Mayor Magnus called the Committee-Of-The-Whole Meeting to order at 7:00 PM and appropriate meeting
notification was confirmed.
Committee Business
a. Discussion on the Approved Amendment to the Comprehensive Land Use Plan 2050 -
Housing Ratios
Frye referenced the February 6, 2024 Council action amending the City’s Comprehensive Land Use
Plan 2050, specifically the intent of the housing ratio mix and stated staff is looking for clarification.
Riffle gave an overview of his memo included in the packet and asked Council if it correctly states
their intent, that the Wangard and Wingspan projects are vested and no new multi-family projects
can be approved unless Council amends the Comprehensive Land Use Plan. He also stated the
Comprehensive Plan is a vision and the approved plan meets statutory requirements. Council
stated their intent was the Wangard & Wingspan projects are vested and any other multi-family
project would need Council to approve an amendment to the Comprehensive Land Use Plan.

Motion to adjourn made by Aultman Kloth and seconded by Mulder.
Motion carried 7-0-0.

BACKGROUND
On February 6, 2024, the Common Council on an 8-0 vote approved changes to the housing ratios in the
City. With this vote there only remains around 220 multifamily units allowed for future construction.
Multifamily includes apartments, senior developments and condominiums.
During the process, it was never directly discussed the impact of the change. Although the ratios have
been set, do they apply to properties that currently have the right to construct multifamily units? We
asked because the construction of units on properly zoned parcels will impact the calculated percentage
ratios.
Our discussion is for Staff to know the intention of the Aldermen with their vote.

Re: Impacts associated with Council amendment to Comprehensive Plan
Council members:
I have been asked to provide legal analysis of impacts related to the recent Council action
concerning amendment to the City’s comprehensive plan. As you know, this action revised the
housing ratios guiding future zoning and land use decisions for residential development. The new
ratios under the revised Comp Plan are:
• 60% single family housing
• 35% multi-family (including 3+ unit condominium development)
• 5% duplex
As you will recall, there was presentation and discussion related to the many tracts within the City
that have previously been zoned for multi-family development that have yet developed. Two such
developments (Wangard and Wingspan) will be before the Council soon seeking final approval
for their mixed developments. I am of the assumption that the Council was fully aware of the
multifamily components of these developments and intended that the number of future units
associated with these developments would be included, not excluded, from the 35% ceiling on
future multifamily projects. If I am mistaken, I will need to address impacts on that basis later.

Based upon staff analysis there currently are 10,787 total housing units existing and/or approved
for construction presently. Accordingly, the total number of multifamily units permitted under the
Comp Plan guideline is 3,776. The impact on the ratio based upon Wingspan and Wangard is:
Current mf units: 3530
Wangard 116
Wingspan 171
Total 3817 (47 units over the 35% threshold)
Assuming my premise that the Council did not intend to exempt these two projects from the new
housing unit percentages, no new multifamily development can be permitted unless the Council
amends the Comprehensive plan. As you know, the plan commission has referred of two such
projects to the Council for consideration –
• NE 3-Leaf project 200 units
• “Capri” project 204 units
I understand that there will be a Committee of the Whole meeting February 20, 2024, at which
time the Council can discuss and verify its intent related to the recent Comprehensive Plan
amendment. I will be available for consultation at that time.
