CITY COUNCIL MINUTES CITY OF ODESSA, TEXAS October 10, 2023 On October 10, 2023, a regular meeting of the Odessa City Council was held at 6:00 p.m. in the Council Chambers, 5th floor, City Hall, 411 W. 8th, Odessa, Texas. City Council present: Mayor Javier Joven; Council members: Mark Matta, District One; Steven P. Thompson, District Two; Greg Connell, District Four; Chris Hanie, District Five, and Denise Swanner, At-Large. City Council absent: Council member Gilbert Vasquez, District Three. Staff present: Norma Aguilar-Grimaldo, City Secretary; John Beckmeyer, City Manager; Dan Jones, City Attorney, and other members of City staff. A quorum being present, Mayor Joven called the meeting to order, and the following proceedings were held: The invocation was given by Pastor Don Belk, Tanglewood Church of Christ, and followed by the Pledge of Allegiance and Texas flags. Proclamations, Presentations and Awards. Mayor Joven presented a proclamation for Fentanyl Awareness Month. He presented the American Heart Association Award to Odessa Fire Rescue for the Lifeline – EMS award. Citizen’s comments on non-agenda items. No comments. Consent Agenda 1. City Council minutes, September 22, 2023; 2. City Council work session minutes, September 26, 2023; 3. City Council minutes, September 26, 2023; 4. City Council minutes, September 28, 2023; 5. Ordinance No. 2023-26 – Amend Chapter 2 of the City of Odessa Code of Ordinances entitled “Animal Control”; 6. Ordinance No. 2023-27 – Permanent lowering of speed limits along FM 1882, County Road West; 7. Award to vendors for annual water and wastewater treatment chemicals for $700,000; 8. Award contract to Officewise and Amazon for the purchase of office supplies. Motion was made by Council member Hanie and seconded by Council member Matta to approve the consent agenda items. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Connell, Hanie, and Swanner Nay: None Council Minutes October 10, 2023 Page 2 Public Hearing Open a public hearing to consider Betenbough Homes, LLC, owner, for a zone change from (SPD), Special Dwelling District to (PD), Planned Development District for Housing Development including special housing types out of a 223.04-acre tract of land situated in Sections 27 and 28, Block 42, City of Odessa, Texas. (Generally located on the northeast corner of the intersection of Andrews Hwy and E 100th St). Maria Prieto, Planning Manager, stated that the zone change would clarify the zoning for a development of mix development. The subdivision would include 1,187 residential lots, green space and five pocket parks. She reviewed the site plan. The residential would be single family dwelling and cottages. Ronnie Wallace, Betenbough, stated that the cottages were affordable housing and reviewed two cottage plans. The cottage homes would range from $190,000 - $200,000. Chris Berry, Betenbough, stated that the playa would remain a natural area. Staff had no concerns and there was flexibility on the lots. Motion was made by Council member Swanner and seconded by Council member Connell to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Connell, Hanie, and Swanner Nay: None Resolution Resolution No. 2023R-92 – Remove from the table and consider approving an economic development agreement between the Odessa Development Corporation (ODC) and Liberty Oilfield Services, LLC. Motion was made by Council member Matta and seconded by Council member Thompson to remove the item from the table. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Connell, Hanie, and Swanner Nay: None Kris Crow, ODC President, stated that Liberty provided suites of completion services and technologies. Liberty would create and maintain 1,456 jobs during the agreement. There would be a capital investment of $34 million. The ODC grant was for $2.5 million over five years if compliance was met. Motion was made by Council member Matta and seconded by Council member Hanie to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Connell, Hanie, and Swanner Nay: None Resolution No. 2023R-93 – City Manager to review and select submitted competitive bids for life, disability and dismemberment insurance policies as authorized. Mr. Jones stated that the RFP was sent. The RFP would open on October 16. Mr. Jones stated that the resolution would authorize the City Manager to choose the best competitive bid. Motion was made by Council member Swanner and seconded by Council member Connell to approve the resolution. The motion was approved by the following vote: Council Minutes October 10, 2023 Page 3 Aye: Joven, Matta, Thompson, Connell, Hanie, and Swanner Nay: None Resolution No. 2023R-94 – Remove from the table and consider the City of Odessa will fund the pre-development agreement for the Amy Bell Sports Complex and must be named as the sole beneficiary of the Amy Bell Sports Foundation, Inc. and continue to exercise control over the bylaws. Motion was made by Council member Thompson and seconded by Council member Matta to remove the item from the table. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Connell, Hanie, and Swanner Nay: None Jeff Whitfield, Attorney, stated that the City would form the 501c(3) for the building and maintain the sports complex. The funding would be under the Foundation. He stated it would create a balance of power. The City would be the key figure of the Foundation. The assets would only be used for the sports complex. He reviewed the appointment and removal of the Board of Directors. The property deed would be transferred to the Foundation. Mr. Whitfield stated that the Foundation would hold the land and would not be an asset to the City. Mayor Joven stated that the pre-development was funded by the City. He stated that the future funds from the Foundation would not be used for other parks of the City. The intent of the Foundation was an advisory committee. The purpose was set per Larry Bell’s direction. The sports complex would be the destination as a multi-use sports facility. Mr. Whitfield stated that polices would be set by the Foundation. He stated that only the City Council could amend the bylaws by super majority vote of the Council. Motion was made by Council member Swanner and seconded by Council member Connell to approve the resolution and the certificate of formation of the sports complex foundation. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Connell, Hanie, and Swanner Nay: None Motion was made by Council member Hanie and seconded by Council member Thompson to approve the Amy Bell Sports Foundation bylaws. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Connell, Hanie, and Swanner Nay: None Resolution No. 2023R-95 – Authorize the City Manager to execute a Memorandum of Understanding to host the Texas Special Olympics to Odessa, Texas in October 2024. Mr. Jones stated that the memorandum of understanding was to host the Texas Special Olympics next year. J’Nette Thorne, Special Olympics West Region Executive Director, stated that Odessa and Midland would host the Special Olympics that would include four sports plus equestrian. There were 59,000 athletes and it would be used to advance to the US and World games. The Special Olympics would be held October 3-5, 2024. Motion was made by Council member Matta and seconded by Council member Hanie to approve the resolution. The motion was approved by the following vote: Council Minutes October 10, 2023 Page 4 Aye: Joven, Matta, Thompson, Connell, Hanie, and Swanner Nay: None Miscellaneous Posting the job of alternate Municipal Court Judge position and accepting applications for said position. Mr. Jones stated that one Alternate Municipal Court Judge retired. There was a need to post the job to handle weekend duties. Motion was made by Council member Connell and seconded by Council member Thompson to post the job of Alternate Municipal Court Judge. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Connell, Hanie, and Swanner Nay: None Appointment of Boards: Midland Odessa Urban Transit District and Odessa Housing Finance Corporation. No action. Executive Session: As authorized by the Texas Government Code, Section 551.074 (Personnel Matters), the City Council may adjourn into executive session to consider personnel matters - deliberate the employment, evaluation, duties, discipline, complaint, or dismissal of a public officer or employee.
