This constitutes a meeting of the Common Council pursuant to State ex rel. Badke v. DBA Johnny Pizza’s & Pastaria – “Class B” License RELATES TO THE STRATEGIC PLAN Strategic Goal - N/A BACKGROUND The City received an application for a new “Class B” Intoxicating Liquor/Fermented Malt Beverage license from JKTS, Inc. dba Johnny Pizza’s & Pastaria, Timothy Mueller, Agent, for the property located at 1288 Summit Avenue, Suite 101. The existing business owner, Mark Herdt, notified the City that he is selling his business known as Rosati’s Pizza and closing is scheduled for August 31st. Mr. Herdt plans to surrender his license on the same date of the closing so the new license can take effect on August 31st. The applicant meets all State Statute and Chapter 12 requirements and is not making any changes to the interior or business operation. ADDITIONAL ANALYSIS The request is to grant the new license on the condition that a successful closing takes place on August 31, 2025. FINANCIAL IMPACT The “Class B” license is a regular license and will expire on June 30, 2025. The prorated fee is $550.00 and the license will need to come forward for renewal during our annual licensing renewal period next June. RECOMMENDATION Protection & Welfare Recommendation: Move to recommend Resolution 24-R3213 granting a new 2024 “Class B” Intoxicating Liquor/Fermented Malt Beverage license to JKTS, Inc. conditioned upon the successful closing of the business on August 31, 2025. WHEREAS, an application for the following new license has been made, necessary fees deposited and all legal procedures have been taken, as per ordinance of the City of Oconomowoc.
