources of revenue – watershed grants and additional 3M reimbursements. Construction is set to begin in October 2024 and the opening of the new Public Works facility is slated for November 2025. City Administrator Chris Volkers shared appreciation for the Council’s willingness to listen to staff’s recommendations especially as it relates to the Alternate Bids. She stated that 3M, Kraus- Anderson, HCM Architects, and Mr. Theisen have been great partners throughout this process. Council Member Morcomb inquired about the significant number of bids received. Mr. Theisen stated that Kraus-Anderson made sure to get the word out about the available bids. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER HER TO WAIVE READING AND ADOPT RESOLUTION 2024-65, AWARDING THE BIDS FOR CITY PROJECT B2024-01 (CONSTRUCTION OF NEW PUBLIC WORKS FACILITY), AND AUTHORIZING THE MAYOR AND CITY ADMINISTRATOR TO SIGN AND EXECUTE THE KRAUS-ANDERSON CONSTRUCTION COMPANY GUARANTEED MAXIMUM PRICE AMENDMENT DATED AUGUST 14TH, 2024. Mayor Zabel reiterated the effort that has gone into this process and getting the project where it is today. He thanked all the valued partners the City has had along the way. 5 AYES 4 STAFF REPORTS PUBLIC WORKS a) Change Order Authority for New Public Works Facility Mr. Theisen spoke on the request to give the City Administrator change order authority on the new Public Works facility project. He noted that change orders are a necessary component of the project that need timely review and approval. The change order review process will include HCM Architects, Kraus-Anderson, and the Owner’s Representative, with a recommendation provided to the City Administrator. Mr. Theisen explained that the City Administrator will be given the authority to approve an individual change order up to $100,000 provided the increase in project cost is within the approved project budget of $31,392,323. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER WILLENBRING TO AUTHORIZE THE CITY ADMINISTRATOR TO APPROVE INDIVIDUAL CHANGE ORDERS UP TO $100,000 PROVIDED THE INCREASE IN PROJECT COST IS WITHIN THE CITY COUNCIL APPROVED PROJECT BUDGET OF $31,392,323.00 RELATED TO THE CONSTRUCTION OF THE NEW PUBLIC WORKS FACILITY. 5 AYES CITY ATTORNEY No Report ADMINISTRATOR'S REPORT a) Approve LOST Ballot Questions for 2024 General Election Ms. Volkers explained that the City returned to the Minnesota Legislature in 2023 to ask for authority to extend the duration and amount of the current local option sales tax (L.O.S.T.). The L.O.S.T. increase would be $3 million for the Police facility (for a total of $18 million over 30 years) and $6 million for the Public Works facility (for a total of $28 million over 30 years). She added that if this extension is not approved by the voters, the additional $9 million will be collected through resident property taxes. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER MORCOMB TO WAIVE READING AND ADOPT RESOLUTION 2024-66, CALLING FOR AN ELECTION RELATING TO THE EXTENSION OF AN EXISTING SALES AND USE TAX AND THE ISSUANCE OF BONDS FOR PURPOSES OF THE NEW PUBLIC WORKS FACILITY AND EXPANSION AND REMODEL OF THE POLICE FACILITY AND CALLING A SPECIAL ELECTION THEREON. 5 AYES COUNCIL PRESENTATIONS Council Member Ingebrigtson wished his twin boys a happy birthday! Council Member Her thanked the residents who participated in Night to Unite last week. He also thanked City staff for all their hard work. 5 Mayor Zabel made announcements about the following: • A big thank-you to the residents who participated in Night to Unite last week. • The Oakdale Farmers Market continues every Wednesday from 2 to 6 PM in the City Hall parking lot through mid-October. • At the August 21st Farmers Market, the City will have a community booth to learn about the Park System Plan Update. The Park System Plan survey is open through August 31st. Visit the City website, www.oakdalemn.gov, to learn more and take the survey. • Consider applying for a City advisory body. The City currently has openings for the Economic Development Commission and the Environmental Management Commission. Each commission meets eight times per year.
