Motion was made by Alderwoman Ehlert, seconded by Alderman Barner, to amend the agenda. Motion carried 5-0. APPROVAL OF CONSENT AGENDA Approval of minutes • November 14, 2022 – Regular Session Motion was made by Alderman Stevens, seconded by Alderwoman Ehlert, to approve the November 14, 2022 regular meeting minutes, and the Finance report. MAYOR’S REPORT Mayor Wright thanked everyone that came out to participate in the Saturday, November 19th Odessa Outreach Turkey Bingo event. It was a great turn out! Mayor Wright went on to reminded everyone of the Downtown Lighting Ceremony that will take place on Monday, November 21st at 6:30 p.m. ALDERMEN REPORTS • Alderman Barner thanked those residents that attended the meeting this evening, and thanked everyone that came out to vote on November 8th. PUBLIC COMMENTS Ron Finn, Resident 614 S First Street, Odessa, MO 64076 Mr. Finn stated that he conducted a poll on Facebook and 140 +\- people stated that they were in favor of keeping the Odessa Reservoir. Someone in the audience stood and stated she agreed with Mr. Finn on keeping the reservoir. Ernie Cockrum, Resident 956 Owl Creek Parkway Odessa, MO 64076 Mr. Cockrum stated that the reservoir is underused, and he would like to see the city look for ways to utilize it and pay for the cost of the spillway repairs. Natalie Powell, Resident Gillen Road, Odessa, MO 64076 Ms. Powell stated that when she moved back to Odessa, she was surprised that the lake was not being utilized how it had been in the past. OLD BUSINESS Mayor Wright requested a motion for the employee contract for Shawna Davis, as Interim City Administrator/Finance Director. The contract states that Ms. Davis will be paid what a City Administrator is paid off the City of Odessa 2022/2023 Pay Schedule. Motion was made by Alderman Stevens, seconded by Alderwoman Ehlert, to approve the contract for Shawna Davis, Interim City Administrator/Finance Director. Motion carried 5-0. NEW BUSINESS Resolution No. 2022-29 – Blue Valley Public Safety, Inc. Mayor Wright proposed a Resolution authorizing execution of a maintenance agreement with Blue Valley Public Safety, Inc. to service and repair five (5) existing storm sirens. Discussion: Josh Thompson, Police Chief, stated that the language in the agreement is all the same, except the cost just went up $4050.00. Motion was made by Alderwoman Ehlert, seconded by Alderman Stevens, to approve Resolution No. 2022-29. Motion carried 5-0. Bill No. 2022-23 (1 reading) – Access to Utility Billing Records st Mayor Wright read the proposed Ordinance restricting access to utility billing records per RSMo. Section 610.021. Motion was made by Alderman Stevens, to approve Bill No. 2022-23 first reading, seconded by Alderwoman Ehlert. Motion carried 5-0. Discussion: Alderwoman Ehlert stated that she spoke to Shawna Davis to confirm that owners/landlords still have the right to review utility bills from their tenants. Ms. Davis stated that Lauber Law did in fact review the state statue, and the ordinance that was presented meets the statue requirements. If a new tenant request the history of a location the city would provide them an average cost for the location, not detailed cost. Bill No. 2022-23 (2 reading) – Access to Utility Billing Records nd Mayor Wright read the proposed Ordinance restricting access to utility billing records per RSMo. Section 610.021. Motion was made by Alderman Barner, to approve second reading of Bill No. 2022-23, seconded by Alderman Cramer. Roll call vote as follows: Alderman Cramer yes Alderwoman Ehlert yes Alderman Lockhart yes Alderman Stevens yes Alderwoman Starr absent Alderman Barner yes Motion carried 5-0. Bill No. 2022-23 became Ordinance No. 3081 Discussion: City Reservoir Shawna Davis, Interim City Administrator, stated that she spoke with Joey McLiney on what the next steps would be for the city reservoir. Mr. McLiney provided data on the impact it would be on a $2 Million dollar GO Bond. An average home owner with a $250,000 home, with their assed value being $47,500 the annual increase would be $117.00 which would be less than a $10.00 impact. It averages out to be a $0.33 per day cost to the home owner. Staff is seeking the Boards approval/recommendation to move forward for communication and education with the public to create the ballot language to put on the April 4th election ballot. The cutoff date is January 24, 2023. The GO Bond design engineering would not move forward until the GO Bond is issued first. Then it would be paid with the GO Bond. Alderman Stevens stated that he would like to get the bond on the ballot. He stated that he would like the city to add some type of maintenance cost to the budget so that the reservoir is maintenance well. Alderwoman Ehlert agreed. Alderwoman Ehlert stated that she wants to make sure there is plenty of education and communication sent out to the public. She went on to say that the Odessa High School Art class is suggesting landscape/site plan designs for what they would like to see at the reservoir. Alderman Barner thanked everyone that attended the meeting. Alderman Cramer stated that he has never seen any municipality say that they have too much park area. He wants the reservoir used as a public use area. He stated that all of this will cost lots of money. He would also like to see the reservoir be reclassified. Alderman Lockhart questioned the engineering design. Mayor Wright stated that the prior engineering designs were just band aid fixes. The next engineering design will consist of tearing out the spillway and creating a foul proof design for the entire spillway. Motion was made by Alderman Barner, to go ahead with the ballot language and GO Bond, seconded by Alderwoman Ehlert. BACKGROUND: The Missouri State Legislature has made changes to the filing deadlines for the General Municipal Elections held in April each year. The first day for candidate filing is now the 17th Tuesday before the Election and the last day for candidate filing is now the 14th Tuesday before the Election. The general municipal election shall be held on the first (1st) Tuesday after the first (1st) Monday in April, or such day as may be mandated by State Law. According to the 2023 Missouri Election Calendar, provided by the Missouri Secretary of State’s office, filing of the April 4, 2023 election will open on Tuesday, December 6, 2022 at 8:00 A.M. and filing closed at 5:00 P.M. on Tuesday, December 27, 2022. Any candidates wishing to file outside the noted times can do so by appointment with the City Clerk. The office of the City Clerk will not be open on Saturdays and Sundays, nor those days designated a holiday by the City of Odessa. Section 4. That the City Clerk shall provide the County Clerk of Lafayette County, Missouri, an election order including legal notice of said election within the City of Odessa in accordance with the Missouri Revised Statutes.  Section 5. In accordance with the laws of the State of Missouri, the election authority shall certify the results of said election to the Board of Aldermen of the City of Odessa, who, in turn, shall certify said results as provided for by law with said certification taking place at the first meeting of the Board of Aldermen, regular or special, after the aforesaid election providing said certification is available. Section 6. That the provisions of this Ordinance are declared to be severable, and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of remaining sections, sentences, clauses, and phrases to this Ordinance, but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part thereof. Section 7. This Ordinance shall be in full force and effect from and after the date of its passage and approval. ACTION: Motion/Second to approve an Ordinance Amending Chaper 46 - Traffic and Vehicles, Article IV - Driving Rules, Division 4 - Speed Limits, of the Code of Ordinances. BACKGROUND: With the roadway resurfacing in Dyer Park the Odessa Park staff assessed the speed limits within Dyer Park. I was contacted regarding the current speed limit and I learned that the speed limit in Dyer Park was not in our speed limit schedule. For any speed limit to be enforced the speeding ordinance should include Dyer Park in the schedule. The recommended speed limit inside City parks is 15 mph and enforced through the municipal traffic code. The following matrix will assist with understanding where the proposed speed zones will be enforced. On From-Direction To Max mph Dyer Park speed zone (Park West Main North Fourth Street 15 mph Drive and North Park Drive) FINANCIAL CONSIDERATIONS: Fines involving violations of speeding ordinances are scheduled with Missouri’s uniform traffic code.
