CITY COUNCIL MINUTES CITY OF ODESSA, TEXAS May 10, 2022 On May10, 2022, a regular meeting of the Odessa City Council was held at 6:00 p.m. in the Council Chambers, 5th floor, City Hall, 411 W. 8th, Odessa, Texas. City Council present: Mayor Javier Joven; Council members: Mark Matta, District One; Steven P. Thompson, District Two; Detra White, District Three; Tom Sprawls, District Four; and Denise Swanner, At-Large. City Council absent: Council member Mari Willis, District Five. Others present: Michael Marrero, City Manager; Norma Aguilar-Grimaldo, City Secretary; Natasha Brooks, City Attorney; Cindy Muncy, Assistant City Manager; Phillip Urrutia, Assistant City Manager; and other members of City staff. A quorum being present, Mayor Joven called the meeting to order, and the following proceedings were held: The invocation was given by Pastor Marcos Zuniga, Kingdom Church, and followed by the Pledge of Allegiance and Texas flags. Citizen’s comments on non-agenda items. Kim Page recently moved to Odessa and wanted to help with the schools and elderly in giving community service. She was looking for volunteers for summer programs and for crossing guards. CONSENT AGENDA ITEMS A. City Council minutes, April 26, 2022; B. City Council special meeting minutes, April 28, 2022; C. City Council work session minutes, May 3, 2022. Motion was made by Council member Matta and seconded by Council member Sprawls to approve the consent agenda items. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, White, Sprawls, and Swanner Nay: None OTHER COUNCIL ACTION Purchase 15 outfitted police package vehicles and equipment. Matt Davidson, Deputy Police Chief, stated that the purchase was for 15 police units. The vehicles would be fully outfitted. He reviewed the cost of the vehicles with a total cost of $1.89 million. Motion was made by Council member Thompson and seconded by Council member White to approve the purchase of 15 outfitted police package vehicles and equipment. The motion was approved by the following vote: Council Minutes May 10, 2022 Page 2 Aye: Joven, Matta, Thompson, White, Sprawls, and Swanner Nay: None PUBLIC HEARING Open a public hearing to consider the request by Midland 256 Rampart LP ETAL, owners, and LCA, agent to amend the uses on Planned Development-Retail (PD-R), Lot 6, Block 27, North Country Club Estates, 5th Filing, City of Odessa, Ector County, Texas (6000 block of East Ridge Rd.). Randy Brinlee, Director of Development Services, reviewed the location. The amendment would amend the conditions to allow a food and beverage sales and the current conditions would remain intact. The Planning and Zoning recommended for approval. No one came forward and the public hearing was closed. Motion was made by Council member Sprawls and seconded by Council member White to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, White, Sprawls, and Swanner Nay: None ORDINANCE Ordinance No. 2020-09 - Amend the Odessa City Code Chapter 4 “Business Regulations”, Article 4-17 “Video Gaming”. Ms. Brooks reviewed the changes made to the ordinance which included the hours of operation, grandfather clause for existing facilities, site plan requirement, maximum 50 video gaming devices in operation on premises, increase distance requirement to 1,500 feet within another video gaming, limited to Light Industrial or Heavy Industrial districts; no use of electronic lock systems, no window or door coverings, no restriction of entry and no check-in procedures. Council member Sprawls was concerned if it was permissible on the distance and supported the interlocal and all other changes. Ian Kapets, Police Sergeant, explained the check-in process as it was based on a hand scanner that would track frequent members. Council member Matta stated it would not take away from the ability to ID. Council member Thompson agreed with concerns on the distancing. He stated that the ordinance could be dissolved if the interlocal was made. Council member White was concerned with the 1,500 foot distancing but agreed with all the other changes. Motion was made by Mayor Joven and seconded by Council member Matta to approve the ordinance on second and final approval which would adopt all amendments as presented. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, White, and Swanner Nay: Sprawls Amend Chapter 10 “Development Regulations”, Article 10-4 “Impact Fees” of the City Code. Tom Kerr, Director of Public Works/Utilities, stated that the amendment was to clarify the grace period that extended to valid building permit or water meter applications that were submitted within one year of the effective date. Housekeeping items were also included. Motion was made by Council member Thompson and seconded by Council member Sprawls to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, White, Sprawls, and Swanner Nay: None Council Minutes May 10, 2022 Page 3 MISCELLANEOUS Appointment of Boards. Motion was made by Council member Sprawls and seconded by Council member Thompson to reappoint Fred “Mickey” Jones and Daniel Hollmann. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, White, Sprawls, and Swanner Nay: None Motion was made by Council member Sprawls and seconded by Council member Matta to appoint Anthony Bolton and reappoint Rita Barrientes to the Housing Authority of Odessa. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, White, Sprawls, and Swanner Nay: None Motion was made by Council member Sprawls and seconded by Council member Matta to adjourn the meeting.
