Protection & Welfare Committee Meeting Minutes – October 6, 2020 Chairman Rosek called the meeting to order at 7:15 PM. Members Present: Aldermen Rosek and Schellpeper Absent: Alderman Rogers Staff Present: Mayor Magnus, Frye, Pfister, Lam and Coenen Others Present: Alds. Zapfel, Ellis, Spiegelberg, and Kowieski 2. a. Consider/recommend Ordinance #20-O983 Amending Section 12.04(3)(g)1. of the City of Oconomowoc Municipal Code Regarding Issuance of Operator’s Licenses: Coenen reported in 2018 Wisconsin State Statue 125.17(1) was amended to allow the municipal governing body the authority to designate a municipal official to issue operator's licenses. Currently, the wait time for an applicant to receive their bartender’s license is approx. two weeks because Council only meets twice a month. I have received requests from applicants and businesses looking for ways to speed up the process so they can start work immediately. The ordinance amendment would address the wait time by allowing the Clerk the authority to issue Operator’s Licenses. The process to review the application and conduct a background check will remain the same. The Clerk’s Dept. will review the application for Statutory and Code compliance and obtain a copy of the applicant’s Responsible Beverage Training Certificate and the Police Dept. will conduct the background check and sign-off for approval or denial of the license. If the license is denied by the Police Dept., the application will be brought forward to Council for a final determination. If the license is approved by the Police Dept., the Clerk would issue the license to the applicant and continue to provide the Police Dept. with an updated monthly list of all licensed bartenders in the City. If the code is amended, the only difference in procedure is that Operator’s Licenses currently listed under the Consent Agenda for Council’s consideration will no longer be listed. We will continue to list Operator denials, Picnic, Taxi/Quadricycle and Amusement Licenses, and Agent changes under the Consent Agenda for Council consideration. The Committee asked that the Clerk include Council on the email to the Police Dept. of the monthly report of licensed bartenders. Motion by Rosek to recommend amending Ordinance #20-O983 Section 12.04(3)(g)1. of the City of Oconomowoc Municipal Code allowing the City Clerk to issue Operator’s Licenses and to waive the second reading; second by Schellpeper. Greendale Village Board, 173Wis. 2d 553, 494 N.W. 2d 408 (1993) and must be noticed as such, although the Common Council will not take any formal action at this meeting. 1 MEMORANDUM CLERKS Date: September 30, 2020 To: Mayor Magnus Common Council From: Diane Coenen, City Clerk Re: Issuance of Operator’s (Bartenders) Licenses RELATES TO THE STRATEGIC PLAN Strategic Goal – N/A BACKGROUND In 2017/18 Wisconsin State Statue 125.17(1) was amended to read: “Every municipal governing body shall issue an operator's license to any applicant who is qualified except that the municipal governing body may by ordinance authorize a designated municipal official to issue operator's licenses.” In order to make the process more efficient for the applicant, by reducing the amount of wait time to receive their license (approx. two weeks), I am requesting an ordinance change to allow the City Clerk the authority to issue Operator’s Licenses. ADDITIONAL ANALYSIS The process to review the application and conduct a background check will remain the same. The Clerk’s Dept. will review the application and obtain a copy of the applicant’s Responsible Beverage Training Certificate and the Police Dept. will conduct the background check and sign-off for approval or denial of the license. If the license is denied by the Police Dept., the application will be brought forward to Council for a final determination. FINANCIAL IMPACT N/A RECOMMENDATION I recommend giving Ordinance No. 20-O983 it’s first reading and waive the second reading. OF THE CITY OF OCONOMOWOC MUNICIPAL CODE REGARDING ISSUANCE OF OPERATOR’S LICENSES The Common Council, City of Oconomowoc, Waukesha County, Wisconsin, do ordain as follows: Section 1. INTOXICATING LIQUOR AND FERMENTED MALT BEVERAGES 12.04(3)(gf)1. of the Municipal Code is amended to read: (3) CLASSES OF LICENSES AND FEES (g) Operator's License. 1. Operator's licenses may be granted to individuals by the City Clerk for the purposes of complying with Sections 125.32(2) and 125.68(2), Wis. Stats. SECTION 2. EFFECTIVE DATE.
