Protection & Welfare Committee Meeting Minutes May 7, 2019 Acting Chairman Shaw called the meeting to order at 7:24 PM. Members Present: Aldermen Shaw and Kowieski (appointed by Nold) Excused: Alderman Rosek Staff Present: Mayor Nold, Sullivan, Freber, Pickart, Frye, Gallo, Buerger, Duffy, Kelliher and Coenen Others Present: Alds. Spiegelberg, Rogers, Strey, Zwart and Ellis, and Atty Riffle 2. Consider/recommend Granting a 6 Month “Class B” License to R & S Hospitality, LLC (Buddy’s Beach Bungalow): Coenen reported the City received an application for a six-month Class “B” Fermented Malt Beverage license from R & S Hospitality, LLC, dba Buddy’s Beach Bungalow to sell fermented malt beverages at City Beach located at 324 W. Wisconsin Avenue. Buddy’s sells concessions from Memorial weekend to Labor Day weekend. The applicant meets all Chapter 12 and State Statute licensing requirements. Motion by Shaw to recommend granting a six-month Class “B” License to R & S Hospitality, LLC; second by Kowieski. Motion carried 2-0. Motion by Shaw to adjourn; second by Kowieski. Adjourn Notice is hereby given that a majority of the Common Council will be present at the above scheduled meeting to gather information about a subject over which they have decision-making responsibility. This constitutes a meeting of the Common Council pursuant to State ex rel. Badke v. Greendale Village Board, 173Wis. 2d 553, 494 N.W. 2d 408 (1993) and must be noticed as such, although the Common Council will not take any formal action at this meeting. 1 MEMORANDUM CLERK’S Date: May 3, 2019 To: Mayor Nold Protection & Welfare Common Council From: Diane Coenen Re: Class “B” Six Month Fermented Malt Beverage License RELATES TO THE STRATEGIC PLAN N/A BACKGROUND The City has received an application for a six-month Class “B” Fermented Malt Beverage license from R & S Hospitality, LLC, dba Buddy’s Beach Bungalow, to serve and sell fermented malt beverages at City Beach. The agent, John Suttner plans to open the bungalow starting Memorial weekend through Labor Day weekend. Buddy’s Beach Bungalow entered into an exclusive Concession Agreement with the City in 2012, which was extended through 2019, to provide concessions at City Beach, which they have done. Applicant meets all Chapter 12 and State Statute requirements. ADDITIONAL ANALYSIS N/A FINANCIAL IMPACT Per the agreement, the Concessionaire, John Suttner/R & S Hospitality agrees to pay to the City 15% of gross receipts received for all gross sales. The Concessionaire shall pay the City Parks, Recreation and Forestry Department weekly according to the sales report. RECOMMENDATION Protection & Welfare Committee Recommendation: Move to recommend the resolution granting a six-month Class “B” Fermented Malt Beverage license to R & S Hospitality, LLC. SUGGESTED MOTION Council Motion: Move to adopt the resolution granting a six-month Class “B” Fermented Malt Beverage license to R & S Hospitality, LLC. 1 2 RESOLUTION NO. 19-R_______ RESOLUTION GRANTING SIX (6) MONTH CLASS “B” FERMENTED MALT BEVERAGE LICENSE TO R & S HOSPITALITY, LLC WHEREAS, the application for the following new six (6) month license has been made, necessary fees deposited and all legal procedures have been taken, as per ordinance of the City of Oconomowoc. NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Oconomowoc that the following six (6) month license be granted (expiring on November 7, 2019): Class “B” Fermented Malt License (sell and serve fermented malt beverages) R & S Hospitality, LLC (Buddy’s Beach Bungalow) 324 W.
