This constitutes a meeting of the Common Council pursuant to State ex rel. Badke v. All licensees/premises are current with all obligations to the City and meet all Chapter 12 code and State statutory requirements. Magnus, Mayor Diane Coenen, City Clerk TO: City of Oconomowoc Common Council Protection and Welfare From: Chief of Police, James Pfister RE: Probationary Period Liquor License - Vino Etcetera ______________________________________________________________________________ The police department conducts background checks and license premise inspections each year for alcohol license renewals in May and June. Upon review of the renewals, Vino Etcetera’s had several violations over the past year and was delinquent in fines to the Lake County Municipal Court. On June 4, 2024, I had a meeting with the owner of Vino Etcetera at the police department. During the meeting, Brian Borkowski was notified that the business had over $1600.00 in fines due to the Lake Country Municipal Court because of unpaid violations submitted by the City of Oconomowoc Police Department. Brian advised me that once the meeting was over, he was going to pay all fines due. Brian and I further discussed violations that were for loud noise and underage subjects located in the bar. We discussed several ways to keep underage individuals out of the bar and standard practices for checking identification properly. Brian addressed the noise issue, stating that the bands that are playing get hot and open the windows behind them while playing. Brian stated that he was going to make sure that all the bands knew the windows and doors must always remain closed when they play. Brian was notified that the recommendation to the Common Council on June 18, 2024, would be for a probationary period for a total of four months. 4 The City of Oconomowoc Police Department is recommending that the alcohol license for Vino Etcetera be placed in a probationary period until November 5, 2024. The police department will give the council an update on this date for full renewal. If violations occur during the probationary period, this license may be brought up for review before the November date. Respectfully Submitted, Chief James P Pfister 5  RESOLUTION NO. 24-R3207 RESOLUTION GRANTING PROBATIONARY RENEWAL OF 2024-2025 ALCOHOL BEVERAGE LICENSE FOR WINE & DÉCOR, LLC WHEREAS, an application for the following renewal license have been made, necessary fees deposited and all legal procedures have been taken, as per ordinance of the City of Oconomowoc; and WHEREAS, due to Wine & Décor, LLC having several violations over the past year and delinquent fines to the Lake Country Municipal Court, the Police Department is recommending that the Reserve "Class B" Intoxicating Liquor/Fermented Malt Beverage License be placed in a probationary period through November 5, 2024 at which time the license will be brought back to Council for consideration of the remainder of the licensing period ending June 30, 2025. Magnus, Mayor ATTEST: Diane Coenen, Clerk 6  MEMORANDUM CLERKS Date: June 12, 2024 To: Mayor Magnus Protection & Welfare Common Council From: Diane Coenen Re: Producer Full-Service Retail Sales Application – Steelhead Aleworks, LLC RELATES TO THE STRATEGIC PLAN Strategic Goal - N/A BACKGROUND Recently enacted legislation (December 2023), Act 73 requires a brewery that manufactures its own fermented malt beverages to submit a Full-Service Retail Sales Application (new form) to the community in which it operates for approval only of the type(s) of alcohol they will be offering for sale. The application requires approval by the governing body and also allows the Council to impose any requirement or restriction in connection with the approval as to the types of alcohol they request to sell. This approval does not grant a license to the applicant, it is only stating that the City approves the retail sales of the type(s) of alcohol the producer is requesting to sell. The license itself is granted and issued by the Wisconsin Division of Alcohol Beverages. ADDITIONAL ANALYSIS Steelhead Aleworks, LLC dba Steeltank Brewing Co. is requesting to sell beer, wine and intoxicating liquor at their location, 1225 Robruck Drive. They have been operating at this location since 2019 with sales of beer and a “Class C” Wine License issued by the City. Because they are a producer and manufacturer their own beer, it is not required by the State that they need a Class “B” Fermented Malt Beverage License from the City. FINANCIAL IMPACT The financial impact is a loss of $100 in annual revenue for the “Class C” Wine License.
