This constitutes a meeting of the Common Council pursuant to State ex rel. Badke v. Greendale Village Board, 173Wis. 2d 553, 494 N.W. 2d 408 (1993) and must be noticed as such, although the Common Council will not take any formal action at this meeting. 1  MEMORANDUM CLERKS TO: Mayor Magnus Protection and Welfare Common Council FROM: Diane Coenen, Clerk DATE: April 1, 2021 RE: The Etc Bar and Grill LLC – “Class B” License RELATES TO THE STRATEGIC PLAN Strategic Goal – N/A BACKGROUND The City received an application for a new “Class B” Intoxicating Liquor/Fermented Malt Beverage license for The Etc Bar and Grill LLC, Brian Borkowski, Agent, for the property located at 118 E. Wisconsin Avenue. Mr. Borkowski purchased the property at 118 E. Wisconsin in March from Lynn Reed, owner of Lakerz Pub & Eatery. He plans to open his new business between April 7th and 16th. Lakerz closed on March 19th. The applicant meets all State Statute and Chapter 12 requirements and is also the owner of Vino, Etc. I have included a copy of the floor plan as provided by Mr. Borkowski. ADDITIONAL ANALYSIS I recommend that the license is granted on the condition the Clerk not issue the license until the owner confirms the opening date, but no later than May 15th and upon receipt of a Letter of Surrender from Ms. Reed for the Lakerz license. FINANCIAL IMPACT The “Class B” license is a regular license and will expire on June 30th. The prorated fee is $150.00 and the license will need to come forward for renewal during our annual June licensing renewal period. RECOMMENDATION Protection & Welfare Recommendation: Move to recommend granting a new 2021 “Class “B” Intoxicating Liquor/Fermented Malt Beverage license to The Etc Bar and Grill LLC with the condition the Clerk not issue the license until the owner confirms the opening date, but no later than May 15th and upon receipt of a Letter of Surrender from Ms. Reed for the Lakerz license. 1 2 SUGGESTED MOTION Council Recommendation: Move to adopt Resolution 21-R2941 granting a new 2021 “Class “B” Intoxicating Liquor/Fermented Malt Beverage license to The Etc Bar and Grill LLC with the condition the Clerk not issue the license until the owner confirms the opening date, but no later than May 15th and upon receipt of a Letter of Surrender from Ms. Reed for the Lakerz license. 2 3 4  RESOLUTION NO. 21-R2941 RESOLUTION GRANTING A NEW 2021 "CLASS B" INTOXICATING LIQUOR/FERMENTED MALT BEVERAGE LICENSE TO THE ETC BAR AND GRILL, LLC WHEREAS, an application for the following new license has been made, necessary fees deposited and all legal procedures have been taken, as per ordinance of the City of Oconomowoc.
