Be it said and remembered that at 1:30 p.m. on the 16th Day of March 2023, there came on and was held a Planning and Zoning Commission meeting in the Council Chambers, 5th Floor, 411 W. 8th St., Odessa, Texas. MEMBERS PRESENT: Lance Marker, Chairman Wayne Russell, Vice Chairman Steve Tercero Jimmy Peacock Connie Coots Gary Sims Craig Stoker MEMBERS ABSENT: OTHERS PRESENT: Maria Prieto, Planner; Cheynna Torres, Planning Tech, Joe Tucker, Assistant City Engineer; Fara Hernandez, CIP Coordinator; Dan Jones, Interim City Attorney The minutes of the of the March 16, 2023, Planning and Zoning Commission meeting were approved, motion for approval being made by Member, Coots seconded by Member Peacock, with the vote being a unanimous “aye” CASE FILE NO. 2023-02-SUP (Approved with conditions) Open a public hearing to consider approval of the request by Claudio Rodriquez, owner, for a specific use permit to allow workforce housing in a Light Industrial (LI) District on Lots 24, Block 5, West Interstate Industrial Site 3-41 City of Odessa, Ector County, Texas (2135 I-20 Service Rd. W.) Ms. Prieto gave the following presentation: The property involved in this request is located at 2135 I-20 Service Rd. W. The site is currently zoned Future Development (FD) with a pending application for Light Industrial (LI) and is occupied by industrial development and vacant land. Land use in the general area consists of industrial development and related uses to the north, south, east and west. The applicant is Claudio Rodriguez, owner, and the purpose of the specific use permit request is to facilitate work force housing on the property with existing industrial development. Proposed building area is approximately 1336 sq. ft. and the total lot 04/06/2023 Page 1 area is approximately 5.0 acres. A site plan has been submitted indicating building locations and other development standards which include parking and fencing. Staff Comments: -- Lot coverage with work force housing is approximately 2% (meets ordinance requirements). Front yard/side yard building setbacks are 25’ front, 10’ street side, 0’ rear side are adequate and meet ordinance requirements. If the Commission chooses to approve this request, the Planning Staff recommends adoption of the following conditions: 1. Access and parking for the site will need to be provided. 2. Six (6) vehicle parking spaces are required for the work force housing (1 paved parking per unit) and existing 7 vehicle parking spaces for existing industrial development are adequate. Required parking spaces need to be paved (9’ x 18’). 3. Vehicles in inoperable condition may not be stored onsite. 4. Operation of a home occupation or home business by occupants of Workforce Housing shall not be allowed. 5. Occupancy shall be limited to 2 persons per bedroom at the same time. 6. Access to proposed work force housing will be provided on W Interstate Hwy 20. 7. All portions of the building(s) must be within 150 feet of an approved fire apparatus road. 8. There must be a fire hydrant within 400 feet of building(s). 9. All applicable building codes need to be met. 10. Review of the permit upon receiving neighborhood complaints. This is a temporary permit and the City Council shall have the right of termination for violation of the terms and conditions of the permit or because of the negative effect of the use on the neighborhood after a public hearing. CASE FILE NO. 2023-04-Z (Approved) Open a public hearing to consider approval of the original zoning request by Leeco, Inc., owner, LCA, agent, for Light Commercial (LC) on the proposed plat Yukon Ridge Commercial, 1st Filing being a 8.50 acre tract in Section 2, Block 42, T-2-S, T & P RY Co. Survey, City of Odessa, Ector County, Texas. (southwest of E. Yukon Rd. and N. Grandview Ave.) Ms. Prieto gave the following presentation: The property involved in this request is located southwest of E. Yukon Rd. and N. Grandview Ave. The site is currently designated Future Development (FD) and is undeveloped. Land use in the area consists of a stadium to the north, and vacant land to the east, south and west. The applicant is Leeco, Inc., owner, LCA, agent and the purpose of the original zoning request is to allow light commercial development on the property. Using the City’s identified priorities contained in the City of Odessa’s Comprehensive Plan to evaluate zoning amendments the following comments are offered: Comprehensiveness: The proposed zoning is not contrary to the established land uses in the general area or the land use plan of the City of Odessa’s Master Plan. Livability: The proposed zoning would not have a negative impact on this site or surrounding properties. The proposed light commercial development would not be out of line with development in the area. The proposed use would be an appropriate complimentary use to the surrounding neighborhood Reasonableness: The proposed zoning district would be consistent with surrounding zoning districts in the area. Based upon the preceding analysis, Staff recommends approval of the request. 04/06/2023 Page 3 Ms. Prieto asked if there were any questions for staff. CASE FILE NO. 2023-19-P (Approved with conditions) Consider approval of the preliminary plat of Yukon Ridge Commercial, 1st Filing being a 8.50 acre tract in Section 2, Block 42, T-2-S, T & P RY Co. Survey, City of Odessa, Ector County, Texas. (southwest of E. Yukon Rd. and N. Grandview Ave.) Ms. Prieto gave the following presentation: The property involved in this preliminary plat request is located southwest of E. Yukon Rd. and N. Grandview Ave. The site is within the City of Odessa and is designated Future Development (FD) with an accompanying original zoning request for Light Commercial (LC). The property is currently undeveloped. The applicant is Leeco Energy & Investments Inc, owner, LCA, consultant, and the purpose of the preliminary plat request is to plat 0.6 acre road dedication and create three (3) lots for ownership and development purposes. Land use in the area consists of a stadium to the north, and vacant land to the east, south and west. A platting conference was held February 21, 2023 with the applicant’s consultant and city staff present. Staff Comments: -- Original tax certificates are needed prior to filing the plat. -- Water and sewer are available for extension. No pro rata is due. -- This tract is not in a special flood hazard area. -- Any work in the right of way or easements will require a permit from the Engineering Division and must comply with current City Ordinances and policies. 04/06/2023 Page 4 Commission action is requested on the following items: 1. Ms. Prieto gave the following presentation: The property involved in this replat request is located southeast of the intersection of Hwy 191 and N. Faudree Rd. The site is zoned Planned Development-Retail-1 (PD-R-1) and is occupied by a hotel and restaurant/cocktail lounge. The applicant is Devi Investments, Inc. owner, S. W. Howell, agent and the purpose of the replat is to create two (2) lots for ownership purposes. Platting conference agenda and comments were sent to the consultant on February 21, 2023. Staff Comments: -- Original tax certificates need to be submitted prior to filing the plat. -- Water and sewer are available. If there is a significant change in use or traffic generation, the existing access should be evaluated to determine if it is still appropriate. (southeast of the intersection of Santa Isabella St. and Mission Santiago Dr.) Ms. Prieto gave the following presentation: The property involved in this replat request is located southeast of the intersection of Santa Isabella St. and Mission Santiago Dr. The site is zoned Single Family-One (SF-1) and is undeveloped. 04/06/2023 Page 6 The applicant is Bobby Hill, owner, Newton Engineering, consultant and the purpose of the replat is to create one (1) lots for ownership and development purposes. Land use in the area consists of residential development to the north, south, and west, and a combined residential and commercial development to the east. Flamingo Ave.) Ms. Prieto gave the following presentation: The property involved in this replat request is located southwest of the intersection of W. 26th St. and N. Flamingo Ave. The site is located in the City of Odessa Extra-Territorial Jurisdiction (ETJ), does not have a zoning designation and is currently occupied by residential development. 04/06/2023 Page 7 The applicant is Vanesa Beltran Perez, owner, S. W. Howell, agent and the purpose of the replat is to create two (2) lots for ownership purposes. Land use in the area consists of residential development to the north, east and south, and vacant land to the west. Staff Comments: -- Original tax certificates need to be submitted prior to filing the plat. -- This tract is outside the City limits and is in the ETJ. -- Water is available through ECUD. -- Drainage report has been submitted. This tract is not in a special flood hazard area. Commission action is requested on the following item: 1. Both lots must connect to ECUD water. (Public Works). (Public Works) 2. 11311 26th Street-Existing Lot 7, Block 23, Westridge 2nd Filing – has a water meter in the alley between 26th Street and Broken Bow Circle. The water line to serve the existing residence (Proposed Lot 19) either crosses under two structures or across proposed Lot 20. If the service line crosses Proposed Lot 20 an easement will be needed. (southwest of the intersection of E Interstate 20 and S Market St.) Ms. Prieto gave the following presentation: The property involved in this replat request is located southwest of the intersection of E Interstate 20 and S Market St. The site is zoned Light Industrial (LI) for the portion within the city limits. The portion of the tract outside of the city limits has no zoning designation and is located in the Extra-Territorial Jurisdiction (ETJ). The property is currently occupied by industrial development and vacant land. Land use in the area consists of industrial uses to the north, east, and south and vacant land to the west. The applicant is La Frontera Holdings, LLC owner, LCA, consultant and the purpose of the replat is to create two (2) lots for industrial purposes. A platting conference was held March 07, 2023, with the applicant’s consultant and city staff present.
