Motion carried 6-0. PUBLIC HEARING The public hearing was opened at 7:01 pm on the proposed tax levy of the general ad valorem property tax for General and Parks for the City of Odessa. Let the record show there were no comments. The public hearing was closed at 7:02 pm. MAYOR'S REPORT Mayor Wright thanked everyone who made the National Night Out successful as well as Puddle Jumper Days. ALDERMEN REPORTS •Alderman Barner thanked everyone who helped with Puddle Jumpers. • Alderman Harves thanked everyone that helped with the Puddle Jumpers, and also informed the board that he would be moving and would be stepping down as Alderman at the end of the month. He stated that it is not a good time to be leaving Odessa with so many exciting things coming, and it's been an honor to serve. • Alderman Lockhart thanked Ray for his service. He inquired about the Casey's sign being moved back from the road when it is replaced. He also thanked the Mayor for his presence at Puddle Jumpers. • Alderwoman Starr stated she had the pleasure helping with Puddle Jumpers Day, and thanked Ray for his service. • Alderman Stevens thanked Ray for his service and wished him well, he also thanked the Puddle Jumpers Committee, and all the City Hall Staff for all the hard work done for Puddle Jumper Days. PUBLIC COMMENTS There were no public comments. NEW BUSINESS Discussion for Right-of Way vacates The City has received three separate requests for the vacating of portions of city right- of-ways. In all request, the city has communicated with legal counsel for guidance. Undeveloped portions of Crews Street. • Alderman Lockhart suggest that the city keep the property, the city might need it for future use. • Alderman Harves believes the city should keep the land. • Alderman Stevens agrees that the city should keep it. • Alderman Barner believes the city should also keep it. Alley between South Connor St. and South Russell St. • Alderman Lockhart said that someone has parked in the space since 1975 and thought it was unfair to tell them to stop. • Wilson stated that the property has now been surveyed • Mayor stated that the owner could put a fence on her property • Alderman Lockhart said no on the right-of-way • Alderman Barner agreed no on the right-of way  Motion of Approval - Residential Waste Collection Nici Wilson, City Administrator stated residential trash service is currently contracted with Heartland Waste of Central Missouri. Recently they have entered into a purchase agreement with Allied Services, LLC. (Republic Services). This transfer agreement would assign the right and obligations currently between the city and Heartland Waste to Allied Services. City staff is meeting with Allied Services next week to further discuss the transition. This agreement has been reviewed by City legal counsel. The current contract will expire September 30, 2021. • Alderwoman Starr stated she is not a fan • Tyler Riordan municipal sales manager with Republic Services said he understood the board's frustration, the company is working to update staff and routes. Some of Heartland employees had chosen not to work with Republic and so new drivers are familiarizing themselves with the routes. Services days will remain the same. • Alderman Stevens expressed his appreciation for the extra days they are working, but expressed his frustration with the fact that the board was told that all the trash would be picked up over the weekend and it was not. • Alderman Lockhart stated that Heartland had nice trucks and what he has seen so far are un kept and noisy trucks. • Riordan said that they own their own fleet, but they are renting some trucks from other Republic Services locations, and said the issues would be fixed. • Mayor Wright stated that the contract was only through September. Motion was made by Alderman Stevens, seconded by Alderman Harves to approve transfer agreement. Motion carried 6-0. Bill No. 2021-22 (1 st reading) - Setting the tax levv for the vear 2021 Mayor Wright read the proposed ordinance setting the tax levy for the year 2021 for the City of Odessa, Missouri and designating the amount to be used for general and park purposes. Motion was made by Alderman Harves, seconded by Alderman Stevens to approve bill no. 2021-22 first reading. • Alderman Lockhart asked if this was posted in the paper. • Mayor Wright stated that is was. Bill No. 2021-22 became Ordinance No. 3046 Bill No. 2021-23 (1st reading) - Conflict of Interest Mayor Wright read the proposed ordinance repealing ordinance 2997 in its entirety: adopt an ordinance to establish a procedure to disclose potential conflicts of interest and substantial interest for certain municipal officials Motion was made by Alderman Stevens, seconded by Alderman Lockhart to approve bill no. 2021-23 first reading. Wilson noted that this was a house keeping ordinance that is adopted every two (2) years. A copy of it is require to be provided to the Missouri Ethics Commission. Motion carried 6-0. Joey Mcliney told the Board that the numbers had stayed the same from his presentation at the previous meeting. Noting that the cost of issuance had gone down in price and that expense will be paid with the savings of the next payment. Mcliney congratulated the Board for their diligence and noting he believes this a first for this type of refinance. Motion was made by Alderman Stevens, seconded by Alderman Barner to approve bill no. 2021-24 first reading. Motion carried 6-0. WHEREAS, the City initiated its application to amend certain sections in Chapter 8, Zoning Regulations to address for clarification and address changes in the law ("Text Amendment Application"); and WHEREAS, on May 20, 2021 , the Planning and Zoning Commission ("Commission") held a public hearing and all those interested and wishing to testify were given the opportunity; and WHEREAS, on August 19, 2021, the Commission recommended approval of certain changes of Chapter 50, Zoning Regulations; and WHEREAS, the Board of Aldermen reviewed the exhibits and other information submitted to the Commission, and held a public hearing all interested persons; and WHEREAS, the Board of Aldermen wishes to amend Chapter 50, Zoning Regulations to reflect the recommendation of the Planning and Zoning Commission. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF ODESSA, MISSOURI, AS FOLLOWS: Section 1. That Section 50-364 of the Code of Ordinances of City of Odessa, Missouri is here by amended as follows: Sec. 50-364. Uses permitted. Property and buildings in an 1-1 Light and Industrial District shall be used only for the following purposes: (1) Any use permitted in a C-3 Highway Commercial District. (2) Any of the following uses: a. Aerospace manufacturing. b. Automotive manufacturing. c. a:- Bakery. d. b-: Bottling works. £:. tr. Book bindery. f:. Eh Candy manufacturing. g. Any article stored temporarily outside of an enclosed building as an incidental part of the primary operation shall be so screened by ornamental walls and fences or evergreen planting that it cannot be seen from adjoining public streets or adjacent lots when viewed by a person standing on the ground level. (4) The following uses mav be permitted on review by the city planning and zoning commission: a. Animal food manufacturing. b. Food products processing and packing, including meat processing and packing. Retail sales are permitted only when incidental and accessory to a permitted principal use in accordance with this section.  Section 2. That Section 50-394 of the Code of Ordinances of City of Odessa, Missouri is here by amended as follows: Sec. 50-394. Uses permitted. Property and buildings in an 1-2 General Industrial District shall be used for the following purposes: (1) Any use permitted in the I-1 Light Industrial District. (2) Any of the following uses: a. Building material sales yard and lumber yard, including the sale of rock, sand, gravel and the like as an incidental part of the main business but not including a concrete batch plant or a transit mix plant. b. Contractor's equipment storage yard or plant or rental of equipment commonly used by contractors. c. Freighting or trucking yard terminal. d. Oilfield equipment storage yard. e. Public utility service yard or electrical receiving or transforming station. f. Sale barn. (3) The following uses when conducted within a completely enclosed building: a. The manufacturer, compounding, processing, packaging or treatment of such products as bakery goods, candy, cosmetics, dairy products, drugs, perfumes, pharmaceuticals, perfumed toilet soap, toiletries and food products. b. The manufacturer, compounding, assembling or treatment of articles or merchandise from the following previously prepared materials: bone, cellophane, canvas, cloth, cork, feathers, felt, fiber, fur, glass, hair, horn, leather, paper, plastics, precious or semi-precious metals or stone, shell, textiles, tobacco, wood, yam and paint not employing a boiling process. c. The manufacture of pottery and figurines or other similar ceramic products, using only previously pulverized clay and kilns fired only by electricity or gas. d. The manufacture and maintenance of electric and neon signs, commercial advertising structures, light sheet metal products, including heating and ventilating ducts and equipment, cornices, eaves and the like. e. Manufacture of musical instruments, toys, novelties and rubber and metal stamps. f. Automobile assembling, painting, upholstering, rebuilding, reconditioning, body and fender works, truck repairing and over-hauling, tire retreading or recapping and battery manufacturing. g. Blacksmith shop and machine shop, excluding punch presses over 20 tons rated capacity, drop hammers and automatic screw machines.  h. Foundry casting lightweight nonferrous metal not causing noxious fumes or odors. 1. Assembly of electrical appliances, electronic instruments and devices, radios and phonographs, including the manufacture of small parts only, such as coils, condensers, transformers, crystal holders and the like. (4) Buildings, structures and uses accessory and customarily incidental to any of the above uses. The uses permitted under this section shall be conducted in such a manner that no noxious odor, fumes or dust will be emitted beyond the property line of the lot on which the use is located. (5) The following uses may be permitted on review by the city planning and zoning comm1ss1on: a. Acid manufacture. b. Automobile salvage or junk yard. c. Building materials salvage yard. d. Cement, lime, gypsum or plaster of paris manufacture. e. Explosives, manufacture or wholesale storage. f. Gas manufacture or wholesale storage. g. Junk or salvage yard of any kind. h. Petroleum or its products, refining of. 1. Scrap metal storage yard. J. Wholesale or bulk storage of gasoline, propane or butane or other petroleum products. k. Any use not otherwise permitted in this division. I. Military and consumer ammunition, arms, and components manufacturing, distribution, and related integrated uses. m. Agricultural Chemicals, manufacture or wholesale storage. Retail sales are permitted only when incidental and accessory to a permitted principal use in accordance with this section. Section 3. The provisions of this ordinance are severable and if any provision hereof is declared invalid, unconstitutional, or unenforceable, such determination shall not affect the validity of the remainder of this ordinance. Section 4. All ordinances conflicting in whole or in part with the provisions of this Ordinance are hereby repealed to the extent of the conflict.  Section 5. This Ordinance shall be in full force and effect from and after its passage by the Board of Aldermen and approval by the Mayor. WHEREAS, the Board of Aldermen of the City of Odessa, Missouri (the "City"), reviewed the ordinances of its officers; and WHEREAS, the Board desires the ordinances outline the duties of the office of city clerk to be reflective of the day to day functions and operations; and WHEREAS, the Board of Aldermen of the City of Odessa wish to modify the provisions of Sections 2-221 of the City Code as it relates to the office of the City Clerk. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF ODESSA, MISSOURI, AS FOLLOWS: SECTION 1: That Division 4 City Clerk, Section 2-221 Duties of the City Clerk is hereby amended as follows: (1) Among other things, the City Clerk shall keep a journal of the proceedings of the Board of Aldermen. He/she shall safely and properly keep all the records and papers belonging to the City, which may be entrusted to his/her care; he/she shall be the official custodian of records; he/she is hereby empowered to administer official oaths and oaths to persons certifying to demands or claims against the City. (2) Acting as keeper of the city seal; executing and sealing documents. The city clerk is the keeper of the corporate seal of the city. (3) The city clerk shall procure stationery, books, and other necessary articles for the board of aldermen and necessary in the city government. (4) Keeping record of official bonds. The city clerk shall record all city ordinances and official bonds of all city officers and bonds of persons having obtained licenses where bonds are required to be given and generally perform all duties required by ordinance or the order of the board of aldermen. SECTION 3: This Ordinance shall be in full force and effect from and after its passage and approval. SECTION 4: The provisions of this Ordinance are severable and if any provision hereof is declared invalid, unconstitutional or unenforceable, such determination shall not affect the validity of the remainder of this Ordinance. SECTION 5: The City Clerk is hereby authorized to correct any scriveners' errors made in amending the City Code. ACTION: Discuss and pass ordinance amendment BACKGROUND: On June 1, 2018 Missouri Governor Eric Greitens signed Senate Bill 793 to raise the juvenile offender age to include children age 17 and under. On June 30, 2021 Governor Mike Parson signed the funding bill to fully implement the "Raise the Age" statute effective immediately. At this time the juvenile age has been officially raised to include children age 17 and under. Reference § 211.438 RSMo. Two City ordinances involving juvenile offenders should be updated to reflect Missouri statute. • City Ordinance 32-422, Curfew for Minors • City Ordinance 32-425, Contributing to the Delinquency of Minors; Abandoning and Cruelty to Minors Traffic violations involving minors has not changed and can be prosecuted under current procedures. FINANCIAL CONSIDERATIONS: Municipal violations involving minors (age 17 and under) will now be transferred to the juvenile court of jurisdiction.
