OCCOQUAN TOWN COUNCIL Regular Meeting Minutes - Draft Town Hall – 314 Mill Street, Occoquan, VA 22125 Tuesday, March 6, 2018 7:00 p.m. Present: Mayor Liz Quist, Vice Mayor Pat Sivigny, Councilmembers Matthew Dawson, Cindy Fithian, and Joe McGuire Absent: Councilmember Jim Drakes Staff: Kirstyn Jovanovich, Town Manager; Martin Crim, Town Attorney; Bruce Reese, Town Engineer; Adam Linn, Chief of Police 1. Call to Order Mayor Quist called the meeting to order at 7:02 p.m. 2. Pledge of Allegiance 3. Citizens Time None. 4. Approval of Minutes It was moved to approve the minutes of the February 6, 2018 Regular Meeting and February 20, 2018 Work Session Meeting. A motion was made by Councilmember Dawson seconded by Vice Mayor Sivigny that the Action Item be approved. The motion carried by poll vote, 3 Ayes (Dawson, Fithian, Sivigny) and 1 Nay (McGuire), motion passes 3-1. 5. Councilmember Reports No Report. 6. Mayor’s Report Mayor Quist, Ms. Jovanovich, and Mr. Reese met with Prince William County staff in regards to stormwater management. Prince William County indicated that they would help with stream remediation, grant opportunities, a high-level mapping exercise of the Town’s stormwater system, creating a plan to determine how to maintain an independent stormwater management program, and research what happened in 1993 when the Town opted out of the Prince William County Stormwater Management Program. 7. Staff Reports A. Town Attorney: Mr. Crim, Town Attorney, reported on the following: i. River Mill Park – Prince William County has issued notices of violation for the heaters and the water issues in the basement. Mr. Crim and staff have been providing documentation to Miller Brothers at their request to allow them to respond to the notices of violation. Town Council Regular Meeting Minutes March 6, 2018 ii. Planning Commission Bylaws – Mr. Crim provided his suggested revisions to the bylaws to ensure legal compliance and smooth functioning of the Commission. iii. Tanyard Hill – Mr. Crim assisted Ms. Jovanovich and Mr. Reese with ensuring that the Comprehensive Plan amendment and rezoning are consistent with the existing conservation easement. iv. HB1427/SB823 – These bills provide for standardized fees for wireless support structures in public rights of way. They have passed both houses and are awaiting the governor’s signature. v. Dominion franchise – Dominion has submitted their template for a new franchise to replace their existing franchise, which expires April 12, 2018. Mr. Crim is in the process of reviewing it and proposing revisions. B. Town Engineer: Mr. Reese, Town Engineer, submitted a report as part of the meeting agenda. He also reported the following: i. Kiely Court- Mr. Reese stated the plat has been picked up for recordation. There is no verification if it has been recorded at this time. C. Building Official: The Building Official’s report was submitted as part of the meeting agenda. No questions were received. D. Town Manager: Ms. Jovanovich submitted a manager’s report as part of the meeting agenda. She also reported the following: i. Parking and Traffic Study –Ms. Jovanovich recommended to forward the study to the Planning Commission for review and recommendations. E. Town Treasurer: Ms. Rodriguez, Town Treasurer, submitted a report as part of the meeting agenda. No questions were received. F. Chief of Police: Chief Linn submitted a report as part of the meeting agenda. He also reported the following: i. Pedestrian and Driver Safety Program - Chief Linn stated that the program was going to address several functions to include education, visibility, and enforcement. Chief Linn indicated that he plans to begin the enforcement function in May and coordinating that with the education function, handing out brochures to drivers and pedestrians. Councilmember McGuire inquired who would be receiving the brochures and indicated that he believed that the biggest problem with pedestrian safety occurs during rush hour traffic. Chief Linn indicated that the brochures would be given to drivers and pedestrians. He also stated that the drivers that were coming into Town would be given a brochure when they stopped at the intersection of Washington Street and Commerce Street. Vice Mayor Sivigny inquired if it would be practical to stop vehicles at the intersection of Washington Street and Commerce Street during rush hour. Chief Linn stated that he would look into that and report back to Town Council. Ms. Jovanovich stated that this Page 2 of 5 Town Council Regular Meeting Minutes March 6, 2018 program is going to be implemented before knowing if the Town has received the grant funding. If the Town does receive the grant funding then this program can expand. Councilmember Fithian inquired if they could also pass out brochures at the intersection of Washington Street and Mill Street or put the brochures under windshield wipers during the Concerts. Chief Linn stated that he was fearful of people driving off with them on the window and creating trash in the roadways. Councilmember McGuire inquired about the cost of the grant. Chief Linn indicated he would have to check for the requested amount and report to Town Council. Mayor Quist inquired about when the program is scheduled to be implemented. Chief Linn stated that his plan was to begin in May with the Concert Series and more pedestrians in Town. Ms. Jovanovich stated this program was developed at the request of Councilmember Drakes. Chief Linn has already begun the enforcement function of the Pedestrian and Driver Safety Program and the scope of the program will be larger if the grant is awarded to Town. G. Boards and Commissions: Chairman Seefeldt reported ARB worked with VFW on their Banner proposal. Councilmember McGuire reported the Planning Commission worked on updating their bylaws. 8. Regular Business Move Item 8D to the beginning of Regular Business It was moved to move Item 8D to beginning of Regular Business. A motion was made by Councilmember Fithian seconded by Councilmember Dawson that the Action Item be approved. The motion carried by poll vote, unanimous. 8D. Request to Permit Prince William County to Enforce Virginia Building Maintenance Code Within the Town of Occoquan Lance Houghton, 127 Washington Street, stated he was strongly opposed to this because it is private citizen complaint driven and it would be complicated with Occoquan’s Historic buildings. After Council discussion and multiple questions unable to be answered without a Prince William County Building Official representative, it was moved to defer this item to a later meeting. A motion was made by Councilmember Fithian, seconded by Councilmember McGuire that the Action Item be approved. The motion carried by poll vote, unanimous. 8A. Request to Accept FYE 2017 Financial Audit It was moved to accept the Fiscal Year End June 30, 2017 Financial Report. The motion carried by poll vote, unanimous. 8B. Request to Approve Town Election Newsletter Mailing It was moved to approve the development and mailing of a 2018 Town Election Newsletter mailing. A motion was made by Councilmember Fithian, seconded by Vice Mayor Sivigny that the Action Item be approved. The motion carried by poll vote, 3 Ayes (Dawson, Fithian, Sivigny) and 1 Nay (McGuire), motion passes 3-1. 8C. Request to Approve Purchase of Replacement Incident Based Reporting System It was moved to set a not-to-exceed amount of $5,000 from the FY2018 CIP for purposes of purchasing an IBR system license for the Occoquan Police Department. A motion was made by Councilmember Fithian, seconded by Vice Mayor Sivigny that the Action Item be approved. The motion carried by poll vote, unanimous. 8E. Request to Contract On-Call Financial Consulting Services It was moved to enter into a contract with Minor and Associates, PLLC for financial consulting services for an amount not-to-exceed $5,000. A motion was made by Councilmember Fithian, seconded by Vice Mayor Sivigny that the Action Item be approved. The motion carried by poll vote, unanimous. 8F. Request to Set not-to-Exceed Amount for Exterminator and Electrician Services for Mill House Museum It was moved to set a not-to-exceed amount of $2,500 for critter removal and electrician services at the Mill House Museum. A motion was made by Vice Mayor Sivigny, seconded by Councilmember Dawson that the Action Item be approved. The motion carried by poll vote, unanimous. 9. Work Session 9A. FY 2019 proposed Budget Work Session (continued from February 2018 Work Session) Ms. Jovanovich stated that today she would be presenting an update of the General Fund and discuss the CIP fund and projects. She indicated that after receiving the full 2017 meals tax data there was a decrease of half a percent from 2016 to 2017 and as a result the budget has been updated to show the FY 2019 proposed Meals Tax as $218,000. With the change in the proposed meals tax revenue there will be cuts made to administrative costs, newsletter, and computer support funding. Ms. Jovanovich reported the projected revenue for the CIP fund from the Craft Show is $102,000 after cutting sponsors and service vendors from the show. She gave an update of the FY 2018 CIP projects that are in progress or completed. Ms. Jovanovich asked for some Page 4 of 5 Town Council Regular Meeting Minutes March 6, 2018 direction from Town Council on which planned CIP projects should be completed this fiscal year based on available funding. Town Council instructed Town Staff to receive quotes on certain CIP items before making a decision. Restriping streets and Town Hall lower level renovations have been deferred to a later date. Town Council also discussed the CIP priorities for FY 2019. The budget will be prepared using those priorities. 10. Closed Session Vice Mayor Sivigny moved that the Council convene in closed session to discuss the following as permitted by the Virginia Code Section 2.2-3711(A)(1): a personnel matter involving performance evaluation or job assignments of all employees and salary or other compensation of all employees. Councilmember Fithian seconded. The motion carried unanimously. Closed Session began at 9:23 p.m. The Council came out of closed session at 9:44 p.m. Vice Mayor Sivigny moved that the Council certify that, in the closed session just concluded, nothing was discussed except the matter or matters (1) specifically identified in the motion to convene in closed session and (2) lawfully permitted to be discussed under the provisions of the Virginia Freedom of Information Act cited in that motion. Councilmember Fithian seconded. Motion passed, Ayes – Councilmember Fithian, Councilmember Dawson, Councilmember McGuire and Vice Mayor Sivigny, by roll call vote. It was moved to proceed as discussed in closed session. A motion was made by Councilmember Dawson, seconded by Councilmember Fithian that the Action Item be approved. Call to Order Mayor Quist called the meeting to order at 7:02 p.m. 2. Pledge of Allegiance 3. Citizens’ Time Lance Houghton, 127 Washington Street, informed Town Council of issues he was having with Prince William County in receiving his Occupancy Permit. Town Staff reported they have spoken with Prince William Building Official and the reason that Mr. Houghton is having to do extra work is because he is creating multiple units in Rockledge. The Occupancy Permit requirements for other businesses in town would not be as difficult, or necessary if there is no changes in use according to the building code. 4. Regular Items 4A. Request to Advertise Proposed FY 2019 Tax Rates It was moved to advertise the following tax rates in support of the FY 2019 Proposed Budget: Real Estate Tax Rate of 13 cents per $100 of assessed value; Meals Tax Rate of 3 percent; and Transient Occupancy Tax Rate of 2 percent. A motion was made by Councilmember Drakes seconded by Councilmember Dawson that the Action Item be approved. The motion carried by poll vote, unanimous. 5. Closed Session 6. Arts and Crafts Show Exploratory Committee Structure Ms. Jovanovich presented a draft committee charter for the exploratory committee that would be tasked with evaluating the implementation and structure of the Occoquan Arts and Crafts Shows and providing a report and recommendations to Town Council. The charter included the committee structure and membership requirement, responsibilities and what information should be included in the report presented to Town Council. Councilmember Drakes suggested changing the proposed membership requirements to remove the Town Council member since this committee should be an advisory committee to the Town Council. Vice Mayor Sivigny suggested that if the committee removed the Town Council member they should require another resident in the committee. Mayor Quist and Vice Mayor Sivigny both expressed the timeline of six months to create a report for Town Council sounded ambitious and questioned if that was a realistic timeline. Ms. Jovanovich stated that she would create a timeline, to guide the committee, and present the timeline and an updated draft committee charter to Town Council for approval. 3. Review pending. Military Tribute Banners Program Town staff is working with Dominion on the permit process in order to aid the VFW in implementing the military banner program. River Mill Park The Town is continuing to work with VDOT to reinstall the lighting on the VDOT pedestrian bridge. New light mounting detail was OK’d by VDOT. Request has been made to perform the lighting install and electrical connection; request pending. Intersection Improvements As a locality of PWC, the Town has partnered with the County to submit a grant request under the TAP program (30% local match) to fund intersection improvements at Mill/Ellicott and Mill/Washington Streets to update the sidewalk ramps and install crosswalks. This would be funding available in Fiscal Years 2019 and 2020, with the Town providing the required 30% local match. Notification of grant status is expected by April. This grant has been included in the proposed FY2019 budget. Tanyard Hill (Oaks III) Rezoning and Comp Plan Amendment The rezoning and comprehensive plan amendment request for the Oaks III/Tanyard Hill park property is on the Prince William County Planning Commission agenda for April 4, 2018. The request is planned to go before the Prince William County Supervisors for final approval in May. This request, if approved, will maintain the site as a park property and allow the town to install signage and construct a trail. The Town is continuing to work with the County to plan the trail section as part of the Occoquan Greenway Trail system. Stormwater Town staff met with County staff to discuss the stormwater management program request made by the Town to the Supervisor’s office on March 6, 2018. Since then, County staff has been in Town reviewing existing systems in an effort to perform a high-level review of the system and perform high-level mapping. The Town is continuing to work with the County on this issue. Recodification Project Staff held a kick-off meeting on August 30, on the recodification process with American Legal. Staff has developed a list of recommended code updates and has provided the current code to Town Manager’s Report April 3, 2018 Page 2 American Legal to begin the recodification process. The contractor has begun the legal review and staff will be bring policy changes for Council consideration throughout the process. The process is expected to last through the remainder of the current fiscal year. River Road Beautification Town staff has scheduled an on-site meeting with River Road residents on April 11, to discuss existing refuse container storage issues. Staff is evaluating a consolidated refuse storage location(s) in order to aid the community in beatification efforts, as well as ensuring Town Code regulations are being met. Budget Public Hearing Due to a misprint in the March 23 public hearing notice, the proposed budget public hearing has been rescheduled to April 17, 2018. The ad was corrected and run on March 30, and April 6, 2018. The public hearing on the proposed tax rates will remain on April 24, 2018. Regular Business Meeting Date: Date 8 A: Request to Approve Arts and Crafts Exploratory Committee Charter Explanation and Summary: At the direction of Town Council, staff developed a draft committee charter for an exploratory committee that would be tasked with evaluating the implementation and structure of the Occoquan Arts and Crafts Shows and providing a report and recommendation to the Town Council on the future of the show. The Town Council discussed the draft Charter during its March 20, 2018 work session and directed staff to update the charter to adjust the membership requirements and develop a proposed timeline. Attached is a revised draft charter for Council review. This is a request to approve the charter and to appoint membership. Town Attorney’s Recommendation: Recommend approval. Town Manager’s Recommendation: Recommend approval. Attachments: (1) Draft Committee Charter ARTS AND CRAFTS SHOW EXPLORATORY COMMITTEE DRAFT CHARTER - REVISED BACKGROUND The Occoquan Arts and Craft Show (“Show”) has been held within the Town of Occoquan for the past 50 years. It has evolved over the years from a small event held in an open lot to a large two-day outdoor street festival that sees more than 10,000 visitors to the town. The Town of Occoquan has also changed within this time, growing from approximately 300 residents to more than 1,000, with new residential developments and commercial redevelopment, and a flourishing downtown historic business district. As the community continues to grow and change, this event must be reviewed to ensure it is meeting its intended goals: - Enhance the Town of Occoquan as a center for living, shopping, dining, art, and history. - Generate funds for town capital projects and other town financial needs. PURPOSE The Arts and Craft Show Exploratory Committee (“Committee”) will review the purpose and goals of the Show and provide recommendations to Town Council on the future of the Show. COMMITTEE STRUCTURE AND MEMBERSHIP The Committee will be a special committee and will serve until final recommendations are provided to Town Council as detailed in this document. The Committee will consist of eleven (11) members, including the following requirements: - Three (3) members of the business community representing a restaurant, professional business, and retail; - Four (4) residents with at least one owning property (1) outside of the historic district and one owning property (1) within the historic district; - Two (2) local arts and/or crafts vendors/businesses; - Town Manager; and - Events and Community Development Director. Town Council will consider and appoint all membership. The Events and Community Development Director will serve as Chairperson. At the first meeting, the Committee will designate a Co-Chair to serve in the absence of the Chair. Arts and Crafts Show Exploratory Committee – Draft Charter REV Page 1 of 3 MEETINGS The Committee will meet on a regular basis as agreed upon by members of the Committee. At every meeting of the Committee, the Committee will designate a member to be responsible for preparing minutes. The Committee will review and approve minutes at the beginning of each meeting and submit to the Town Clerk for record retention by the Town of Occoquan. COMMITTEE RESPONSIBILITIES The Committee will meet on a regular basis to discuss, analyze, and prepare recommendations and a final report to the Town Council on the future of the Show. The Committee will evaluate and provide recommendations that support the goals of the Show, including: 1. Enhancing the Town of Occoquan as a center for living, shopping, dining, art, and history. 2. Generating funds for town capital projects and other town financial needs. The Committee may also review the goals and include recommended changes within the report. In preparing its recommendation, the Committee will consider a variety of factors that impact the Show including, but not limited to: 1. Availability of quality arts and crafts vendors. 2. Shopping patterns (online vs. in-person). 3. Challenges of hosting a multi-day, outdoor street event. 4. Generational impact on arts and crafts development, and shopping patterns. 5. Ability to generate at least $120,000 in annual net revenue for town capital projects. 6. Competing events; number of similar events in region. 7. Impact on residents and businesses. 8. Community demand for events, including type, frequency, etc. 9. Goals of events: quality of life, revenue generating, tourism impact. 10. Community and business input. 11. Other current town and business events. The Committee will have approximately six months to provide a final report and recommendation to the Town Council on the future of the Show, with a presentation to Town Council scheduled for the November 2018 work session. Recommendations will be considered for implementation no earlier than the 2019 Fall Show, or as determined and directed by the Town Council. Regular Business Meeting Date: April 3, 2018 8 B: Proclamation for Arbor Day Explanation and Summary: This is a request to proclaim April 28, 2018, as Arbor Day in the Town of Occoquan. A short tree planting ceremony will be held in partnership with Keep Prince William Beautiful on Saturday, April 28, 2018, on Commerce Street in recognition of Arbor Day. In addition, the Town will be awarded the Tree City USA designation for the first time during this event. Sterling Morton proposed that a special day be set aside for the planting of trees, and this holiday, called Arbor Day, was first observed with the planting of more than a million trees in Nebraska, and is now observed throughout the nation and the world, and WHEREAS, trees can reduce the erosion of our precious topsoil by wind and water, cut heating and cooling costs, moderate the temperature, clean the air, produce life-giving oxygen, and provide habitat for wildlife, and WHEREAS, conservation of our natural resources and beautification of the Occoquan community are both very important to the quality of life enjoyed by residents, and WHEREAS, trees enhance the beauty of Occoquan, increase property values, enhance the economic vitality of business areas, improve our environment, and provide important educational experiences, and WHEREAS, the planting of new trees will be the expressions of our commitment to future generations, and NOW, THEREFORE, I, Elizabeth A.C. Quist, Mayor of the Town of Occoquan and on behalf of the Occoquan Town Council hereby proclaim Saturday, April 28, 2018 as ARBOR DAY in the Town of Occoquan and urge all individuals, groups, and businesses to celebrate and enjoy Occoquan’s outdoors and the richness of our town through the planting and preservation of trees.
