CITY COUNCIL MINUTES CITY OF ODESSA, TEXAS June 25, 2024 On June 25, 2024, a regular meeting of the Odessa City Council was held at 6:02 p.m. in the Council Chambers, 5th floor, City Hall, 411 W. 8th, Odessa, Texas. City Council present: Mayor Javier Joven; Council members: Mark Matta, District One; Steven P. Thompson, District Two; Gilbert Vasquez, District Three; Greg Connell, District Four; Chris Hanie, District Five; and Denise Swanner, At-Large. Staff present: Norma Aguilar, City Secretary; John Beckmeyer, City Manager; Dan Jones, City Attorney; and other members of City staff. A quorum being present, Mayor Joven called the meeting to order, and the following proceedings were held: Roll call. Ms. Aguilar conducted the roll call for the City Council. The invocation was given by Pastor James McCrary, First Baptist Church, and followed by the Pledge of Allegiance and Texas flags. Motion was made by Council member Matta and seconded by Council member Vasquez to suspend the rules. The motion was approved by unanimous vote. Citizen’s comments on non-agenda items. Campbell Landswerk stated that there was a lack of resources at Animal Services. She stated programs were needed to reduce the killings of animals at Animal Services. Proclamations, Presentations, and Awards. Mayor Joven presented Mayra Cano with a proclamation. Consent Agenda 1. City Council work session minutes, June 11, 2024; 2. City Council minutes, June 11, 2024; 3. Ordinance No. 2024-26 – Amend the Odessa City Code Chapter 1-7 Boards Commissions and Committees to remove the Downtown Odessa Inc. Board; 4. Ordinance No. 2024-27 - Amend the Odessa City Code Chapter 12 “Traffic and Vehicles” Article 12-3 “Parking, Stopping and Standing” Sections 12-3-15 “Parking in Undeveloped Lots” and 12-3-16 “Parking of Commercial Motor Vehicles. Motion was made by Council member Vasquez and seconded by Council member Hanie to approve the consent agenda items. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie and Swanner Nay: None Council Minutes June 25, 2024 Page 2 Regular Purchase stencils for painting streets in Odessa, as part of the 2024 Seal Coat program. Joeseph Goff, Traffic Operations Superintendent, stated that the purchase was for thermoplastic pavement markings for $66,705.35. Motion was made by Council member Matta and seconded by Council member Thompson to purchase the stencils for painting streets. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie and Swanner Nay: None Resolution Resolution No. 2024R-68 – Authorize the City to apply for and accept a Federal Grant $18,000 to provide partial payment for bulletproof vests, committing to a cash match, appropriating awarded grant funds, and authorizing expenditure of awarded grant funds. Mike Gerke, Police Chief, stated that the City would apply and accept a grant for bulletproof vests. The grant was a 50% match with the City’s portion of $9,000. The bulletproof vest shelf life was five years. Motion was made by Council member Thompson and seconded by Council member Connell to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Resoltuion No. 2024R-69 - Accept $270,000 for the purchase of Fire Station No. 6. Mr. Jones stated that the purchase would release the property for a retail business. Motion was made by Council member Vasquez and seconded by Council member Swanner to accept $270,000 for Fire Station No. 6. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie and Swanner Nay: None Resolution No. 2024R-70 – Amend the lease agreement between the Girl Scouts of the Desert Southwest and the City of Odessa. Mr. Jones stated that the agreement was for a lease of 99 years. The Girl Scouts obtained funding for the exterior of the property and supported the 99-year lease. Mr. Jones stated that the lease has been in place since the 1980s. Motion was made by Council member Hanie and seconded by Council member Swanner to approve the resolution and Mr. Beckmeyer negotiate the fee for the lease of 99 years. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Resolution No. 2024R-71 – Resurfacing McKinney Park playground. Max Reyes, Director of Parks and Recreation, stated that the playground at McKinney Park was out of Council Minutes June 25, 2024 Page 3 date and not ADA compliant. The project construction was for resurfacing the playground with a time frame of two to three weeks. The cost was $112,408. Motion was made by Council member Matta and seconded by Council member Thompson to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Ordinance Rename Troy Avenue between University Boulevard and 28th Street to Apex Avenue. Joe Tucker, Director of Public Works, stated that there was a new development, and the developer was rebuilding the street. He recommended one block of street to be renamed from Troy to Apex Avenue. Motion was made by Council member Hanie and seconded by Council member Connell to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Miscellaneous Appointment of Boards: Board of Survey, Historic Preservation Commission, Planning and Zoning Commission, Tax Incentive Committee, Traffic Advisory Committee, and Zoning Board of Adjustment. Motion was made by Council member Thompson and seconded by Council member Vasquez to appoint Taylor Grimes to the Traffic Advisory Committee. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Resolution Resolution No. 2024R-72 – Outside agency requests for funding for FY 2024-25 budget. Kaylie Banda, Director of Finance, stated that there was a new process to capture and streamline the usage of awarding the General Fund and Hotel Motel Tax Fund. The application was changed with required additional information. The committee reviewed and recommended awarding of funds. Kala Hardy, Internal Auditor, reviewed the factors and criteria. Mr. Beckmeyer thanked the committee and applicants. Mayor Joven supported the recommendation and the formula which included an audit. Ms. Banda conducted roll call of the applicants. The Black Cultural Council agreed to be funded out of the General Fund. Each Council member and the Mayor provided a recommendation for the General Fund. Council member Matta abstained from Odessa Teen Court’s request. There was a consensus of General Fund funding. Each Council member and the Mayor gave a recommendation for Hotel Motel funding. Council member Vasquez abstained from Odessa Arts. Council member Swanner abstained from Junior League of Odessa. The coliseum funding was required through contract. Council Minutes June 25, 2024 Page 4 JoAnn Davenport stated that the Black Cultural Council requested funds from Hotel Motel and asked why it was changed to the General Fund. Ms. Banda stated that they were not tracking the hotel stays and was moved to the General Fund as it was not tied to restrictions. Motion was made by Council member Hanie and seconded by Council member Connell approve the following Hotel Motel allocations: Children’s Miracle Network $50,000 Odessa Crime Stoppers 65,000 PermiaCare 90,000 Young Professionals of Odessa 10,000 Black Cultural Council of Odessa 50,000 The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, Hanie, and Swanner Nay: None Motion was made by Council member Thompson seconded by Council member Hanie to approve the Odessa Teen Court allocation of $40,000.
