CITY COUNCIL MINUTES CITY OF ODESSA, TEXAS September 22, 2020 On September 22, 2020, a regular meeting of the Odessa City Council was held at 6:00 p.m., at Odessa Regional Medical Center, East Campus Auditorium, 515 N. Adams, Odessa, Texas. City Council present: Mayor David R. Turner; Council members: Michael Shelton, District One; Dewey Bryant, District Two; Detra White, District Three; Tom Sprawls, District Four; Mari Willis, District Five; and Peggy Dean, At-Large. Others present: Michael Marrero, City Manager; Norma Aguilar-Grimaldo, City Secretary; Natasha Brooks, City Attorney; Phillip Urrutia, Assistant City Manager; Cindy Muncy, Assistant City Manager; and other members of City staff. A quorum being present, Mayor Turner called the meeting to order and the following proceedings were held: The invocation was given by Mayor Turner and followed by the Pledge of Allegiance and Texas flags. CONSENT AGENDA ITEMS A. City Council minutes, September 8, 2020; B. City Council work session minutes, September 15, 2020; C. Ordinance No. 2020-32 – Request by Jonathan Ramirez and Roberto Arenivas, owners, for a specific use permit to allow a beauty shop-one chair accessory use in a Single Family-Three (SF-3) zoning district on Lot 5, Block 11, Ridgecrest West (208 Monticello Dr.); D. Ordinance No. 2020-33 – Appoint judges and clerks for the General City Election on November 3, 2020; E. Ordinance No. 2020-34 - Amend the Odessa City Code Chapter 13 "Utilities", Article 13-2 "Water and Sewer Service", Division 3 "Water Conservation and Drought Contingency Plan"; F. Consider the creation of an Odessa Public Facility Corporation; G. Authorize Discover Odessa to roll over unused 2019-20 funds to be expended in FY 2020-21; H. Purchase a command trailer for the Police Department for $289,036.77. Motion was made by Council member Bryant and seconded by Council member Sprawls to remove item F. from the consent agenda items. The motion was approved by the following vote: Aye: Turner, Shelton, Bryant, White, Sprawls, Willis, and Dean Nay: None Motion was made by Council member White and seconded by Council member Willis to approve consent agenda items A – E and G - H. The motion was approved by the following vote: Council Minutes September 22, 2020 Page 2 Aye: Turner, Shelton, Bryant, White, Sprawls, Willis, and Dean Nay: None Tabled - Create Odessa Public Facility Corporation (PFC). Larry Robinson, 2219 E. 8th St, requested that the PFC be withdrawn. The corporation has loopholes and it was no benefit for lower housing units. The environment automatically provided affordable housing units without giving up the tax base. He stated that the public was not getting a return on investment in other communities. He stated that the taxpayers had to take the no new revenue rate during a time of suffering. He was opposed of Council issuing nonvoter approval debt obligation. Javier Joven, 3006 Byron, stated that there were several studies with good data on the PFC. He asked if all the information was known such as enforcement and the ratio of property value with the abatement. He requested it be tabled and have a better understanding of the program before it would be an overburden of tax. Motion was made by Council member Bryant and seconded by Council member Shelton to table the Odessa Public Facility Corporation resolution. The motion was approved by the following vote: Aye: Turner, Shelton, Bryant, White, Sprawls, Willis, and Dean Nay: None OTHER COUNCIL ACTION Bid to Vanco Insulation, In. for the emergency removal of two unsafe commercial structures. Merita Sandoval, Director of Community Development, stated that the contract was with Vanco Insulation for the removal of two commercial unsafe structures for $133,495. The bid was under budget. Motion was made by Council member Dean and seconded by Council member White to approve the bid as recommended. The motion was approved by the following vote: Aye: Turner, Shelton, Bryant, White, Sprawls, Willis, and Dean Nay: None PUBLIC HEARING Open a public hearing to consider approval of the request by Halliburton Energy Services, owner, Multatech, agent, for original zoning of Heavy Industrial (HI) on Lots 1 and 2, Block 1, Halliburton Subdivision, 2nd Filing, Odessa, Ector County, Texas (south of the intersection of Interstate 20 and FM 1936). Randy Brinlee, Director of Development Services, reviewed the location. The zoning was for heavy industrial for future development of high intensity use. The area accommodated the established area use. The Planning and Zoning Commission recommended for approval. No one came forward and the public hearing was closed. Motion was made by Council member Dean and seconded by Council member Shelton to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Turner, Shelton, Bryant, White, Sprawls, Willis, and Dean Nay: None Council Minutes September 22, 2020 Page 3 RESOLUTION Resolution No. 2020R-66 – Odessa Development Corporation (ODC) Economic Development agreement with Gasket and Packings. Wesley Burnett, Director of Economic Development, stated that the agreement was for a small local business expansion. The company would retain five jobs and create five jobs for a grant of $125,000. The company would increase $3 million in sales. Council member Dean was pleased with assisting local businesses. ODC had a focus to expand local businesses and provide incentives with the focus on jobs. Motion was made by Council member Sprawls and seconded by Council member Willis to approve the resolution. The motion was approved by the following vote: Aye: Turner, Shelton, Bryant, White, Sprawls, Willis, and Dean Nay: None Resolution No. 2020R-67 – Review and approve the City’s Investment Policy and the approved brokers/dealers and financial institutions list. Mrs. Muncy stated that the policy did not have any changes and there were no state changes. The brokers/dealers list had no changes only contact information updated. Motion was made by Council member Bryant and seconded by Council member Shelton to approve the resolution. The motion was approved by the following vote: Aye: Turner, Shelton, Bryant, White, Willis, and Dean Nay: Sprawls MISCELLANEOUS Appointment of Boards: Board of Survey, Citizens Golf Advisory Committee, Odessa Housing Finance Corporation, Traffic Advisory Committee, Zoning Board of Adjustment, Midland Odessa Urban Transit District and Public Art Committee. Motion was made by Council member Willis and seconded by Council member Bryant to reappoint Richard Gillham, Chris Stanley, and Yervand Hmayakyan to the Odessa Public Art Committee for one year. The motion was approved by the following vote: Aye: Turner, Shelton, Bryant, White, Sprawls, Willis, and Dean Nay: None Citizen’s comments on non-agenda items. No comments. As authorized by the Texas Government Code, Section 551.074 (Personnel Matters), the City Council may adjourn into executive session to consider personnel matters - deliberate the employment, evaluation, duties, discipline, complaint, or dismissal of a public officer or employee.
