City of Oconomowoc Protection & Welfare Committee Meeting Minutes June 27, 2023 - 6:55 PM Aldermen Present: Chris Douglas, Charles Schellpeper, Matt Rosek Also Present: Robert Magnus, Matt Mulder, Jennifer Aultman Kloth, Kevin Ellis, Karen Spiegelberg, Andy Moroni, Lucas Caine, Diane Coenen, Robert Duffy, Kevin Freber, Mark Frye, Jason Gallo, Craig Hoeppner, Scott Osborn, Laurie Sullivan-Murray, Brad Timm, Brad Bowen, Stan Riffle Chairman Douglas called the Protection & Welfare Committee Meeting to order at 6:32 PM (immediately following Finance Committee.) Committee Business a. Consider/recommend Resolution 23-R3136 Granting New 2023-2024 "Class B" Intoxicating Liquor/Fermented Malt Beverage License to BNB Lounge, LLC (Bubbles and Bourbon) Motion to recommend Resolution 23-R3136 granting a new 2023-2024 "Class B" Intoxicating Liquor/Fermented Malt Beverage License to BNB Lounge, LLC (Bubbles and Bourbon) on the condition they receive occupancy no later than July 31st made by Rosek and seconded by Schellpeper. Motion carried 3-0-0. Adjourn Motion to adjourn made by Rosek and seconded by Schellpeper. Motion carried 3-0-0. Adjourn ________________________________ Diane Coenen, City Clerk City of Oconomowoc Notice is hereby given that a majority of the Common Council will be present at the above scheduled meeting to gather information about a subject over which they have decision-making responsibility. This constitutes a meeting of the Common Council pursuant to State ex rel. Badke v. Greendale Village Board, 173Wis. 2d 553, 494 N.W. 2d 408 (1993) and must be noticed as such, although the Common Council will not take any formal action at this meeting. 1 MEMORANDUM CLERKS To: Mayor Magnus Protection and Welfare Common Council From: Diane Coenen Re: “Class B” Intoxicating Liquor/Fermented Malt Beverage License – BNB Lounge, LLC (Bubbles and Bourbon) RELATES TO THE STRATEGIC PLAN Strategic Goal- N/A BACKGROUND The City has received an application for a “Class B” Intoxicating Liquor/Fermented Malt Beverage license from BNB Lounge, LLC (Bubbles and Bourbon), Michele Y. Gilbert, Agent, to sell intoxicating liquor/fermented malt beverages at 203A E. Wisconsin Avenue. The applicant meets all Chapter 12 and State licensing requirements and has provided the attached floor plan and rendering. ADDITIONAL ANALYSIS “Class B” licenses are restricted by quota and alcohol must be consumed on the premise. If this license is granted, the City will have 1 Regular ($600) and 9 Reserve ($10K) “Class B” licenses remaining. FINANCIAL IMPACT N/A RECOMMENDATION Protection & Welfare Recommendation: Move to recommend approving the “Class B” Intoxicating Liquor/Fermented Malt Beverage license to BNB Lounge, LLC at 203A E. Wisconsin Avenue. SUGGESTED MOTION Council Recommendation: Move to adopt Resolution 23-R3136 granting a new “Class B” Intoxicating Liquor/Fermented Malt Beverage License to BNB Lounge, LLC. 2 3 4 “CLASS B” INTOXICATING LIQUOR/FERMENTED MALT BEVERAGE ESTABLISHMENTS BEST AND HIGHEST LICENSE USE CRITERIA The Committee shall consider the following: 1. Establishment with a Full-Service Bar  Full-Service Restaurant  Taverns / Pubs  Hotel  Diner  Club  Café / Coffee Shop 2. Establishment w/o a Full-Service Bar Seating Capacity Interior and Exterior: 1. 200 – 299 2. 100 – 199 3. 1 – 99 Food Served: 1. Full Meals 2. Appetizers 3. Catered Events 4. Prepackaged Foods 5. Snacks (Pretzels, Peanuts, etc.) Premise: 1. Previously Licensed 2. Redevelopment Area 3. New Structure Code Compliance: 1. No Outstanding Claims 2. No Inspections Issues 3. Annual Utility Reports Completed Number of Employees: 1. More than 50 2. Less than 50 5 RESOLUTION NO. 23-R3136 RESOLUTION GRANTING NEW 2023 - 2024 “CLASS B” INTOXICATING LIQUOR/ FERMENTED MALT BEVERAGE LICENSE TO BNB LOUNGE, LLC (BUBBLES AND BOURBON) WHEREAS, an application for the following new license has been made, necessary fees deposited and all legal procedures have been taken, as per ordinance of the City of Oconomowoc. NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Oconomowoc that the following license be granted (will expire on June 30, 2024): “Class B” License (serve intoxicating liquor/fermented malt beverages) BNB Lounge, LLC (Bubbles and Bourbon) 203A E.
