March 5, 2020
The Oakdale Planning Commission held a meeting on Thursday, March 5, 2020 at Oakdale City Hall,
1584 Hadley Avenue North, Oakdale, Minnesota. The meeting began at 7 PM with the Pledge of
Allegiance.

PUBLIC HEARINGS
a. CONDITIONAL USE PERMIT FOR A SECOND ACCESSORY BUILDING AT 6570 5TH STREET
Planner Shively presented a Conditional Use Permit (CUP) request for a second accessory building
(10’x10’ square foot open sided gazebo) at the home of Matt and Tara Falteisek, 6570 5th Street
North, zoned R3 (Low-Density Residential), in addition to an existing 10’x10’ square foot building
at that location. She explained that single family homes in R3 districts are allowed to have one
accessory building up to 150 square feet and that second accessory buildings or a larger single
accessory buildings require the approval of a Conditional Use Permit (CUP).
Ms. Shively stated that staff reviewed the CUP request and found it meets all the requirements in
the ordinance, therefore, staff recommends approval.
In response to Commissioner Diatta’s question whether an attached or detached garage is
considered an accessory building, Ms. Shively explained that single family homes are allowed
either one attached or detached garage up to 1,000 square feet and, in addition, one accessory
building, based on size determined by the zoning district, is also allowed.

In response to Commissioner Campbell’s question, Ms. Shively said that should one of the
accessory buildings be removed at some point, the homeowner could replace it provided it is a
building of the same size and meets the setback requirements; a larger building would require a
new CUP request.
In response to a question from Commissioner Boulliane, Ms. Shively stated that the applicants
contacted their neighbors, as per process, and no objections were noted.
In response to a question from Commissioner Stolarski, Mr. and Mrs. Falteisek explained that
their gazebo is open, not enclosed.
Commissioner Campbell asked if any language was needed to state that the requested CUP is for
use as a gazebo only.
Mr. Falteisek noted that he does not want any additional buildings on his property.
Planner Shively noted that having a hot tub or a lawn mower in the gazebo may be different, but
the land use impact is not significant as the structure is still being used for residential purposes.
In response to a question from Chair Pierson, Planner Shively confirmed that another CUP would
be needed if a future property owner wanted to remove the two 10’x10’ structures and build a
10’x11’ structure.
Chair Pierson opened the public hearing for comments from the audience.
Ms. Shively noted she received a phone call from the property owner at 6525 5th Street North and
Al Jantz supported the CUP request.
As no other comments were heard, Chair Pierson closed the public hearing.

LORD’S CHURCH)
Planner Shively presented a Conditional Use Permit (CUP) request to allow a church use at 7019
6th Street North. She stated that The Lord’s Church has been leasing space in an office building in
an I-O Industrial Office zoning district and that churches are allowed in that zoning district with a
Conditional Use Permit. Planner Shively further stated that the church did not realize a CUP was
needed. She noted that the commission would be reviewing whether there is sufficient parking
for the use and noted that the church’s activities typically take place on evenings and weekends
when other users in the building are not as active.

Planner Shively stated the church typically utilizes up to 15 parking spaces of the 127 parking
spaces on site. She added that the church’s use has been shown to be compatible with the other
uses in the building and there have not been any parking issues.
Ms. Shively stated that staff reviewed the CUP request and found it meets all the requirements in
the ordinance, therefore, staff recommends approval.
Pastor Thao Xiong from The Lord’s Church and David Johnson from Crossroads Properties,
landlord for property, were available for questions.
Chair Pierson asked whether the fire department identified any code(s) required for the assembly
use at the location.
Planner Shively replied that all new building permit requests are checked to make sure that the
use meets code. She added that she works with the building department to ensure that uses are
permitted and that all of the zoning code requirements are met when there are new tenants.
Chair Pierson opened the public hearing for comments from the audience.
David Johnson, Owner of Crossroads Properties, noted that commercial properties within the City
benefit from the annual inspection from the Oakdale Fire Department where issues can be
identified. He stated that he was not aware of the requirement for a Conditional Use Permit
relative to churches in I-O zoned districts.
Pastor Xiong shared that the church is comprised of seven families who utilize no more than 15
parking spaces of the 20 allotted to his leased space.
In response to a question from Commissioner Boulliane, Pastor Xiong stated he is hoping
membership continues to grow.
Commissioner Diatta questioned how the need for a CUP was discovered.
Pastor Xiong was contacted by Mr. Johnson and he, in turn, contacted the city planner.
Ms. Shively explained that a new tenant in the building applied for a building permit and she
requested information about other tenants to make sure parking balanced at this site and learned
about the church use.
As no other comments were heard, Chair Pierson closed the public hearing.

INFORMATIONAL ITEMS
a. Planning and Development Update
Planner Shively shared that the tent that was up at Peaceful Lodge, 6630 Hudson Boulevard, to
start the foundation work has come down and work on the building would begin shortly.
Ms. Shively noted that commissioners were provided a printed copy of the final 2040
Comprehensive Plan and that the final version is also available online. She thanked the
commissioners for their participation in the City’s Comprehensive Plan process and that a number
of applications that may come before the Planning Commission relate back comp plan goals.
Planner Shively also mentioned staff was working with the City’s Communication Specialist Alyssa.
Macleod on the public engagement relating to the Bike and Pedestrian Plan update, which is a
goal of the comp plan. She added that, earlier in the day, the City rolled out an online survey and
online wiki-map to gather residents’ experience of walking and biking in Oakdale. Ms. Shively
mentioned that the process would include in-person engagement for those that don’t have
internet access from the end of March and into April. She anticipated a meeting to be held in April
and would inform commissioners if this changes.
In response to a question from Commissioner Diatta regarding sand running across sidewalks and
into the sewer system, Ms. Shively asked that Commissioner Diatta email her with the locations so
she can pass the information along to other City staff.
In response to a question from Chair Pierson about the City’s new Adopt-A-Drain program, Planner
Shively shared that the Environmental Management Commission has initiated program to address
the leaves, dirt and garbage that gets into the curbs and gutters, into storm sewers, and then into
wetlands and lakes and that information for signing up is on the City’s website.

OTHER BUSINESS – Planning and Development Update
Ms. Shively announced that Taco Bell, 7049 10th St N, Oakdale, MN 55128, opened in October
2019.
Ms. Shively reminded the Commission that Peaceful Lodge, 6630 Hudson Blvd, Oakdale, MN
55128, is building a 33 unit addition to the assisted Living. They have installed Geo Technical
Piers to stabilize the building due to the high water table. There is currently a white tent at
the addition site in an attempt to warm the soil to get some masonry work done. Project is
scheduled to be complete summer of 2020.
Planner Shively provided informational updates regarding upcoming projects in 2020:
1) Gold Line Bus Rapid Transit is in another stage of engineering. Updates will be
provided to the Commission as the project progresses.
a. Part of Gold Line project is the new bridge over I94 connecting Helmo Avenue
to Bielenberg Drive in Woodbury. Councilmember Ingebrigtson asked who
would “own” the bridge. Planner Shively shared that MNDOT generally owns
the bridges over interstates; however, there have been conversations about
some bridges being turned back to local jurisdictions.
b. Possible planning actions in 2020 may include the re-platting of the station
area to establish the new lots, blocks and street alignments that are consistent
with the Master Plan for this area.
c. Construction of the Gold Line is set to begin in 2022 with completion 2024.
2) Tanners Lake Redevelopment site. The Council has entered into a preliminary
development agreement with an interested party to build a hotel and coffee shop.

3) Bicycle and Pedestrian Plan. Staff has been working with Toole Design Group to obtain
basic inventory information on sidewalks and trails and then looking at connections,
gaps and intersections to enhance safety. This spring, all boards and commissions will
be part of a stakeholder group sharing input and experiences.
4) 3M site. Developer has a preliminary purchase agreement with owner of site to build
the single family homes and some townhomes in the new neighborhood.
Ms. Shively reminded the Commission of the upcoming work session with the City Council on
January 28 from 6:00 - 6:30 pm.

INTRODUCTION
Single-family homes in the R-3 Low-Density Residential District are permitted one accessory building up
to 150 square feet (Sec. 25-36(b)(1)a)). Accessory buildings exceeding the size and number requirements
may be allowed via Conditional Use Permit (Sec.25-154(e)). This allows the City to review the request to
ensure the general and specific criteria in the ordinance are met so that additional or larger accessory
buildings can be determined to be suitable for the area.
Mike Falteisek (6570 5th Street North) recently purchased a hot tub and erected a 10’x10’ structure to
protect it from the elements. The gazebo structure is located on the east side of the garage. As there is
an existing 10’x10’ storage shed on the property, a Conditional Use Permit is needed to allow for two
accessory buildings on the site. (See Attachment A: Location Map and Attachment B: Site Plan).
COMPREHENSIVE PLAN DESIGNATION
The subject property is guided Low Density Residential in the City’s Comprehensive Plan.
ZONING DISTRICT REQUIREMENTS
The subject property is zoned R-3 Low Density Housing. Single-family homes may have one accessory
building up to 150 square feet. Accessory buildings exceeding that number may be permitted via
Conditional Use Permit.

ANALYSIS
The zoning ordinance states the following (Sec. 25-3-900(a)):
A conditional use is a permitted use that is allowed only when it is shown that the use meets certain
general and specific standards related to the proposed conditional use.

All conditional uses must meet seven general criteria in order for a permit to be approved. This allows the
City to review the potential impact(s) the use may have and ensure that the use is consistent with what
is envisioned for the area in the City’s Comprehensive Plan.
In addition, some conditional uses have specific criteria that must be met which are intended to address
potential issues that may arise associated with that type of use. If an application meets all of the criteria
in the ordinance, then a conditional use permit shall be granted.
General Criterial for Granting a Conditional Use Permit. The general criteria for granting a conditional use
permit (applicable to all conditional use permit requests) is listed in Section 25-3-900(g) of the Zoning
Code. The conditional use is evaluated according to the following criteria:
(1) The conditional use will be in conformity with the City’s comprehensive plan and with the
purpose, intent and applicable standards of this Ordinance.
The proposed use is in conformity with the city's comprehensive plan as the property is guided low-
density residential and accessory buildings are permitted residential accessory uses. This
condition is met.
(2) The conditional use shall be located, designated, maintained and operated to be compatible
with the existing or intended character of that zoning district in which it is located.
The lot at 6570 5th Street North exceeds R-3 lot area requirements by approximately 3,470
square feet. There is sufficient area for the two small accessory buildings on this property. This
condition is met.
(3) The use shall not be hazardous, detrimental or disturbing to present and potential surrounding
land uses due to noise, glare, smoke, dust, odor, fumes, water pollution, vibration, general
unsightliness or other nuisances.
The accessory buildings do not generate any nuisance conditions. This condition is met.
(4) The use shall not create traffic congestion, unsafe access or parking needs that will cause
inconveniences to the adjoining properties.
No additional traffic is generated by this use. This condition is met.
(5) The use shall be served adequately by essential public services, such as streets, police, fire
protection and utilities.
The existing home is served adequately by public services and the accessory buildings will not
require additional services beyond those that can be provided by existing utilities. This condition
is met.
(6) The use shall not create excessive additional requirements at public cost for public facilities
and services and shall not be detrimental to the economic welfare of the city.
The accessory buildings does not require any additional requirements at public cost. This
condition is met.
(7) The use shall preserve and incorporate the site's natural and scenic features into the
development design and cause minimal adverse environmental effects.
The two accessory buildings do not impact any natural features on the site and do not cause any
adverse environmental effects. This condition is met.

Specific Conditional Use Permit Criteria for Accessory Buildings Exceeding the Number and Size in the
Ordinance. The specific criteria for granting a conditional use permit is listed in Section 25-23(c)(9) of
the Zoning Code:
(a) The property where the structure is to be located cannot be reduced through subdividing as
long as the building remains on the site.
The parcel is not eligible for subdivision due to lot width. This condition is met.
(b) The building shall not be of a pole building type construction (defined as a structure that
utilizes treated lumber buried in the ground that serves as the building foundation).
The accessory buildings are not of a pole building type construction. This condition is met.
(c) No door or other access opening shall exceed ten (10) feet in height.
No doors or other access are greater than 10 feet in height. This condition is met.
(d) The structure shall not be used for commercial or industrial activities, except as allowed by
the regulations governing home occupations.
The applicant has stated that one accessory building will be used for residential storage and the
second accessory building shelters a hot tub. Both of these are residential uses. This condition
is met.
Additional Considerations. Applications for a Conditional Use Permit require notification of neighbors
within 100 feet of the subject property. The applicant has fulfilled the requirement.

ROLE OF THE PLANNING COMMISSION
The role of the Planning Commission is to review the Conditional Use Permit request as it relates to the
Comprehensive Plan and Zoning Ordinance requirements and provide a recommendation to the City
Council.
RECOMMENDATION
Staff has determined that the request for a Conditional Use Permit for two 10’x10’ accessory buildings
meets the requirements of the zoning ordinance. Staff recommends approval of the Conditional Use
Permit.
MOTION
Motion to recommend approval of the Conditional Use Permit for two 10’x10’ accessory buildings at 6570

At a meeting of the City Council of the City of Oakdale held on Tuesday, March 24, 2020 at Oakdale City
Hall, 1584 Hadley Avenue North, Oakdale, Minnesota, with the following members present: Mayor Paul
Reinke; Councilmembers Jake Ingebrigtson, Susan Olson, Colleen Swedberg, and Kevin Zabel and the
following members absent: None, the Oakdale City Council resolved:
WHEREAS, Mike Falteisek has requested a conditional use permit to allow two 10’x10’ accessory
buildings in the rear yard at 6570 5th Street North (Legal Description: Lot 16, Block 16, Tanners Lake
Heights Plat No.3), and
WHEREAS, the property is zoned R-3 Medium Density Residential and accessory buildings exceeding the
size and number requirements are allowed via conditional use permit, per Section 25-154(e), and
WHEREAS, the two accessory buildings meet the four specific standards (Sec. 25-23(c)(9)) and the seven
general criteria for granting a conditional use permit (Sec. 25-3-900), and
WHEREAS, the applicant meets all performance and setback requirements established in the ordinance,
and
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Oakdale hereby approves a
Conditional Use Permit for two 10’x10’ accessory buildings at 6570 5th Street North.

INTRODUCTION
The Lord’s Church is currently leasing space in an office building in an I-O Industrial Office zoning district
(See Attachment A: Location Map and Attachment B: Suite Location). Churches are allowed in an I-O
Industrial Office zoning district via Conditional Use Permit. This allows the City to review the request to
ensure the general criteria in the ordinance are met so that the use may be determined to be suitable for
the area.
The Lord’s Church has been leasing space at this location for approximately two years with a five-year
lease term. The use has been shown to be compatible with adjacent businesses and sufficient parking
exists on the site to accommodate attendees and staff (see Attachment C: Applicant Narrative and
Attachment D: Letter from the landlord/property manager).
COMPREHENSIVE PLAN DESIGNATION
The subject property is guided Industrial Office in the City’s Comprehensive Plan.
ZONING DISTRICT REQUIREMENTS
The subject property is zoned I-O Industrial Office. Churches are allowed in an I-O Industrial Office
District via Conditional Use Permit (Sec.25-21).

(2) The conditional use shall be located, designated, maintained and operated to be compatible
with the existing or intended character of that zoning district in which it is located.
The church activities typically take place in the evenings and on weekends when the majority of
other uses in the building are not active. The church’s office and assembly uses are compatible
with other office-industrial uses in the building. This condition is met.
(3) The use shall not be hazardous, detrimental or disturbing to present and potential surrounding
land uses due to noise, glare, smoke, dust, odor, fumes, water pollution, vibration, general
unsightliness or other nuisances.
The church use does not generate any nuisance conditions. This condition is met.
(4) The use shall not create traffic congestion, unsafe access or parking needs that will cause
inconveniences to the adjoining properties.
There are currently approximately 34 church members and the applicant states that there are
typically between twenty to thirty attendees (including children) on Sundays utilizing no more
than fifteen parking spaces. On weeknights and Saturdays, there are approximately ten
attendees. The church has been operating in this location for approximately two years and it has
been demonstrated during that time that there is sufficient parking available to accommodate
church attendees and staff as well as other uses on the site. This condition is met.
(5) The use shall be served adequately by essential public services, such as streets, police, fire
protection and utilities.
The existing building is served adequately by public services and the church use will not require
additional services beyond those that can be provided by existing utilities and services. This
condition is met.
(6) The use shall not create excessive additional requirements at public cost for public facilities
and services and shall not be detrimental to the economic welfare of the city.
The proposed use does not require any additional requirements at public cost. This condition is
met.
(7) The use shall preserve and incorporate the site's natural and scenic features into the
development design and cause minimal adverse environmental effects.
The church is leasing space in an existing building with no alterations to the site for this use. This
condition is met.

Additional Considerations. Applications for a Conditional Use Permit require notification of neighbors
within 100 feet of the subject property. The applicant has fulfilled the requirement.

ROLE OF THE PLANNING COMMISSION
The role of the Planning Commission is to review the Conditional Use Permit request as it relates to the
Comprehensive Plan and Zoning Ordinance requirements and provide a recommendation to the City
Council.
RECOMMENDATION
Staff has determined that the request for a Conditional Use Permit for a church use in this location meets
the requirements of the zoning ordinance. Staff recommends approval of the Conditional Use Permit.

APPROVING A CONDITONAL USE PERMIT FOR A CHURCH USE AT 7019 6TH STREET NORTH.
At a meeting of the City Council of the City of Oakdale held on Tuesday, March 24, 2020 at Oakdale City
Hall, 1584 Hadley Avenue North, Oakdale, Minnesota, with the following members present: Mayor Paul
Reinke; Councilmembers Jake Ingebrigtson, Susan Olson, Colleen Swedberg, and Kevin Zabel and the
following members absent: None, the Oakdale City Council resolved:
WHEREAS, The Lord’s Church has requested a conditional use permit to lease space at 7019 6th Street
North (Legal Description: Lot 1, Block 1, Oakdale Crossing), and
WHEREAS, the property is zoned I-O Industrial Office and a church is a conditional use in that zoning
district per Section 25-21, and
WHEREAS, the church use in this location meets the seven general criteria for granting a conditional use
permit (Sec. 25-3-900), and
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Oakdale hereby approves a
Conditional Use Permit for a church use at 7019 6th Street North.
