CITY COUNCIL MINUTES CITY OF ODESSA, TEXAS October 8, 2024 On October 8, 2024, a regular meeting of the Odessa City Council was held at 6:00 p.m. in the Council Chambers, 5th floor, City Hall, 411 W. 8th, Odessa, Texas. City Council present: Mayor Javier Joven; Council members: Denise Swanner, At-Large; Mark Matta, District One; Steven P. Thompson, District Two; Gilbert Vasquez, District Three; and Greg Connell, District Four. City Council absent: Council member Chris Hanie, District Five. Staff present: Norma Aguilar, City Secretary; Cristina Burns, Assistant City Manager; Dan Jones, City Attorney; and other members of City staff. A quorum being present, Mayor Joven called the meeting to order, and the following proceedings were held: Roll call. Ms. Aguilar conducted the roll call for the City Council. The invocation was given by Pastor Joshua Zuniga, Kingdom Church, and followed by the Pledge of Allegiance and Texas flags. Proclamations, Presentations, and Awards. Mayor Joven presented a Mike Canales Day proclamation to the family members. Consent Agenda 1. City Council minutes, September 24, 2024; 2. Ordinance No. 2024-39 - Request by LCA for a zone change from FD, Future Development to PD-SD, Planned Development-Surface Drainage, FD-DR, Future Development District—Drill Reservation, to PD-H, Planned Development District – Housing, FD, Future Development District, to PD-H, Planned Development District – Housing, FD-DR, Future Development District—Drill Reservation, to PD-H, Planned Development District – Housing, and FD, Future Development District, to PD-SD, Planned Development District – Surface Drainage, on a 107.18 acre tract located in Sections 11 & 14, Block 41, T-2-S T&P RR Co. Survey City of Odessa, Midland County, Texas; 3. Ordinance No. 2024-40 - Request by Los Cuatro Amigos, LLC, for a Zone Change from FD, Future Development District, to MU, Mixed Use, on a 159.28-acre tract, located in Section 10, 11, 14 and 15, Block 41, T-2-S, T&P RR. Co. Survey, Midland County, Texas; 4. Resolution No. 2024-118 - Accept and appropriate the funds from the sale of old fire Station 6 to Odessa Fire Rescue. Council Minutes October 8, 2024 Page 2 Motion was made by Council member Swanner and seconded by Council member Connell to approve the consent agenda items. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, and Swanner Nay: None Regular Bid award to prepare design and construction plans for a new municipal parking garage to WGI. Jeffrey Fisher, Strategy Development and Policy Manager, recommended the bid award to WGI for the design and construction of the parking garage. The garage would be for the Police, municipal employees and downtown. The cost of the design was $200,000. The completion date was one and one half years. The garage had about 450 – 500 spaces. Council member Thompson had concerns on mixing the police vehicles with civilian vehicles. Elizabeth Shaughnessy, Director of Development Services, stated that there would be two ramps and the police vehicles would be segregated from the other vehicles. The revenue would be for garage maintenance. The life expectancy of the garage was 50 to 60 years. Mrs. Shaughnessy explained the reasons for not recommending automated parking. Dallas Kenney asked who would be charged for parking. Mrs. Shaughnessy stated revenue would be from after hours and weekends, but it was to be determined. Motion was made by Council member Thompson and seconded by Council member Connell to approve the bid award to WGI for design and construction plans as recommended. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, and Swanner Nay: None Transfer $126,000 received from TML Intergovernmental Risk Pool for the AAON unit replacement at the Animal Shelter to the PD Training and Academy Facility Project. Mrs Burns stated that $126,000 was received from the TML Intergovernmental Risk Pool and it would be transferred to the Police Training and Academy Facility account. Motion was made by Council member Vasquez and seconded by Council member Connell to approve transferring $126,000 for the AAON unit replacement as recommended. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, and Swanner Nay: None Public Hearing Open a public hearing to consider a request by Board of Trustees, Ector County Independent School District, for a zone change from FD, Future Development District, to LI, Light Industrial District, on a 37.83 acre tract located in Section 25, Block 42, T- 2-S, T&P, RR Co. Survey, Ector County, Texas. Mrs. Shaughnessy stated that the zone change was for a technical educational school. Council member Connell stated it would be a world class school for skills and certification. No one came forward and the public hearing was closed. Motion was made by Council member Matta and seconded by Council member Swanner to Council Minutes October 8, 2024 Page 3 approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, and Swanner Nay: None Open a public hearing to consider a request by Leeco Energy & Investments, LLC, for a zone change from FD, Future Development District, to SPD, Special Dwelling District and from FD, Future Development District to SPDSD, Special Dwelling District-Surface Drainage on a 119.57 acre tract located in Section 2, T-2-S, T&P RR. CO. Survey, City of Odessa, Ector County, Texas. Mrs. Shaughnessy stated that the zone change was for housing development. The Planning and Zoning Commission recommended for approval with conditions. No one came forward and the public hearing was closed. Motion was made by Council member Vasquez and seconded by Council member Thompson to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, and Swanner Nay: None Resolution Resolution No. 2024R-119 – Downtown Odessa, Inc. lease agreement for the office space at Municipal Plaza. Mrs. Burns stated that the lease agreement was for suites 101, 103, and 105 at Muncipal Plaza. A monetary payment and an annual report were required as part of the agreement. The contract was for 10 years with an option to renew. Craig Stoker, Downtown Board President, provided the members of the board as it was reformed. Motion was made by Council member Vasquez and seconded by Council member Matta to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, and Swanner Nay: None Resolution No. 2024R-120 – Ector County interlocal agreement for the division of the 2024 Edward Byrne Memorial Justice Assistance Grant (JAG) funds. Mike Gerke, Police Chief, stated that the City would administer the grant for the Police Department and Ector County. Motion was made by Council member Connell and seconded by Council member Swanner to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, and Swanner Nay: None Resolution No. 2024R-121 – Authorize the Odessa Police Department to apply for and accept; amending the fiscal budget to appropriate awarded funds as additional revenue and authorize the expenditure of awarded grant funds from the 2024 BJA Edward Byrne Memorial Justice Assistance Grant Program (JAG). Motion was made by Council member Thompson and seconded by Council member Connell to approve the resolution. The motion was approved by the following vote: Council Minutes October 8, 2024 Page 4 Aye: Joven, Matta, Thompson, Vasquez, Connell, and Swanner Nay: None Resolution No. 2024R-122 – Authorize the Odessa Police Department to apply for and accept; amending the fiscal budget to appropriate awarded funds as additional revenue and authorize the expenditure of awarded grant funds from the 2025 STEP- Impaired Driving Mobilization Grant. Chief Gerke stated that the grant was to target impaired driving during special times such as the holidays. Motion was made by Council member Matta and seconded by Council member Swanner to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, and Swanner Nay: None Resolution No. 2024R-123 – Appropriate for needs-based staffing across various departments. Kaylie Banda, Director of Finance, reviewed the list of positions for staffing for various departments. The appropriated amount was $761,095.30. Motion was made by Council member Swanner and seconded by Council member Connell to approve the resolution. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Vasquez, Connell, and Swanner Nay: None Miscellaneous Appointment of Boards: Board of Survey, Historic Preservation Commission, Odessa Development Corporation, Odessa Housing Finance Corp. Planning and Zoning Commission, Public Art Committee, Tax Incentive Committee, and Zoning Board of Adjustment. No action. Citizen’s comments on non-agenda items. Bill Cleaver was upset with the appointees’ contracts. He asked if anyone checked with TML and what two people placed on the agenda. He stated that it was not discussed in executive session. He asked that the contracts be amended and restore city government. Victoria Romo, Odessa Deserves Better, stated that over six months the Council has heard advocates for saving the animals in Odessa. She asked that TNVR be implemented which has been done with great success. Dallas Kenney asked to allow citizens to comment at the beginning of the meeting and not at the end. Ronnie Lewis stated that the TGAA contract was not transparent and there was a conflict of interest with Matt Armstrong. He stated that there was nothing in the contract that benefitted the city. Motion was made by Council member Swanner and seconded by Council member Vasquez to adjourn the meeting.
