Motion carried 5-0 MAYOR’S REPORT Mayor Wright congratulated Alderman Bryan Barner for receiving his MGI & Advanced MGI certification from the Missouri Municipal League, “MML”. Mayor Wright read a proclamation calling out September 17 – 23, 2023 as Constitution Week. Mayor Wright went on to thank Alderman Barner, Mayor Pro-Tem, Shawna, and Chief Thompson for attending the private signing of the Public Safety Bill at Governor Parson’s office. ALDERMEN REPORTS ● Alderman Barner expressed his gratitude to the staff for their assistance in obtaining his MGI certification. ● Alderman Carey and the Centennial Hills HOA president have expressed their concerns about the speed limit on OO Hwy. They reached out to Chief Thompson, who informed them that some streets in Odessa are not under the City's control. OO Hwy. is owned and maintained by MoDOT, and MoDOT has been approached multiple times regarding the 45 mph speed limit on OO. Alderman Carey hopes that MoDOT will conduct a study by the end of the year to address traffic concerns. Chief Thompson also mentioned that a speed radar will be installed on the road in the near future. ● Alderwoman Ehlert – No Report ● Alderwoman Polson – No Report ● Alderwoman Starr extended her congratulations to Alderman Barner. ● Alderman Cramer – Absent PUBLIC HEARING None PUBLIC COMMENTS None OLD BUSINESS None NEW BUSINESS Special Event Permit “Odessa Marching Band Invitational” Christina Dawson, OHS Band, Odessa School District, is requesting permission to close the street from Second Street and Main to College Street for the annual Odessa Marching Band Invitational, scheduled for Saturday, October 14, 2023, from 8:00 a.m. – 11:00 a.m. Alderwoman Ehlert inquired about the businesses being contacted. Ms. Dawson confirmed that flyers will be distributed to all downtown businesses. Mr. Twombly, Band Director will contact Advanced Industries. Motion to approve the Special Event Permit for the “Odessa Marching Band Invitational” by Alderman Barner, seconded by Alderwoman Ehlert. Motion carried 5-0. Special Event Permit “Odessa Chamber Trick-or-Treat” Kelsey Legate, Odessa Chamber of Commerce President, is requesting street closure at the Intersection of Mason and 2nd Street (4-Way) for the annual Trick-or-Treat event. The event will take place Saturday, October 28, 2023, from 4:00 p.m. to 7:30 p.m. Motion to approve the Special Event Permit for the “Odessa Chamber Trick-or-Treat” by Alderwoman Ehlert, seconded by Alderwoman Starr. Motion carried 5-0. Resolution 2023-30 - “Tyler Technologies, Inc. Agreement for Professional Services” Mayor Wright read the proposed Resolution authorizing the Mayor to enter into an agreement between the City of Odessa and Tyler Technologies, Inc. for municipal software support. Alder members questioned the software and its reliability. Mallory Chiesa-Cullum, Finance Director, stated that Tyler Technologies has always been very reliable for the City of Odessa. Shawna Davis, City Administrator stated that the original contract was approved in 2017, and implemented in 2018. The package that Tyler provides Jackson County is not the same package that they provide to the City of Odessa. It wasn’t so much the software, it's more of a process issue with Jackson County. The time and dollars that it would take to move to another software is not currently feasible. Motion was made by Alderman Barner, to approve Resolution 2023-30 authorizing the Mayor to enter into an agreement between the City of Odessa and Tyler Technologies, Inc. for municipal software support, seconded by Alderwoman Ehlert. Motion carried 5-0. Resolution 2023-31 - “Brightspeed Pole Attachment Amendment” Mayor Wright read the proposed Resolution authorizing the Mayor to enter into an amended agreement between the City of Odessa and Brightspeed of West Missouri, LLC for the exchange of Pole and GIS data. Troy Woutzke, Electric Superintendent stated that this would benefit the electric department in the case of a natural disaster, the software will show where poles were placed. Motion was made by Alderwoman Ehlert, to approve Resolution 2023-31 authorizing the Mayor to enter into an amended agreement between the City of Odessa and Brightspeed of West Missouri, LLC for the exchange of Pole and GIS data, seconded by Alderman Barner. Motion carried 5-0. Discussion – “Garden Meters” The City will look at cost-sharing options for rain barrels. Discussion – “Waterfowl Hunting” Based on the write-up that was a part of the agenda, there was a Motion made by Alderwoman Starr, to discontinue waterfowl hunting at the City Reservoir, seconded by Alderman Carey. ACTION REQUESTED: 1st & 2nd Reading of Bill No. 2023-21 Amending Chapter 34, Article II. – Boating, Fishing and Hunting, Sec. 34-33. – Hunting Restrictions and Sec. 34-34. – Fishing and Hunting seasons and times of the Code of Ordinance of the City of Odessa. BACKGROUND: Each year City staff conduct a duck blind lottery which allows for 10 duck blind permits to be issued. Hunting is permitted from 30 minutes prior to sunrise to 1 PM each day for approximately a 4-month period during hunting season and then open to the public from 1 PM to 11 PM. A great deal of staff time is required. Staff overtime is necessary to hold the lottery and administer the permits, deposits, and keys. The water department is typically responsible for making new keys and locks each year. The purpose of the keys is so hunters are able to access the reservoir during the allotted hours. Then during the season, it weighs a heavy burden for staff to ensure the reservoir is properly locked and unlocked during hunting times to ensure the safety of non-hunters. Staff go out to the reservoir to ensure the gate is unlocked for public use at 1 PM and locked at 11 PM. There are some changes happening at the reservoir. A building maintenance employee will be present daily to take care of mowing, cleaning, and maintenance tasks for the reservoir. Additionally, the Odessa Rotary Club is planning to construct a wilderness trail around the reservoirs with the help of volunteers from the community. The trail construction will take place in late fall and early spring. The Board of Aldermen convened on Monday, September 18, 2023 to deliberate on the future of waterfowl season. They debated between continuing with it or completely abolishing it. Eventually, a motion was proposed and seconded to discontinue waterfowl hunting in the City Reservoir. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF ODESSA, MISSOURI AS FOLLOWS: Section 1. Chapter 34, Article II. - Boating, Fishing and Hunting, Sec. 34-33. – Hunting Restrictions and Sec. 34-34. – Fishing and Hunting Seasons and Times of the Code of Ordinances of the City of Odessa is hereby repealed and the following is hereby adopted. Sec. 34-33. – Hunting restrictions. A. It shall be unlawful for any person to hunt waterfowl on the City Lake property. except as hereinafter provided. No person shall hunt waterfowl on said premises except from duck blinds, and no duck blind shall be erected except at locations designated by the Public Works Director. The blind permit fee shall be fifty dollars for each blind per season. The blind permit fee of fifty dollars shall be refunded to a member of the group if the blind is removed from the Lake property within fifteen days after closing of the waterfowl season. The City shall destroy all blinds not removed within said fifteen days. More than one person shall join together to obtain a blind, but not to exceed ten persons. All persons hunting waterfowl on the Lake property shall register with the City Clerk and shall pay a fee of $7.50 per person. After the blind selection, a person may join a group by paying the fee of $7.50, and having the permission of the group in which blind he/she wishes to hunt. B. The city reserves the right to close said City Water Reservoir and Lake to hunting at any time that the Board of Aldermen at its discretion shall deem that the same be done, irrespective of the issuance of any permits hereafter, this reservation of right being a part of the granting of said permit. C. It is understood that any person applying for and receiving a permit under the terms and provisions hereof shall accept the premises of said City where they shall hunt to be in the condition that they exist at the time of and use thereof, including but not limited to the period of time when any blind may be constructed or removed, and the recipient and holder of said permit agrees to save said City harmless with reference to the use of any permit rendered hereunder and its use by the recipient hereof or any person or any other person using the same. Sec. 34-34. – Fishing and hunting seasons and times. A. The fishing season at the Odessa City Lakes shall be year-round from 6:00 a.m. until 11:00 p.m. each day. except during waterfowl season as set each year by the Missouri Department of Conservation. During said waterfowl season, times for fishing shall be 1:00 p.m. until 11:00 p.m. each day. B. Hunting during waterfowl season shall be from 30 minutes prior to sunrise until 1:00 p.m. each day as regulated by the Missouri Department of Conservation [MO 3CSR 10-12.125 1(H)] Effective Date. This ordinance shall be in full force and effect from and after the date of its passage and approval and shall remain in effect until amended or repealed by the Board of Aldermen. Wright, Mayor  BOARD OF ALDERMEN ACTION REPORT ISSUE: 2023 Street Plan Summary ACTION REQUESTED: Motion/Second to approve the recommended street improvements. BACKGROUND: City staff has completed the street plan for the year 2023. The following blocks have been finished:  200 blocks of South Wells St.  South Conner St.  700 and 800 blocks of South Russell  East Crestview  100 and 200 blocks of East College  600 and 700 blocks of West Mason St.  300 block of South 9th St.  All 2023 chip seal streets Additionally, staff has skim-coated the 500 block of South Russell and part of North 1st St. However, we still have $58,981.00 remaining to address other roads in town. Staff’s recommendation is to mill an inch off and skim coating curb-to-curb on West Main from 4th Street to 8th Street, which would cost approximately $35,680. Although this is not a permanent solution to West Main, it will smooth the road and provide a few years before we can find the funds to resurface the road. With the remaining funds staff recommend to overlay the 400 block of 4th St. for approximately $15,000 and the 100 block of North Russell St. for approximately $8,000, if the weather remains favorable in the next few months.
