Planning and Zoning Commission Approved for Agenda: Elizabeth Shaughnessy November 21, 2024 MEETING DATE: CASE FILE #: 2024-14-Z Open a public hearing to consider approval of the request by Ngoc Tran, owner, for a Zone change from Single Family Residence-Three (SF-3) District to Multiple Family Residence-One (MF-1) District of a 0.3214-acre tract, being Scharbauer Place, 2nd Filing, Lots 1 and 2, Block 19, less the northwest Part of Lot 2, and the southeast Part of Lot 4, Block 19, Crestview Addition (Northwest of the intersection of N Lauderdale Ave. and W 6th St. – Council District 5) Maria Prieto Presents: The applicant, Ngoc Tran, is requesting a zone change from SF-3, Single- Family Residence District - 3, to MF-1, Multiple-Family Residence District-1, on the above-mentioned property. The applicant intends to use the property for a one-story buildings with three (3) residential units. The Subject property is located northwest of the intersection of N Lauderdale Ave and W 6th St. The site is currently designated SF-3, Single-Family Residence District-3 and is the location of a church. The applicant, Ngoc Tran, is seeking a zone change for the future development of a three-unit residential building. Using the City's identified priorities contained in the City of Odessa's Comprehensive Plan, the Planning Division provides the following comments: Comprehensiveness: This request is inconsistent with the City of Odessa's Comprehensiveness Plan. The property is surrounded by Single-Family dwellings and zoning on all sides, and approving multi-family zoning in the center would be considered spot zoning and inconsistent with the Planning objectives outlined in the Comprehensive Plan and zoning district. The nearest Multiple-Family zoning designation is approximately 1,00-feet away. Livability: The proposed zoning would have a negative impact on this site or surrounding properties. It would add more density, parking, and traffic in an area deigned for single-family housing on large lots. Reasonableness: the proposed zoning district would not facilitate a reasonable transition between land uses of varying intensities and would create a conflict to existing land uses in the area. The Planning Division recommends DENIAL due to the request being inconsistent with the development objectives of the Comprehensive Plan and Zoning Ordinance. Chairman ask members for question. Member Gary Sims ask staff for the Zoning process. Explains the Multi Family locations as giving a better quality. As this neighborhood indicated rental homes and apartments down the road. Staff indicates City Council request for the change as notices sent out for two hundred feet radius. Staff as well indicates multiple family would be the best zoning for a project like this to be approved. Director would request a study from the area and present to City Council. As Dan Jones, City Attorney, stated to members would be able to send a request to City Council for a proposal of Multi-Family in a larger area than just this spot zoning. Chairman opens the public portion of the meeting asking if any one else further would like to speak on behalf, owner approaches podium stating the use of zoning will help impact his projection. Chairman closes the public portion hearing no one else speak on behalf of opposing. The SF-2 district allows single-family homes with a minimum lot size of 8,000 square feet. The property is required to be platted prior to construction. Using the City's identified priorities contained in the City of Odessa's Comprehensive Plan, the Planning Division provides the following comments: Comprehensiveness: This request is consistent with the City of Odessa's Comprehensiveness Plan. The property is adjacent to SF-2 properties will existing single-family homes. Livability: The proposed zoning would not have a negative impact on this site or surrounding properties. Any future SF-2, Single-Family Residence District-2 development will be consistent with the development in the area. Reasonableness: The proposed zoning district will facilitate a reasonable transition between land uses of varying intensities and would not create a conflict to existing land uses in the area. The Planning Division recommends Approval due to the request being consistent with the development objectives of the Comprehensive Plan and Zoning Ordinance. Approval of the zone change will be subject to condition A. Staff indicated no protest for current case, as twenty one (21) notices sent and one approval. (Notices sent to members ) Chairman ask members for discussion or question for staff. Hearing none, opens the public portion of the meeting for discussion or concerns from audience. As no one comes forward closes the public portion of the meeting and turns to his members for motion or discussion. CO. Survey, City of Odessa, Ector county, Texas. (Generally located on the south side of Royal Manor Dr, approximately 260-fet east of Grand Manor– Council District 2) James Reber Presents: The applicants and owners, Landon and Kayla Hobbs with consultant, Newton Engineering, PC, are seeking to Replat to create one (1) lot for ownership purposes. This request has been routed to all respective City departments for review. John Burnett approached the podium regarding the drainage and the Drill Reservation having entrance through private road. ( Vensia road from Verona) Joe Tucker approached the podium stating comments needed to address not listed on the agenda. No Direct Access to East Ridge. As planning a fence in the location, however this is one specific needed for record. As other comments will be addressed with consultant and for the Private access, is owned from Oncor.
