CITY COUNCIL MINUTES CITY OF ODESSA, TEXAS September 26, 2023 On September 26, 2023, a regular meeting of the Odessa City Council was held at 6:00 p.m. in the Council Chambers, 5th floor, City Hall, 411 W. 8th, Odessa, Texas. City Council present: Mayor Javier Joven; Council members: Mark Matta, District One; Steven P. Thompson, District Two; Gilbert Vasquez, District Three; Greg Connell, District Four; Chris Hanie, District Five, and Denise Swanner, At-Large. Staff present: Norma Aguilar-Grimaldo, City Secretary; John Beckmeyer, City Manager; Dan Jones, City Attorney, and other members of City staff. A quorum being present, Mayor Joven called the meeting to order, and the following proceedings were held: The invocation was given by Pastor Rudy Espinosa and followed by the Pledge of Allegiance and Texas flags. Proclamations, Presentations and Awards. Mayor Joven presented a proclamation for World Teacher’s Day. Dangers and risks of methamphetamines in Odessa. Dr. Alejandra Garcia, practiced at Texas Tech and Medical Center Hospital, dealt with drugs with patients in the ICU. She reported that drugs were a concern and there was a rise and abuse in drugs. Fentanyl use was triplicated since 2015. Methamphetamines was used in our area. Psychostimulants were used in men and women in the 20s and 30s years of age. Cocaine and amphetamines were drastically used. She stated that the drug use needed to be addressed and wanted to be part of the solution. Council member Swanner stated that drugs and human trafficking were correlated, and awareness was needed. Mayor Joven stated that a campaign awareness could be done with the fentanyl funds that were awarded to the City. He stated that drugs were a reality in the community. He expressed appreciation and thanked Dr. Garica for serving the community. Citizen’s comments on non-agenda items. Ed Mendez, Oncor, invited the TML attendees to Oncor’s reception in Dallas next week. Mayor Joven recognized Boy Scout Troop 34 and Girls Scout Troop 6110. Renew software maintenance between the City of Odessa and Tyler Technologies, Inc. for the Tyler Munis Enterprise Resource Planning software license and application for $118,593.94, for the duration of August 3 - December 31, 2023; 10. Resolution No. 2023R-84 – Extend Meals on Wheels of Odessa time to expend CARES Act Community Development Block Grant- Coronavirus funds (CDBG-CV) to provide hot meals to the elderly and disabled homebound residents of Odessa; 11. Resolution No. 2023R-85 – RATP Dev. and EZ Rider five-year contract. Motion was made by Council member Swanner and seconded by Council member Matta to approve the consent agenda items. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Regular Resolution No. 2023R-86 – Donation from Texas J Regional Advisory Council and appropriate the funds to Odessa Fire Rescue. Daniel Chavez, Assistant Fire Chief, stated that the grant was for EMS training and equipment. Motion was made by Council member Matta and seconded by Council member Thompson to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Public Hearing Resolution No. 2023R-87 - Open a public hearing and consider the reallocation of $10,378 in program year 2019 Community Development Block Grant (CDBG) funds to fund a vacant lot mowing program. Merita Sandoval, Director of Community Development, stated that a vacant lot mowing program would be established to address citywide code violations. The reallocation amount for the program was $10,378. Motion was made by Council member Vasquez and seconded by Council member Connell to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Council Minutes September 26, 2023 Page 3 Resolution Resolution No. 2023R-88 – Remove from the table and consider approving an economic development agreement between the Odessa Development Corporation (ODC) and GCC Permian, LLC. Motion was made by Council member Hanie and seconded by Council member Swanner to remove the item from the table. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Kris Crow, ODC President, stated that GCC, a cement producer, would retain 104 jobs and add five new jobs within five years and provide a $400 million capital investment. The ODC grant was $2,118,588 over five years if it met compliance. Motion was made by Council member Hanie and seconded by Council member Swanner to approve the resolution. The motion was approved by the following vote: Aye: Joven, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Abstain: Matta Resolution No. 2023R-89 – Remove from the table and consider approving an economic development agreement between the Odessa Development Corporation (ODC) and Standard Industrial Manufacturing Partners, LLC. Motion was made by Council member Swanner and seconded by Council member Thompson to remove the item from the table. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Mr. Crow stated that Standard Industrial Manufacturing, manufacturer of cutting tools and machine tool accessories, would retain eight jobs and add 22 new jobs within five years and provide a $2,565,000 capital investment. The ODC grant was $900,551.82 over five years if it met compliance. Motion was made by Council member Hanie and seconded by Council member Matta to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Tabled - Economic development agreement between the Odessa Development Corporation (ODC) and Liberty Oilfield Services, LLC. Motion was made by Council member Vasquez and seconded by Council member Matta to table the item. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Council Minutes September 26, 2023 Page 4 Resolution No. 2023R-90 – Ector County Utility District (ECUD) wholesale water rate for 2023-2024 on a month-to-month basis until further notice. Kevin Niles, Director of Utilities, stated that in November 2020 a contract was approved with ECUD to supply water to resale to ECUD customers. A rate model was agreed for a third party to determine the yearly rate. Legal staff indicated that the contract was invalid. He recommended a month- to-month basis for the supply of water at the current rate of $3.83 per 1,000 gallons. Motion was made by Council member Connell and seconded by Council member Swanner to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Resolution No. 2023R-91 – Authorized representative and account administrator for reporting in connection with Coronavirus State and Local Fiscal Recovery Funds (SLFRF). Monica Munoz, Budget Manager, stated that the resolution would remove Agapito Bernal and Seth Boles and add John Beckmeyer and Monica Munoz as the City’s authorized representatives and account administrator for reporting the SLFRF funds. Motion was made by Council member Thompson and seconded by Council member Matta to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Tabled – City of Odessa will fund the pre-development agreement for the Amy Bell Sports Complex and must be named as the sole beneficiary of the Amy Bell Sports Foundation, Inc. and continue to exercise control over the bylaws. Mr. Jones asked that the item be tabled to research information with regard to the City as beneficiary and how it related to the Foundation. Motion was made by Council member Thompson and seconded by Council member Hanie to table the item. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Ordinance Permanent lowering of speed limits along FM 1882, County Road West. Yervand Hmayakyan, City Engineer, stated that TXDOT conducted a speed study and based on data it recommended that the speed limit be lowered on FM 1882, County Road West from 55 MPH to 50 MPH within the city limits. Motion was made by Council member Hanie and seconded by Council member Connell to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Council Minutes September 26, 2023 Page 5 Amend the Odessa City Code Chapter 2 “Animal Control” Kelley Hendricks, Animal Control Manager, stated that this would remove the Animal Services from the Police Department and be a stand-alone department. Susie Clark stated that the Committee recommended approval of the ordinance amendments. She raised a concern on how to enforce and mandate. She stated that this was a step up for the voiceless. She stated that the amendments would address issues. Motion was made by Council member Matta and seconded by Council member Thompson to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Miscellaneous Appointment of Boards: Midland Odessa Urban Transit District, Odessa Housing Finance Corporation, and Public Art Committee. Motion was made by Council member Vasquez and seconded by Council member Matta to appoint Matt Rist, Janice Thompson and Shanvonica Meyer to the Public Art Committee.
