Committee Business a. Consider/recommend Resolution 24-R3198 Granting Renewal of 2024 - 2025 Alcohol Beverage Licenses Pfister noted that five citations have been issued to Vino Etcetera and their license renewal is not being brought forward until June 18th. The owner Brian Borkowski paid the citations in full on 6/4/24. Motion to recommend Resolution 24-R3198 granting renewal of 2024 - 2025 Alcohol Beverage Licenses made by Schellpeper and seconded by Mulder. Protection & Welfare had concerns because the owner of Vino is the same owner of The Etcetera. Motion carried 2-0-1. Voted no Ellis. b. Consider/recommend Resolution 24-R3199 Granting a New 2024-2025 "Class A” Intoxicating Liquor/Fermented Malt Beverage License to Sausage Haus Motion to recommend Resolution 24-R3199 granting a new 2024 - 2025 "Class A" Intoxicating Liquor/Fermented Malt Beverage License to Sausage Haus made by Mulder and seconded by Schellpeper. Motion carried 3-0-0. c. Consider/recommend Ordinance 24-O1069 to Opt Out of Extended Closing Hours for Licensed Alcohol Premises During the Republican National Convention (July 15-18, 2024) Motion to pass Ordinance 24-O1069 to Opt Out of Extended Closing Hours for Licensed Alcohol Premises during the Republican National Convention (July 15-18, 2024) on to Council without a recommendation made by Mulder and seconded by Schellpeper. Motion carried 3-0-0. Adjourn Motion to adjourn made by Schellpeper and seconded by Mulder. Motion carried 3-0-0. This constitutes a meeting of the Common Council pursuant to State ex rel. Badke v. Greendale Village Board, 173Wis. 2d 553, 494 N.W. 2d 408 (1993) and must be noticed as such, although the Common Council will not take any formal action at this meeting. 1 MEMORANDUM CLERKS Date: May 30, 2024 To: Mayor Magnus Protection & Welfare Committee Common Council From: Diane Coenen, City Clerk Re: Renewal of Alcohol Beverage Licenses: July 1, 2024 – June 30, 2025 RELATES TO THE STRATEGIC PLAN Strategic Goal – N/A BACKGROUND The resolution lists all licensee applications that were received by the deadline requesting renewal of their Class A, B and/or C alcohol beverage license(s) for the licensing period July 1, 2024 to June 30, 2025. All licensees/premises are current with all obligations to the City and meet all Chapter 12 code and State statutory requirements. ADDITIONAL ANALYSIS Below are the types of alcohol licenses the City issues and number available: These licenses are restricted by quota and alcohol must be consumed on the premise. - “Class B” Intoxicating Liquor/Fermented Malt Beverage Licenses – 0 Regular $600 each - “Class B” Intoxicating Liquor/Fermented Malt Beverage Licenses – 8 Reserve $10,000 + $600 each These licenses are not restricted by quota and alcohol must be consumed on the premise. - Class “B” Fermented Malt Beverage License – $100 each - “Class C” Wine License – $100 each These licenses are not restricted by quota, they are a retail purchase, and consumption is away from the premise. - “Class A” Intoxicating Liquor/Fermented Malt Beverage License – $600 each - Class “A” Fermented Malt Beverage License – $100 each FINANCIAL IMPACT N/A 1 2 RECOMMENDATION Protection and Welfare Recommendation: Move to recommend granting renewal 2024-2025 alcohol beverage licenses as presented. Oakwood Ave. The applicant currently has a Class “A” Fermented Malt Beverage License and would like to add the sale of wine for his customers. He meets all Chapter 12 and State licensing requirements. ADDITIONAL ANALYSIS The City has no quotas on “Class A” licenses and the license would take effect on July 1, 2024. Magnus, Mayor ATTEST: Diane Coenen, Clerk 9 MEMORANDUM ADMINISTRATION Date: June 4, 2024 To: Mayor and Common Council From: Mark Frye, City Administrator Re: Consider/act on Ordinance 24-O1069 to Opt-Out of Extended Closing Hours for Licensed Alcohol Premises During the Republican National Convention RELATES TO THE STRATEGIC PLAN N/A BACKGROUND Act 73, enacted in December 2023, included a provision to extend the hours of alcohol sales in the counties surrounding the City of Milwaukee during the Republican National Convention July 15-18, 2024. The closing hours would be anytime between 4am and 6am. The Act also included an Opt-Out provision should a municipality wish to maintain their current sales hours. Right now, alcohol sales must end by 2am during the week. ADDITIONAL ANALYSIS N/A FINANCIAL IMPACT N/A RECOMMENDATION There is no Staff recommendation regarding the Ordinance. The item is on the agenda, so the Common Council knows there are options regarding the alcohol sales hours during the Republican National Convention in July. SUGGESTED MOTION N/A Z:\City Administrator\Council Agenda\Ordinance to Opt-Out of Act 73 Extended Alcohol Sales Durning RNC 2024\Background Memo for Ordinance 24-RO1069 to Opt Out of Extended Closing Hours for Alcohol Sales During RNC 2024 06042024.docx 1 10 STATE OF WISCONSIN WAUKESHA COUNTY CITY OF OCONOMOWOC ORDINANCE 24-O1069 An Ordinance Pursuant to § 64c(4) of 2023 Wisconsin Act 73 To Opt-Out Of Extended Closing Hours for Licensed Alcohol Premises During the Republican National Convention (July 15 – 18, 2024) WHEREAS, § 64c(4) of 2023 Wisconsin Act 73 provides for an extension of the closing hours in Chapter 125 for alcohol licensees located in Kenosha, Racine, Walworth, Rock, Milwaukee, Waukesha, Jefferson, Dane, Ozaukee, Washington, Dodge, Columbia, Sheboygan, or Fond du Lac Counties commencing on the first day of the Republican National Convention in the summer of 2024 until the day after said convention’s last day; and WHEREAS, § 64c(4) of 2023 Wisconsin Act 73 further provides that a municipality located within the aforementioned counties may establish a disqualification process for alcohol licensees that it has licensed or may opt out of the extended hours otherwise permitted by § 64c(4) of 2023 Wisconsin Act 73 by the enactment of an ordinance after the effective date of 2023 Wis. Act 73; and WHEREAS, the City Common Council finds that the public health, safety, and welfare will be promoted by opting out of the extended closing hours provided for the Republican National Convention; NOW THEREFORE, the City Council of the City of Oconomowoc, Waukesha County do hereby ordain as follows: SECTION I. Pursuant to §§ 64c(4)(b)(3), 64c(4)(c)(3), and 64c(4)(d)(3) of 2023 Wisconsin Act 73, the City of Oconomowoc hereby acts to “opt-out” of the extended hours otherwise permitted under 2023 Wis. Act 73, § 64c for the Republican National Convention, and the closing hours set forth in the closing hours specified in Wis. Stat. §§ 125.29(8)(a), 125.52(5)(a), and 125.53(4)(a), 125.32(3)(a). 125.68(4)(c)1 shall remain in effect throughout said convention period. 1 11 SECTION II: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a court of competent jurisdiction to be invalid, unlawful or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision and shall not affect the validity of any other provisions, sections or portions thereof of the ordinance. The remainder of the ordinance shall remain in full force and effect. Any other ordinances whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict. SECTION III: This Ordinance shall take effect and be in force after its passage and posting/publication as required by law.
