Call to order and confirmation of appropriate meeting notification Committee Business a. Consider/recommend Resolution 22-R3009 Granting New 2021-2022 "Class B" Intoxicating Liquor/Fermented Malt Beverage License to Ginger Ovens LLC Coenen reported on the application and the Committee discussed the business operation in relation to highest and best use of a “Class B” license. Motion to move the resolution granting a new 2021-2022 "Class B" Intoxicating Liquor/Fermented Malt Beverage License for Ginger Ovens, LLC on to Council without a recommendation made by Ellis and seconded by Rosek. Adjourn Motion to adjourn made by Ellis and seconded by Rosek. Motion carried 2-0-0. Adjourn ________________________________ Diane Coenen, City Clerk City of Oconomowoc Notice is hereby given that a majority of the Common Council will be present at the above scheduled meeting to gather information about a subject over which they have decision-making responsibility. This constitutes a meeting of the Common Council pursuant to State ex rel. Badke v. Greendale Village Board, 173Wis. 2d 553, 494 N.W. 2d 408 (1993) and must be noticed as such, although the Common Council will not take any formal action at this meeting. 1 MEMORANDUM CLERKS Date: January 26, 2022 To: Mayor Magnus Protection & Welfare Common Council From: Diane Coenen, City Clerk Re: Ginger Ovens LLC – New “Class B” License RELATES TO THE STRATEGIC PLAN Strategic Goal - N/A BACKGROUND The City received an application for a new “Class B” intoxicating liquor/fermented malt beverage license from Ginger Ovens LLC, Jonathan Sandor, agent for the property located at 219 E. Pleasant Street. The applicant meets all State Statute and Chapter 12 requirements. I have included a copy of the floor plan which outlines inside seating at 25 and outside seating at 12 with the alcohol sold and served at a counter and stored on shelving or cabinetry. Days/hours of operation are shown on the floor plan. ADDITIONAL ANALYSIS I have also included a copy of the “Class B” Best and Highest License Use Criteria sheet that was put together in 2017 and presented to the Protection and Welfare Committee as a tool to use in determining issuance of new licenses. Council has broad discretion whether to issue or deny a new license after proper review of the application and consideration of public sentiment or concerns. If the license is denied, State Statute 125.12(3m) provides that the applicant shall be notified in writing of the reason(s) for denial. The City has two regular ($600) “Class B” licenses and seven Reserve ($10,000) “Class B” licenses available. Reserve licenses can only be issued if there are no regular licenses available. FINANCIAL IMPACT The “Class B” license would expire June 30, 2022. The prorated fee, per State Statute is $200. RECOMMENDATION Based on the criteria sheet, and the business operations as provided by Ginger Ovens LLC they do not fall into the category of best and highest use of a “Class B” license. SUGGESTED MOTION 1 2 There are two potential motions: 1) Motion to adopt Resolution 22-R3009 granting a new “Class B” license to Ginger Ovens LLC OR 2) Motion to deny the “Class B” license application of Ginger Ovens LLC based on ………….. 2 3 4 “CLASS B” INTOXICATING LIQUOR/FERMENTED MALT BEVERAGE ESTABLISHMENTS BEST AND HIGHEST LICENSE USE CRITERIA The Committee shall consider the following: 1. Establishment with a Full-Service Bar  Full-Service Restaurant  Taverns / Pubs  Hotel  Diner  Club  Café / Coffee Shop 2. Establishment w/o a Full-Service Bar Seating Capacity Interior and Exterior: 1. 200 – 299 2. 100 – 199 3. 1 – 99 Food Served: 1. Full Meals 2. Appetizers 3. Catered Events 4. Prepackaged Foods 5. Snacks (Pretzels, Peanuts, etc.) Premise: 1. Previously Licensed 2. Redevelopment Area 3. New Structure Code Compliance: 1. No Outstanding Claims 2. No Inspections Issues 3. Annual Utility Reports Completed Number of Employees: 1. More than 50 2. Less than 50 5 RESOLUTION NO. 22-R3009 RESOLUTION GRANTING NEW 2021-2022 “CLASS B” INTOXICATING LIQUOR/ FERMENTED MALT BEVERAGE LICENSE TO GINGER OVENS, LLC WHEREAS, an application for the following new license has been made, necessary fees deposited and all legal procedures have been taken, as per ordinance of the City of Oconomowoc. NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Oconomowoc that the following license be granted (will expire on June 30, 2022): “Class B” Combination License (serve intoxicating liquor/fermented malt beverages) Ginger Ovens LLC 219 E.
