Page 2 of 23 MINUTES Ocean Shores Planning Commission Regular Meeting Tuesday, 5/14/2024 – 2:00 p.m. Ocean Shores Public Library Meeting Room 573 Point Brown Ave NW, Ocean Shores, WA Minutes taken by Commissioner Berry • Call to Order Chair Mark Lawlis called the meeting to order at 2:00 p.m. • Roll Call Planning Commissioners present: Mark Lawlis, Kerry Barr, Tom Bies and Steve Berry Planning Commissioners absent: Thorn Ward Motion by Commissioner Barr to excuse Commissioner Ward. Seconded by Commissioner Berry. The motion was passed unanimously. City Staff present: Nicole Birch, City Clerk; Marshall Read, City Planner • Approval of Minutes • Approval of our minutes from our meeting of April 23, 2024. Commissioner Lawlis moved to approve the minutes, with correction to Item 9. Should read “Chair Mark Lawlis appointed Commissioner Berry as secretary for the 5/14/2024 meeting”. Seconded by Commissioner Barr. The motion passed unanimously. • Public Comments No public comments • Public Hearing • Chair Lawlis recessed meeting at 2:03 p.m. for Public Hearing to hear public testimony for or against the application for rezone of certain real property in Ocean Shores from PR-1, Private Recreational to R-1 Residential Zone. Planner Read presented a summary of the Staff Report. Applicant concurred with Mr. Read. • Commissioner Comments: Commissioner Barr reiterated that Applicant would still need to comply with all other codes and standards. Commissioner Berry expressed concerns regarding site access across city right-of-way and potential conflicts with future city plans for pedestrian/bike path. Planner Read stated that access should not have any impact on future path. • Public Comment: Vida Piera provided written and oral concerns regarding Special Districts, compliance with Shoreline Master Plan and EMS access. Don Williams pointed out errors in the Staff Report regarding lot size and reference to “Parks & Recreation district” on page 15. He also asked about access to adjacent property to the south. Mr. Read concurred with the errors and corrections will be made. The adjacent property is currently underwater in the canal. • Chair Lawlis reconvened the meeting at 2:31 p.m. • Motion made by Commissioner Berry to vote on proposed rezone, second by Commissioner Barr. Page 4 of 23 40% Rule for Residential Lots On December 13, 2022, the Ocean Shores Planning Commission met and unanimously voted to recommend that the Ocean Shores Municipal Code be changed to specify that the 40% restriction on building area be applied to residential lots only. a. Section 17.50.210 M of the Ocean Shores Municipal Code was recently changed to limit buildings to covering 40% or less of a lot area. No differentiation was made between residential and business districts. Lot area used to calculate allowable building coverage was the entire lot, regardless of setbacks. The Planning Commission was clear in their original intent that the 40% restriction should only apply to residential lots, and not be applied to business and commercial lots. Section 17.50.210.M of OSMC currently reads: “No building or combination of buildings permitted or otherwise shall exceed forty percent of the lot area as specified per this section.” Proposed revised language for section 17.50.210.M of OSMC: “No building or combination of buildings permitted or otherwise in a residential zone shall exceed forty percent of the lot area as specified per this section.” (Emphasis added). b. Steel Design Manual. Seismic load combinations are not included because the seismic base shear calculated using the Simplified Design Procedure in ASCE7 is less than the horizontal forces resulting from the design wind load. It is the end users’ responsibility to insure the structure is sufficiently anchored to resist any forces as a result of the stated loads. The Commission reviewed code from other cities and Washington State, researched and discussed various options and their implications, and developed the enclosed additional recommended language. This Planning Commission felt that this language would better protect the residents and visitors to Ocean Shores. 17.50.055 Transient rentals. A. Purpose. The purpose of the ordinance codified in this section by petition or initiative is to protect the character of the city’s residential neighborhoods by prohibiting transient rental of dwellings and recreational vehicles therein. Use of dwellings for transient rental purposes has unmitigatable adverse impacts on surrounding residential uses and properties and is therefore prohibited except as provided for in these zoning regulations. It is found and determined that transient rental of dwellings has been permitted in the past and that the lawful use of property pursuant to the former Ocean Shores Municipal Code Sections 17.50.055, 17.16.050 and Ocean Shores Ordinances 419 (1986) and 518 (1991) may continue for a specified period subject to certain conditions contained in this section. These conditions include an amortization period of five years and the provision for individualized determinations that lawful investments specifically committed to transient occupancy have been made and may warrant a longer amortization period. B. Prohibition of Transient Rental with Exceptions. No owner, person or entity shall occupy, use, operate, rent or lease nor advertise, offer or negotiate to use, lease or rent a dwelling in the R-1, R-2, R-3, R-4, R-5, R-6A, R-6B, R-6C, R-7, R-8 and R-9 zones for transient rental except: a dwelling holding a lawful conditional use permit for transient rental on the effective date of the ordinance codified in this section and which complies with the requirements of subsection (C) of this section. C. Requirements for Continued Transient Rental. 1. No owner, person or entity shall rent, lease, operate, manage or maintain a dwelling in the R-1, R-2, R-3, R-4, R-5, R-6A, R-6B, R-6C, R-7, R-8 and R-9 zones for transient rental after the effective date of the ordinance codified in this section unless the dwelling had a valid and lawful transient rental conditional use permit on the effective date of said ordinance and meeting the following requirements: a. Any person or entity who rented or leased a dwelling unit for transient rental by virtue of a conditional use permit issued pursuant to former Ocean Shores Municipal Code Sections 17.50.055 and 17.16.050 and Ocean Shores Ordinances 419 (1986) and 518 (1991) during the period between January 1, 6. Transient Rentals Led by: Planning Commission Chair, Mark Lawlis Page 19 of 23 1989, and the effective date of the ordinance codified in this section or who otherwise claims a nonconforming use status for transient rental must establish the nonconforming use status of their transient rental activity by filing a claim for nonconforming use status with the city planner or in his or her absence the public works director or designee within ninety days of the effective date of said ordinance. b. Upon timely receipt of any such claim the Ocean Shores hearing examiner shall conduct a hearing, pursuant to Chapter 17.61, and determine whether grounds for the issuance of a nonconforming use permit have been proved by a preponderance of the evidence. Proceedings and appeal rights shall be as provided in Chapter 17.61 as amended. 2. Any transient rental nonconforming use permit issued pursuant to subsections (C)(1)(a) and (b) of this section shall have conditions no less stringent than the conditions under which the predecessor conditional use permit was issued and shall have a term ending five years from the effective date of the ordinance codified in this section and all transient rental of the dwelling shall be prohibited from and after the expiration of the five years unless hardship relief has been granted pursuant to subsection (C)(3) of this section. 3. A hardship provision is established for property owners who can prove that an investment made exclusively for the purpose and use of the dwelling as a transient rental can not be reasonably amortized and recovered over the five years allowed in subsection (C)(2) of this section. An application for hardship relief can only be made within the time and in the manner permitted for an application for a nonconforming use permit and shall be heard in conjunction with the hearing on the nonconforming use permit under the same conditions, requirements and appeal rights as specified for the nonconforming use permit. The hearing examiner shall determine, based upon a preponderance of evidence presented of generally accepted accounting principles and other substantial evidence, whether an extension of the term of the nonconforming use permit is needed to permit a reasonable amortization and recovery of investments proved to have been made exclusively for the purpose and use of the dwelling as a transient rental, and the term of any extension needed to accomplish a reasonable amortization and recovery of the investment. 4. Any nonconforming use permit may be suspended temporarily or revoked upon findings by the hearing examiner, after a hearing and subject to appeal as any other ruling of the hearing examiner, that the subject property has become a nuisance to its neighbors, engenders an unreasonable amount of law enforcement activity, violates one or more of the conditions of its issuance, violates any one or more of the provisions of the zoning code or any one or more of the foregoing. D. Any violation of the provisions of this transient rental section shall be enforced by the public works director or designee in the manner specified in Chapter 17.62; 6. Transient Rentals Led by: Planning Commission Chair, Mark Lawlis Page 20 of 23 provided, that the penalty shall not be less than one hundred dollars plus fifty dollars per day of occupancy in violation of this section. E. Business Licenses and Taxes. 1. Owners of transient rentals properties in permitted locations must obtain a city business license in accordance with Chapter 5.02 of the Ocean Shores Municipal Code before operating said property as a transient rental. 2. Owners/operators of transient rentals in permitted locations are subject to all provisions of Chapter 5.02 of the Ocean Shores Municipal Code, to include but not limited to: application, fees, renewal, and revocation. Special note is made that behavior and/or actions of persons renting or otherwise occupying licensed transient rentals that is in violation of any provision of the Ocean Shores municipal code may result in revocation of the Business License permitting operation of the Transient Rental. 3. For owners/operators of multiple transient rental properties in permitted locations, each property shall be considered a branch location in accordance with section 5.02.070 of the Ocean Shores Municipal Code and shall require a separate city business license for each location. 4. Owners/operators of rentals properties in permitted locations shall pay all business and occupation tax in accordance with Chapter 3.38 of the Ocean Shores Municipal Code. 5. Owners/operators of rentals properties in permitted locations shall collect and pay to the Washington State Department of Revenue Lodging Tax in accordance with Chapter 3.32 of the Ocean Chores Municipal Code. 6. Insurance. The owner/operator of transient rental properties in permitted locations shall provide proof of insurance specific to transient rental properties covering the period of the business license. The owner/operator of transient rental properties shall maintain such insurance throughout the period the property is used as a transient rental. F. Conditions of approval and maintenance of a city business license for transient rental properties 1. Local Property Representative. Where the owner/operator of a transient rental property does not reside full-time within 50 miles driving distance of the transient rental property, a local property manager shall be designated. The designated local property manager shall reside full-time within a 50-mile driving distance to the transient rental property. The owner/operator or local property manager shall be available 24 hours per day responsible for 6. Transient Rentals Led by: Planning Commission Chair, Mark Lawlis Page 21 of 23 responding to and resolving all complaints about the transient rental property. 2. Alternate Property Representative. An Alternate Property Representative for each transient rental property shall be designated regardless of the requirement to designate a Local Property Representative. The Alternate Property Representative shall be contacted if the owner/operator or Local Property Representative cannot be contacted in a reasonable timeframe and shall have all the duties and responsibilities of the owner and operator or Local Property Representative in such instance. Owner/operators of transient rental properties shall provide, as part of the city business tax application, an affirmation by Alternate Property Representative affirming awareness and capability to perform the duties of the owner/operator or Local Property Representative. 3. The name, address, and telephone number of the owner/operator, Local Property Representative (if used), and Alternate Property Representative shall be kept on file by the city and provided to the City of Ocean Shores Police Department. Failure to keep all contact information current, failure to respond in a timely manner to complaints, or occurrence of repeated complaints may result in the suspension or revocation of the business license and/or civil or criminal penalties. G. Fire Safety Inspection. The owner/operator of a transient rental property shall coordinate with the Ocean Shores Fire Department for a fire safety inspection of the proposed transient rental property prior to applying for a city business license. A copy of the passed inspection certificate shall be provided along with the initial application for a city business license. The fire safety inspection shall be performed annually thereafter and a copy provide with the application for annual renewal of the business license. H. Occupancy. Maximum occupancy of the transient rental property shall be based on the International Building Code standards, or a safe maximum occupancy set by the Ocean Shores Fire Department during the annual Fire Safety Inspection, whichever is less. The owner/operator of the transient rental property shall be responsible for ensuring that the transient rental property is operated in conformance with is maximum occupancy. I. Parking. At least one additional off-street parking space shall be provided for transient lodging use, in addition to all other parking required for the property in accordance with current city building codes. Sufficient parking space shall be provided such that on-street parking is not required at the maximum occupancy. In accordance with Ocean Shores City Code section 8.32.030, no more than four vehicles shall be parked outside an enclosed garage or carport. J. Solid Waste. Owner/operators of transient rental properties shall ensure collection and removal of solid waste from transient rental properties at least 6. Solid waste shall be stored in completely enclosed and secured solid waste receptacles or stored indoors until collection. K. Informational Packet. A packet of information shall be provided to renters and posted conspicuously in the common area of the transient rental summarizing the guidelines and restrictions applicable to use of the transient rental property to include: 1. Maximum occupancy. 2. Prohibited uses 3. Applicable noise and use restrictions in accordance with current city code. 4. Location of approved parking and maximum number of allowed vehicles. 5. Instructions for management of solid waste, including specific instructions on prevention of bear nuisance. 6. Contact information for owner/operator of transient rental property, Local Property Representative (when used), and Alternate Property Representative. 7.
