Protection & Welfare Committee Meeting Minutes December 4, 2018 Acting Chairman Miller called the meeting to order at 6:55 PM. Members Present: Aldermen Miller and Shaw Excused: Ald. Rosek Staff Present: Mayor Nold, Kitsembel, Sullivan, Buerger, Gallo, Frye, Freber, Pickart, Kelliher, Schuh and Coenen Others Present: Ald. Zwart, Spiegelberg, Strey, Kowieski and Ellis 2. Consider/recommend Repealing and Recreating §9.20 of the Municipal Code Regarding Use of Intoxicants Restricted: Buerger reported Council recently adopted ordinance §12.05 which allows open intoxicants in specific public areas with the issuance of a special event permit by the Parks and Recreation Dept. The Police Dept's enforcement of violations of the consumption of intoxicants on public property is in §9.20 and in order for the two ordinances to be consistent, §9.20 should be repealed. Motion by Shaw to recommend repealing §9.20 of the Municipal Code regarding use of intoxicants restricted; second by Miller. Motion carried 2-0. 3. Consider/recommend Repealing and Recreating §9.21 Horses in Business District and on Sidewalks Prohibited and Repealing and Recreating §21.091 Horses in Parks and Other Public Areas Prohibited of the Municipal Code Buerger reported there are two sections in our code that are intended to regulate and permit horses in the City. Horses in the Business District and on sidewalks is regulated in Chapter 9 and includes a regulatory and permit process, which is done through the Police Dept. However, the issuance of permits through the PD has never been done. Horses in parks and other public areas prohibited is in Chapter 21 and includes a permit process, which is done through the Parks & Recreation Dept. The revisions combine the two ordinances with the Parks & Recreation Dept. responsible for the permitting process and the Police Dept. responsible for enforcement. Motion by Shaw to recommend amending §9.21 horses in Business District and on sidewalks prohibited and §21.091 horses in parks and other public areas prohibited of the Municipal Code; second by Miller. Motion carried 2-0. Motion by Shaw to adjourn; second by Miller. Motion carried 2-0. The meeting adjourned at 6:58 PM. Minutes by Diane Coenen, City Clerk Ald.
