CITY COUNCIL WORK SESSION MINUTES CITY OF ODESSA, TEXAS May 3, 2022 On May 3, 2022, a work session meeting of the Odessa City Council was held at 3:00 p.m., Council Chamber, fifth floor, City Hall, 411 W. 8th St., Odessa, Texas. City Council present: Mayor Javier Joven; Council members: Mark Matta, District One; Steven P. Thompson, District Two; Tom Sprawls, District Four; and Denise Swanner, At- Large. City Council absent: Council members Detra White, District Three and Mari Willis, District Five. Others present: Michael Marrero, City Manager; Norma Aguilar-Grimaldo, City Secretary; Natasha Brooks, City Attorney; Cindy Muncy, Assistant City Manager; Phillip Urrutia, Assistant City Manager; and other members of City staff. A quorum being present, Mayor Joven called the meeting to order, and the following proceedings were held: Council member Matta gave the invocation. Resolution 2022R-24 – Adopt criteria for use in 2022 redistricting process. Ms. Brooks stated the redistricting criteria would serve as a framework in the formulation of the districting plans. She reviewed each criteria for the City’s single-member districts. The Council would review the plans with consideration on the criteria and may decline any plan that was not a complete plan. Motion was made by Council member Swanner and seconded by Council member Matta to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Sprawls, and Swanner Nay: None Resolution 2022R-25 – Adopt guidelines for persons submitting specific redistricting proposals and providing comments. Ms. Brooks stated that the guidelines relate to persons who have specific redistricting plans for Council consideration. Any person may submit a comment or a redistricting plan. She reviewed each of the guidelines. The next public hearing for comments and proposed plans will be May 9, 2022 at 1 p.m. Motion was made by Council member Thompson and seconded by Council member Sprawls to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Sprawls, and Swanner Nay: None Open a public hearing to discuss potential redistricting options for drawing new single-member district boundaries considering 2020 census data. Mayor Joven called the public hearing to order at 3:08 p.m. He stated that the purpose of the public hearing was to receive comments from the public concerning the proposed plans for new council member Council Work Session Minutes May 3, 2022 Page 2 districts. He asked if anyone wanted to give comments. No one came forward and the public hearing was closed at 3:09 p.m. Ms. Brooks reviewed the redistricting legal principles. She reported that the ideal population size for each district was 22,897. The overall deviation was 40.72% which was larger than the permitted 10%; therefore, redistricting was needed to be within the 10% range. The draft of Plan A was viewed which had an overall deviation of 6.33%. A draft of Plan B was viewed. With Plan D, District 2 had the lease number of people and District 3 had the greatest number of people. The overall deviation was 6.10%. The Council would hold another public hearing on May 9, 2022 at 1 p.m. Faudree Road Improvements Project update. Hal Feldman, Traffic Engineer, reported on the Faudree Road Improvement project which would be widen to a five-lane roadway. The project was on the website and reviewed each of the six projects. He reported that it would have a drainage channel on the west side with lighting on the East and a sidewalk path. P Bar Ranch and Yukon warranted for a traffic signal which would be funded out of the street maintenance. The franchise utility relocations were reviewed and work was being done. He reviewed the bid schedule for Faudree with a completion date of September 2024. Council member Thompson was concerned of the Shiloh and Parks Bell traffic issues. Purchase 15 outfitted Police package vehicles and equipment. Matt Davidson, Deputy Police Chief, stated that the purchase was for 15 patrol vehicles. The logo on the vehicles would be a new logo with the OPD patch and shield. The total cost was $1.189 million and the funds would be used from the Equipment Service Fund. Amendments to Chapter 10 “Development Regulations”, Article 10-4 “Impact Fees”. Tom Kerr, Director of Public Works/Utilities, stated that the amendment was to clarify that the grace period extended to valid building permit or water meter applications that have been properly submitted within one year of the effective date. Additional housekeeping changes were included in this ordinance. Executive Session – As authorized by the Texas Government Code, Section 551.101, the City Council will hold an executive session, which is closed to the public, to discuss the following matters permitted under the following sections of the Texas Government Code: Section 551.071, Consultation with the City Attorney and attorney(s) employed by the City of Odessa (1) Discuss matters in which the duty of the attorney(s) to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Texas Government Code. (2) Discuss contemplated litigation involving Chapter 387 of the Texas Local Government Code (3) Discuss pending litigation with the City Attorney and attorneys hired by the City, Cause No. 11-22-00052-CV, AIM Media, Texas LLC d/b/a The Odessa American vs. City of Odessa, Texas, in the 11th Court of Appeals for the State of Texas. Motion was made by Council member Matta and seconded by Council member Sprawls to go into executive session under 551.071. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Sprawls, and Swanner Nay: None Motion was made by Council member Matta and seconded by Council member Thompson to return from executive session.
