WHEREAS, the election for a sales tax on adult use, non-medical marijuana was held on Tuesday, April 4, 2023; and WHEREAS, the Lafayette County Clerk has certified the election results and those results are attached as Exhibit A. NOW, THEREFORE, BE IT ORDAINED BY THE ODESSA BOARD OF ALDERMAN OF THE CITY OF ODESSA, MISSOURI AS FOLLOWS: Section 1. It is hereby found, declared and determined in accordance with the certification of election results from the Lafayette County Clerk, at the general municipal election held Tuesday, April 4, 2023, in conformity with the laws of the State of Missouri, as follows: Question 1 Shall the City of Odessa, Missouri, impose a city sales tax of three percent (3%) on the sale of adult use marijuana sold at retail? VOTES IN FAVOR VOTES OPPOSED 604 148 The Board of Alderman finds there were more votes in favor of imposing a sales tax on adult use, non- medical marijuana than votes opposed. Section 2. The provisions of this ordinance are declared to be severable, and if any sentence, clause or phrase of this ordinance shall for any reason be held to be invalid or unconstitutional, such decisions shall not affect the validity of the remaining sections, sentences, clause or phrases of this ordinance, but they shall remain in effect notwithstanding the invalidity of any part thereof. Section 3. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. This ordinance shall be in full force and effect from and after its passage and approval.
