Call to order and confirmation of appropriate meeting notification Committee Business a. Consider/recommend Resolution 21-R2929 Granting New 2021 Reserve "Class B" Intoxicating Liquor/Fermented Malt Beverage License to Olympia Hospitality LLC Motion to recommend Resolution 21-R2929 granting new 2021 Reserve "Class B" Intoxicating Liquor/Fermented Malt Beverage License to Olympia Hospitality LLC made by Schellpeper and seconded by Rosek. Motion carried 3-0-0. Adjourn Motion by Rosek to adjourn the Protection & Welfare Committee meeting, second by Schellpeper. Motion carried 3-0-0. Adjourn ________________________________ Diane Coenen, City Clerk City of Oconomowoc Notice is hereby given that a majority of the Common Council will be present at the above scheduled meeting to gather information about a subject over which they have decision-making responsibility. This constitutes a meeting of the Common Council pursuant to State ex rel. Badke v. Greendale Village Board, 173Wis. 2d 553, 494 N.W. 2d 408 (1993) and must be noticed as such, although the Common Council will not take any formal action at this meeting. 1 MEMORANDUM CLERKS TO: Mayor Magnus Protection and Welfare Common Council FROM: Diane Coenen, Clerk DATE: February 22, 2021 RE: Olympia Hospitality LLC – Reserve “Class B” License RELATES TO THE STRATEGIC PLAN Strategic Goal – N/A BACKGROUND The City received an application for a Reserve “Class B” Intoxicating Liquor/Fermented Malt Beverage license from Olympia Hospitality LLC, Matthew Moroney, Agent, for the property located at 1414 Summit Avenue. The license is being applied for per the Tax Increment Agreement approved by the Council on January 19, 2021 which provides in Article IV, City Activities and Obligations, Item F. that the City shall issue one Reserve “Class B” license for the Olympia Fields Project. Although there is not currently a business in operation, the licensee/agent does meet the requirements to obtain a liquor license which are, completed paperwork, responsible beverage training course and background check. ADDITIONAL ANALYSIS The agreement also provides that if a full-service restaurant is not operational as of June 30, 2024 the license shall be deemed revoked and surrendered to the City. FINANCIAL IMPACT The fees associated with a Reserve “Class B” license are: Initial Reserve Fee is $10,000 plus a $200 License Fee, which is prorated per Wis Stats. The licensee will also need to renew the license annually during the June license renewal period. RECOMMENDATION Protection & Welfare Recommendation: Move to recommend granting a new 2021 Reserve “Class “B” Intoxicating Liquor/Fermented Malt Beverage license to Olympia Hospitality LLC per the Tax Increment Agreement. SUGGESTED MOTION Council Recommendation: Move to adopt Resolution 21-R2929 granting a new 2021 Reserve “Class “B” Intoxicating Liquor/Fermented Malt Beverage license to Olympia Hospitality LLC per the Tax Increment Agreement. 1 2 RESOLUTION NO. 21-R2929 RESOLUTION GRANTING NEW 2021 RESERVE “CLASS B” INTOXICATING LIQUOR/ FERMENTED MALT BEVERAGE LICENSE TO OLYMPIA HOSPITALITY, LLC WHEREAS, an application for the following new license has been made, necessary fees deposited and all legal procedures have been taken, as per ordinance of the City of Oconomowoc; and WHEREAS, the license is being applied for per the Tax Increment Agreement approved by the Council on January 19, 2021 which provides in Article IV, City Activities and Obligations, Item F. that the City shall issue one Reserve “Class B” license for the Olympia Fields Project. NOW THEREFORE, BE IT HEREBY RESOLVED the agreement also provides that if a full-service restaurant is not operational as of June 30, 2024 the license shall be deemed revoked and surrendered to the City.
