CITY COUNCIL MINUTES CITY OF ODESSA, TEXAS May 24, 2022 On May 24, 2022, a regular meeting of the Odessa City Council was held at 6:00 p.m. in the Council Chambers, 5th floor, City Hall, 411 W. 8th, Odessa, Texas. City Council present: Mayor Javier Joven; Council members: Mark Matta, District One; Steven P. Thompson, District Two; Detra White, District Three; Tom Sprawls, District Four; Mari Willis, District Five; and Denise Swanner, At-Large. Others present: Michael Marrero, City Manager; Norma Aguilar-Grimaldo, City Secretary; Natasha Brooks, City Attorney; Cindy Muncy, Assistant City Manager; Phillip Urrutia, Assistant City Manager; and other members of City staff. A quorum being present, Mayor Joven called the meeting to order, and the following proceedings were held: The invocation was given by Pastor Jeremiah Ramer, Crossroads Church, and followed by the Pledge of Allegiance and Texas flags. Mayor Joven recognized the Texas Scholar students. He presented proclamations for National EMS Week and State Farm Day. Citizen’s comments on non-agenda items. Susan Clark provided an Animal Shelter Advisory Committee update. She reported that the committee recommended to hire a veterinarian for the new shelter. She stated that spay and neuter could be offered. She stated that a voucher was not transferrable and many would be unable to use as it would be costly even with a voucher. New programs could be implemented. Tommy Ervin stated that there was another drought. He asked the Council to view the CRMWD’s website to review the lake levels as they are close to the levels in 2008. In 2012 there were water restrictions. He asked Council to look at the wasted water as citations could be given. He stated that there should not be any water restrictions but to look at other water sources to keep from water restrictions. Karen Patterson heard from constituents regarding the consideration of vouchers and would like to know how to inform Council in the support of the program. Fix West Texas would have a vaccination clinic on June 11. She wanted to review the Animal Shelter Committee’s minutes. Ms. Patterson stated that, regarding Chief Gerke’s comments on a personality conflict, she did not know Ms. Hendricks. She challenged Chief Gerke to be accountable and transparent. CONSENT AGENDA ITEMS A. City Council minutes, May 9, 2022; B. City Council minutes, May 10, 2022; C. City Council work session minutes, May 17, 2022; D. Ordinance No. 2022-10 – Request by Midland 256 Rampart LP ETAL, owners, and LCA, agent to amend the uses on Planned Development–Retail (PD-R), Lot 6, Block 27, North Country Club Estates, 5th Filing, City of Odessa, Ector County, Texas (6000 Block of East Ridge Rd.); Council Minutes May 24, 2022 Page 2 E. Ordinance No. 2022-11 – Adopt the redistricting of the city’s single- member council districts based on 2020 census data and establishing the new boundaries for the five single-member council districts; F. Ordinance No. 2022-12 – Amend Chapter 10 “Development Regulations” Article 10-4 “Impact Fees” of the City Code; G. Resolution No. 2022R-26 – Apply and accept funds for the City of Odessa Police Department from the 2022 Motor Vehicle Crime Prevention Authority Auxiliary Grant for $24,000; H. Renew Motorola Premier One software; I. Renew contract for auctioneering services. Motion was made by Council member Swanner and seconded by Council member Willis to approve the consent agenda items. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, White, Sprawls, Willis, and Swanner Nay: None OTHER COUNCIL ACTION Bid award for the 2022 traffic signal improvements. Hal Feldman, Traffic Engineer, stated that a traffic signal would be installed at Faudree and P Bar Road. He recommended the bid award to Willis Electric for $139,000. The project would be completed by the middle of August. Motion was made by Council member White and seconded by Council member Thompson to approve the bid award to Willis Electric. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, White, Sprawls, Willis, and Swanner Nay: None ORDINANCE Ordinance No. 2022-13 - Amend the Odessa City Code Chapter 8, “Offenses and Nuisances”, Section 8-1-27(b), “Social Host Accountability” and Section 8-1-15, “Discharging or dumping liquids or waste on street, right-of-way or easement”. Monique Wimberly, Senior Assistant City Attorney, stated that the amendment to the social host ordinance would expand the definition to include party buses, limos and motor vehicles. The ordinance removed a citation to an exhibit that no longer existed. Motion was made by Council member Thompson and seconded by Council member Swanner to approve the ordinance on second and final approval. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, White, Sprawls, Willis, and Swanner Nay: None MISCELLANEOUS Appointment of Boards.
