Protection & Welfare Committee Meeting Minutes July 18, 2017 Chairman Rosek called the meeting to order at 6:44 PM. Members Present: Aldermen Rosek, Schmidt and Shaw Staff Present: Mayor Nold, Kitsembel, Buerger, Frye, Gallo, Duffy, Pickart, Sullivan, Steinbach, Kelliher, Osborn and Coenen Others Present: Alds. Zwart, Strey, Ellis and Miller, and Atty Riffle 2. Consider/recommend Creating §10.07 of the Municipal Code Relating to Graffiti Abatement: Buerger reported the PD is proposing the creation of a graffiti abatement ordinance to allow the dept. to work with property owners to remove graffiti from their property in a timely manner. Graffiti depreciates the value of the property and surrounding properties. The PD would be responsible for the enforcement of the ordinance and once the property owner is contacted, they would have seven days to abate the graffiti. If the property owner does not comply within seven days, the City may cause the graffiti to be abated by DPW employees or a private contractor. The owner will be responsible for the cost. Riffle added that graffiti is recognized as a public nuisance. Motion by Shaw to recommend creating §10.07 relating to graffiti abatement; second by Schmidt. Motion carried 3-0. 3. Consider/recommend Renaming §21.08 and Creating §21.08(3) & (4) of the Municipal Code Relating to Intoxicants, Fermented Malt Beverages and Smoking: Kelliher reported this ordinance gives the City the ability to post no consumption of intoxicants or fermented malt beverages or no smoking in specific areas of a park. It also prohibits the consumption of intoxicants or fermented malt beverages within the Community Center unless purchased and distributed by the City’s approved liquor license holder. It also provides the PD with an enforcement tool to gain compliance within our public parks and community center. The City currently allows drinking and smoking in our parks, however we receive calls related to Imagination Station and if signs are posted, we can ask people to stop. Motion by Shaw to recommend renaming §21.08 and creating §21.08(3) & (4) relating to intoxicants, fermented malt beverages and smoking; second by Schmidt. Motion carried 3-0. 4. Consider/recommend Granting a New 2017-2018 “Class B” Intoxicating Liquor/ Fermented Malt Beverage License to VIP Sushi Hibachi Oconomowoc, LLC: Coenen reported the City received an application from VIP Sushi Hibachi Oconomowoc, LLC for a “Class B” Intoxicating Liquor/Fermented Malt Beverage license for their business at 1288 Summit Ave. at the same time we received three others. Council took no action on April 4th on the application due to the fact that Protection & Welfare Committee was working on determining best use criteria of a “Class B” license. Based on those discussions and direction during the renewal licensing period, the request from VIP Sushi Hibachi qualifies to be brought forward because the business is currently operating. The City now has six licenses available. Jerry Erdmann spoke on behalf of the restaurant owners stating they are a fine dining restaurant, they seat 68 patrons in addition to seating for 18 outside, drinks and food are provided by wait staff with table-side service and the owners agree that if the restaurant closes for more than 30 days, they will surrender the license. The Committee discussed the size of the restaurant, the operation, potential alcohol sales, having licenses available as an economic tool, prioritizing how we issue them and owner’s willingness to surrender the license if the business closes. Motion by Shaw to recommend granting a new 2017-2018 “Class B” intoxicating liquor/fermented malt beverage license to VIP Sushi Hibachi Oconomowoc, LLC; second by Rosek. Motion carried 2-1.
