Chairman Shaw called the meeting to order at 7:16 PM.
Members Present: Aldermen Shaw, Spiegelberg and Rogers
Staff Present: Mayor Nold, Kitsembel, Sullivan, Freber, Pickart, Frye, Gallo, Osborn, Buerger,
Hoeppner and Coenen
Others Present: Alds. Rosek, Zwart, Ellis, and Strey and Atty Larson
2. a. Consider/recommend Granting a New 2019 Reserve “Class B” Intoxicating Liquor/Fermented
Malt Beverage License to Brinker Restaurant Corporation (Chili’s Grill & Bar):
Motion by Spiegelberg to recommend granting a new 2019 Reserve “Class B” Intoxicating liquor/fermented
malt beverage license to Brinker Restaurant Corporation on the condition it not be issued until the sale has
occurred; second by Rogers. Motion carried 3-0.
Motion by Shaw to adjourn; second by Spiegelberg. Motion carried 3-0. The meeting adjourned at 7:17
PM.

BACKGROUND
The City received an application for a Reserve “Class B” Intoxicating Liquor/Fermented Malt Beverage license
from Brinker Restaurant Corp., Matthew Fitzgerald, Agent, to sell intoxicating liquor and fermented malt
beverages at Chili’s Grill & Bar at 1229 Corporate Center Dr. Brinker Restaurant Corp. has purchased the
restaurant from ERJ Dining and will close on or about September 5, 2019. Upon the successful closing, ERJ
Dining will surrender their Reserve “Class B” license to the City. The restaurant operations will remain the same.
The applicant meets all Chapter 12 and State licensing requirements.
ADDITIONAL ANALYSIS

FINANCIAL IMPACT
When ERJ Dining first applied for a “Class B” license, they were issued a Reserve license and paid the initial
$10,000 Reserve fee. Due to the change in ownership, an original Alcohol Beverage Retail License Application
must be submitted per Statue and the new licensee must also pay the initial $10,000 Reserve fee.
RECOMMENDATION
Committee Recommendation: Move to recommend granting a new 2019 Reserve “Class “B” Intoxicating
Liquor/Fermented Malt Beverage license to Brinker Restaurant Corp. on the condition the Clerk not issue the
license until the new owner confirms the sale of the property.
SUGGESTED MOTION
Council Recommendation: Move to adopt the resolution granting a new 2019 Reserve “Class “B” Intoxicating
Liquor/Fermented Malt Beverage license to Brinker Restaurant Corp. on the condition the Clerk not issue the
license until the new owner confirms the sale of the property.

RESOLUTION GRANTING NEW 2019 RESERVE “CLASS B” INTOXICATING LIQUOR/FERMENTED MALT
BEVERAGE LICENSE TO BRINKER RESTAURANT CORPORATION DBA CHILI’S GRILL & BAR
WHEREAS, an application for the following new license has been made, necessary fees
deposited and all legal procedures have been taken, as per ordinance of the City of
Oconomowoc.
NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Oconomowoc
that the following license be granted (will expire on June 30, 2020):
Reserve “Class B” License
(serve intoxicating liquor/fermented malt beverages)
Brinker Restaurant Corporation dba Chili’s Grill & Bar
1229 Corporate Center Drive
