This constitutes a meeting of the Common Council pursuant to State ex rel. Badke v. Greendale Village Board, 173Wis. 2d 553, 494 N.W. 2d 408 (1993) and must be noticed as such, although the Common Council will not take any formal action at this meeting. 1  MEMORANDUM CLERK’S Date: December 11, 2019 To: Mayor Nold Protection & Welfare Common Council From: Diane Coenen, Clerk Re: Coco’s Seafood & Steakhouse – Reserve “Class B” License RELATES TO THE STRATEGIC PLAN Strategic Goal – Focus on Economic Development BACKGROUND The City received an application for a Reserve “Class B” Intoxicating Liquor/Fermented Malt Beverage license from Highline Vault, Inc., Mark Rossetti, Agent, to sell intoxicating liquor and fermented malt beverages at 151 St Paul Street. Coco’s Seafood & Steakhouse is a new restaurant that will operate out of the Fowler Lake Village building . There will be seating for 96 and a full-service bar (see attached floor plan.) The applicant meets all Chapter 12 and State licensing requirements. ADDITIONAL ANALYSIS This reserve license was put on “hold” by Council on February 5, 2013 for the City Hall North Redevelopment Area. Council had previously adopted Resolution 12-R2376 acknowledging the CDA entered into a Memorandum of Understanding with Rockwell Development, LLC (Fowler Lake Village) for the development of a mixed-use project containing retail/office space, a restaurant and residential condominiums. The City agreed through the MOU to put key elements in place which included reserving a license to ensure its availability when the project moved forward. As of this writing, the owner plans to open later in January 2020. I would like to suggest granting the license with a condition that the Clerk not issue the license until the owner confirms the opening date but not later than February 28th. If the opening does not occur by February 28th the license will not be issued and the applicant would have to come back to Council for reapproval. FINANCIAL IMPACT There is an initial fee of $10,000.00 for a Reserve “Class B” license in addition to the license fee. There will be seating for 99 which includes 15 seats at the Taproom bar (see attached floor plan.) The applicant anticipates opening January 10th and meets all Chapter 12 and State licensing requirements. This system is in place for public safety purposes aligning all property addresses within the City on a consistent system. With the upcoming attachment of the Southwoods Subdivision, questions were raised about this requirement. In reviewing the matter further, it was determined there may be certain unique situations in which this requirement may warrant waiver. The attached ordinance is drafted to provide a provision within the City’s code that the Chief of Police may waive the base line system numbering if he/she determines it is not necessary upon consideration of public safety. ADDITIONAL ANALYSIS n/a FINANCIAL IMPACT n/a RECOMMENDATION Staff recommends the approval of the waiver provision to be incorporated into the City’s municipal code. SUGGESTED MOTION Move to approve the Ordinance to Create Section 8.10(2)(c) of the City Code Relating to House Numbering. 1 9  ORDINANCE NO. 19-O________ ORDINANCE TO CREATE §8.10(2)(c) OF THE CITY OF OCONOMOWOC MUNICIPAL CODE RELATING TO HOUSE NUMBERING _______________________________________________________________________ The Common Council of the City of Oconomowoc, Waukesha County, Wisconsin, do ordain as follows: SECTION 1. Section 8.10(2)(c) of Chapter 8 of the Municipal Ordinance, is hereby created to include the following: §8.10(2)(c) – Waiver. The Chief of Police may waive the base line system of numbering if the Chief determines that assignment of house numbers under the system is not necessary based upon consideration of public safety. SECTION 2. EFFECTIVE DATE. This ordinance shall become effective upon passage and publication as required by law.
