approved, motion for approval being made by Vice-Chairman, Kyle Newton, seconded
by member, Anthony Rios, with the vote being a unanimous “aye”.

The property involved in this request is located at 4332 Locust Ave. This site is
currently zoned Single Family-Three (SF-3) Zoning District and is occupied by a
single-family residence. The property is surrounded by single family residential
development to the north, south, east and west.
The applicant is David Veloz, owner, and the purpose of the request is to obtain a
variance to allow the construction of a 570 sq. ft. carport to be built with a zero-foot (0’)
side yard setback instead of the required fifteen feet (15’) side yard setback. The
applicant is requesting a variance from Section 14-7-8 (d) of the City of Odessa Zoning
Ordinance. The Planning Staff cannot support the variance request, and recommends
that the request be denied, and that the carport be located at the rear of the property,
maintaining a six-foot (6') separation between the main residence and the accessory
structure.
Should the Board choose to approve this request, the Planning staff would recommend
adoption with the following conditions:
1. That no other structures or additions may be placed within the fifteen feet (15’) side
yard setback.
2. The eave of the carport shall be kept entirely within the property line.
3. That the carport shall not be enclosed in the future.
4. Shall meet building code requirements and obtain a permit from the Building
Inspections Department.
Board Member Anthony P. Rios recused himself due to personal ties with the applicant.
Member Norberto Brito noted the Carport Overlay District allows carports within
setbacks, which aligns with the applicant’s request. Staff clarified that corner lots have
unique overlay requirements, and the applicant seeks a zero-foot side yard setback
instead of the required ten feet.
Chairman Arzate opened the public hearing. Homeowner David Veloz explained the
hardship due to weather exposure and the removal of a previous carport. He intends to
build a compliant and visually appealing structure.
No other public comments were made chairman Arzate closed public hearing.
Member Brito moved to approve the variance with staff-recommended conditions.
Seconded by Member Henry Enriquez.
Motion passed 4-0 with one abstention.

The property involved in this request is located at 610 E 95th St. This site is
currently zoned Single Family-Three (SF-3) Zoning District and is occupied by a
single-family residence. The property is surrounded by single family residential
development to the north, south, east and west.
The applicant is Chistopher Tetley, owner, and the purpose of the request is to obtain
a variance to allow the construction of a 378 sq. ft. (14 ft. x 27 ft.) carport to be built with
a zero-foot (0’) side yard setback instead of the required five feet (5’) side yard
setback. The applicant is requesting a variance from Section 14-7-7 of the City of
Odessa Zoning Ordinance
Analysis of this request is that the variance will be contrary to the public interest for several
reason. First, reducing the side yard setback to zero feet (0’) will create hazards and
hardships to the adjacent property due to the proximity of the structure and will cause flow
of rainwater to fall onto adjacent property. Second, it will reduce the amount of light, air,
or open space for the adjacent property owner and set a negative precedent for other
owners to place their structures on side and front yards.
Staff recommends denial of the applicant’s request for a zero-foot (0') side yard setback.
Instead, staff proposes reducing the width of the carport from fourteen feet (14') to nine
feet (9') to comply with the required five-foot (5') side yard setback.
Should the Board choose to approve this request, the Planning staff would recommend
adoption with the following conditions:
1. That no other structures or additions may be placed within the five feet (5’) side
yard setback.
2. That the carport shall not be enclosed in the future.
3. The eave of the carport shall be kept entirely within the property line.
4. Shall meet building code requirements and obtain a permit from the Building
Inspections Department.
Board Member Anthony Rios asked staff about driveway access if the carport were
built on the side of the home. Ms. Prieto (Staff) explained that a curb cut from the
front street would be required to create a new driveway, referencing the 24-inch
side yard overhang allowance per Zoning Ordinance 14-7-8.
With no further questions, Chairman Arzate opened the public hearing.
Homeowner Christopher Tetley spoke in favor, outlining plans to expand the
driveway and install a gutter system to manage water runoff from the carport.
Due to uncertainty regarding the right-of-way and whether a curb cut would be
permitted in this neighborhood, the public hearing was closed.
Board members expressed concern and recommended tabling the case until the
curb cut issue is resolved.
Motion to table passed 5-0.
Member Anthony Rios moved to table the case until confirmation is received
regarding the curb cut. Seconded by Norberto Brito III.

The property involved in this request is located at 1701 N Lincoln Ave. This site is
currently zoned Two Family-One (2F-1) Zoning District and is occupied by a
single-family residence. The property is surrounded by single family residential
development to the north, south, east and west.
The applicant is Sheryl Walker, owner, and the purpose of the request is to obtain
a variance to allow the construction of a 528 sq. ft. carport to be built with a two-foot
(2’) front yard setback instead of the required twenty-five foot (25’) front yard setback.
The applicant is requesting a variance from Section 14-7-5 of the City of Odessa
Zoning Ordinance. The variance will be contrary to the public interest if approved. First,
the proposed carport structure will reduce the amount of light, air, or open space for the
adjacent property owner and set a negative precedent for other owners to place their
structures within the front yard setback. Second, a carport will create safety issues for
traffic southbound from N. Lincoln Ave. approaching the intersection.
Staff analysis of this request is to deny the applicant’s request for the structure carport
to be located in the front yard with a two foot (2’) front yard setback. The property is
located in close proximity with an intersection which might hinder visibility of traffic if the
carport is placed in the front yard setback. However, should the Board choose to
approve this request we recommend the following conditions, which would require:

1. That no other structures or additions may be placed within the twenty five feet (25’)
front yard setback.
2. That the carport shall be attached to the main residence.
3. That the carport shall not be enclosed in the future.

Board Member Anthony Rios asked staff to clarify the reason for the variance
request. Ms. Prieto (Staff) referenced the applicant’s letter, which cited the absence
of a garage and vehicle damage as justification. Mr. Rios noted that the submitted
photos appeared to show a garage on the property.
Member Norberto Brito recommended tabling the case, citing the applicant’s
absence and lack of clarity regarding the request.
Motion to table passed 5-0.
Member Norberto Brito moved to table the case due to the applicant’s absence.
Seconded by Anthony Rios.

The following criteria as outlined in the Zoning Ordinance are to be used by the Board of
Adjustment in evaluating variance requests. The burden of proof in meeting each of
these criteria is upon the applicant.
A. The variance request is not contrary to the public interest.
B. Special conditions exist for the applicant that do not generally exist for others.
C. A literal enforcement of the ordinance will result in unnecessary hardship.
D. The spirit of the zoning ordinance is observed, and substantial justice is done.
Analysis of this request is that the variance will be contrary to the public interest for several

variance to allow the construction of a 450 sq. ft. (18’x25’) carport to be built with a five-
feet (5’) side yard setback instead of the required ten feet (10’) front yard setback. The
applicant is requesting a variance from Section 14-7-7 of the City of Odessa Zoning
Ordinance, which states:

Second, the proposed carport will not create safety issues for traffic eastbound on W.
16th St. due to the sixty foot (60’) distance to the approaching the intersection with N.
Golder Ave.
Staff analysis of this request is to approve the applicant’s request for the structure carport
to be located in the side yard with a five feet (5’) side yard setback.
Should the Board choose to approve this request, the Planning staff would recommend
adoption with the following conditions:
1. That no other structures or additions may be placed within the ten foot (10’) side
yard setback.
2. That the carport shall be attached to the main residence.
3. That the carport shall not be enclosed in the future.
4. Shall meet building code requirements and obtain a permit from the Building

The proposed freestanding sign will measure 15 ft. 3 inches in height and face N.
Grandview Ave. The additional sign will have a 128 feet in distance from a freestanding
(D2) facing N Grandview Ave. and will be placed at 46 ft. from the front property line. (see
attached site plan)
In order to allow the additional sign area, the applicant is requesting a variance from
Section 14-10-1(d) (1) of the City of Odessa Zoning Ordinance which states:
14-10-1 (d) (1) Individual businesses located on a separate lot or tract shall be
entitled to a business identification sign, the maximum area in square
feet of which is derived by one and seventy-five hundredths (1.75)
times the linear feet of street frontage occupied by a separate
business on its own lot or tract, but in no case shall total business sign
area for the business or use exceed four hundred (400) square feet.
The following criteria as outlined in the Zoning Ordinance are to be used by the Board of
Adjustment in evaluating variance requests. The burden of proof in meeting each of these
criteria is upon the applicant.
A. The variance request is not contrary to the public interest.
B. Special conditions exist for the applicant that do not generally exist for others.
C. A literal enforcement of the ordinance will result in unnecessary hardship.
D. The spirit of the zoning ordinance is observed and substantial justice is done.
The Planning Staff recommends denial of the sign request to prevent proliferation of sign
usage. Staff analysis of this request is that the additional 32.33 Sq. Ft. Freestanding
signage is not a reasonable request due to excessive amount of signage and sign lighting
will create a distraction to motorists on E. Yukon Rd. and N. Grandview Ave. and may also
affect adjoining properties that have not yet been developed.
Several of the new signs added to the existing freestanding sign are not advertising the
main businesses and creating much of the excess signage. For instance, the Kwik Eats
and food item signage are in addition to the existing Kwik sign. Second, the second new
freestanding sign already advertises the Kwik car wash so having additional signage saying
Car Wash on the other freestanding adds to the overall total signage greatly exceeding the
sign ordinance allowance.
In essence, the applicant is asking for an additional increase from what was previously
approved, which does not meet the spirit and intent of the ordinance to maintain safety and
adequate open space.
Staff is willing to work with the applicant to find solutions so they can move forward but a
significant reduction in signage is necessary to meet the previously approved sign
allowance and best ensure public safety for oncoming motorists.
Therefore, the Planning Staff recommends denial of the sign request to prevent
proliferation of sign usage.

allow a structure (mobile home) to remain located on the property with a seven feet, ten
inch (7’10”) street side yard setback instead of the ten (10) feet street side yard setback.
The applicant is requesting a variance from Section 14-7-8 (4) of the City of Odessa
Zoning Ordinance, which states:
Sec. 14-7-8 (4) Special Side Yard Regulations
On a corner lot used for one-family, two-family or multiple-family dwellings a
minimum side yard of ten (10) feet shall be observed. On lots which were official
lots of record prior to December 28, 1971, the minimum side yard adjacent to a
side street shall comply with the required side yard for the respective districts as
specified in section 14-7-7 or with any side yard shown on a plat of record.
The following criteria as outlined in the Zoning Ordinance are to be used by the Board of
Adjustment in evaluating variance requests. The burden of proof in meeting each of these
criteria is upon the applicant.
A. The variance request is not contrary to the public interest.
B. Special conditions exist for the applicant that do not generally exist for others.
C. A literal enforcement of the ordinance will result in unnecessary hardship.
D. The spirit of the zoning ordinance is observed, and substantial justice is done.
Staff analysis of this request is that there are no special conditions associated with
property that do not exist for others in the area. The applicant’s request to reduce the
street side yard setback to seven feet and ten inches (7’10”) instead of the required ten
feet (10’) will create a precedence for the surrounding properties to follow. The property
is located at an intersection, which might hinder visibility of traffic approaching the
intersection. The applicant was issued a permit that specified the required street side yard
setbacks but failed to comply with these requirements. Additionally, the applicant did not
request any inspections after placing the mobile home on the property. Had the applicant
contacted the inspections department, they could have taken appropriate corrective
measures.
Staff recommends DENIAL of this request for not satisfying the above variance criteria
outlined in the Zoning Ordinance.
Should the Board choose to approve this request, the Planning staff would recommend
adoption with the following conditions:
1. No other structures or additions may be placed within the 10-foot street side yard
setback.
2. No additional structures, additions or modifications may be made to the structure
or property without first contacting the Building Inspections Department, obtaining
a building permit, and scheduling the required inspections.

residence. The property is surrounded by single family residential development to the
east, south and west, and vacant land with a drill site to the north.
The applicant is Robyn L. Millar, owner, and the purpose of the request is to permit a
mobile or HUD-manufactured home (15’2” x 28’) on a lot that is already occupied by a
single-family residence.
The applicant is requesting a Special Exception from Section 14-15-1 (d) (2) (C) of the
City of Odessa Zoning Ordinance, which states:
Sec. 14-7-8 (4) Special Side Yard Regulations
Permit the location on a lot occupied by a single-family detached dwelling
of a mobile or hud-manufactured home subject to such spacing, health, sanitation,
access, parking and occupancy standards as the Zoning Board of Adjustment may
prescribe.
The HUD manufactured home will be placed at the rear of property with a thirty foot (30’)
side yard setback and fourteen feet and five inches from the main residence thus abiding
by side yard setback and building separation requirements. Nonetheless, this
arrangement will be in violation of the Single Family- Three District Zoning Ordinance
requirements in the following manner:
1. Insufficient Lot Area:
- each single family dwelling unit requires 5,000 sq. ft.
- each mobile home unit requires 4,800 sq. ft.
Total 9,800 sq. ft.
The lot measures 7,370 sq. ft., therefore, the lot area is short by 2,430 sq. ft.
2. Two additional off street paved parking spaces will need to be provided.
3. Single Family- Three District does not allow for hud-manufactured homes in this
zoning district.
There are no special criteria listed to evaluate Special Exception requests and the Board
of Adjustment is not bound to follow them as with the variance request; however, the
Planning Department has followed the variance format to analyze this request as follows:
A. There are no special circumstances existing on the property related to
shape, size or topography.
B. A variance is not necessary to permit the applicant the same rights presently
enjoyed by surrounding property owners under the ordinance.
C. Granting of the Special Exception for this specific property will not affect the
land use plan by restricting the amount of light, air or open space due to the
size of the hud-manufactured home in question.
D. The Exception, if granted, will not be considered detrimental to the public
welfare or to the value of the property in the vicinity.
Staff analysis of this request is that there are no special conditions associated with
property that do not exist for others in the area. The applicant’s request to place a hud
manufactured home on a lot that is already occupied by a single-family residence will
create a precedence for surrounding properties in the area.
Staff recommends DENIAL of this request for not satisfying the above criteria outlined in
the Zoning Ordinance.
Should the Board choose to approve this request, the Planning staff would recommend
adoption with the following conditions:
1. Location of a modular home structure shall meet all Zoning Ordinance
requirements related to setbacks.
2. That the structure shall not be used as a means for conducting business.

(9) In the SPD District a front yard may be reduced to zero provided that provisions
are made for handling the storage of automobiles off the street without creating a traffic
hazard and all front yard lines in an SPD District shall be subject to approval on the Site
Plan as hereinafter specified to assure a compatible relationship to adjacent development
and adequate provision for the health and safety of the occupants and the public.
(10) Gasoline pump islands with or without canopy shall be located no closer than 20'
to the property line. Canopies attached to the pump islands shall provide at least 14' of
clearance from the ground to the bottom of the canopy and shall be located no closer than
10' to the property line.
(11) In the MC, R, R-1, LC, HC, CB-2, LI, and HI districts a minimum 25 foot front
yard is required for all non-residential uses except where provision is made for adequate
site design, by addressing traffic circulation, parking, visual clearance and surrounding

twenty-five (25) feet.
(12) In all districts where establishments providing service directly to the automobile
are permitted, a setback and drive for stacking waiting vehicles shall be provided so that a
minimum of four (4) automobiles may be accommodated between the front property line
and the service window or order board of the facility.
(13) Where single-family residential lots front upon the major or secondary traffic
arteries of University Boulevard, 42nd Street, 52nd Street, Dixie Boulevard, Maple
Avenue, Tanglewood Lane, West County Road, Golder Avenue, Crane Avenue or Dawn
Avenue, a screening fence or wall may be constructed in the required front yard as a buffer
and separation from the visual and noise impact of vehicular traffic generated by the
proximity of the thoroughfares. No screening fence or wall authorized in the front yard
under the provisions of this section shall exceed eight (8) feet in height and no fence or
wall shall be located nearer than ten (10) feet to the front property line and in all cases a
screening fence, wall or related landscape planting shall be so located and arranged as to
assure a driver of a vehicle clear vision of the street and sidewalk when entering or leaving
the premises and prior to the vehicles entering or leaving the street. The space created
between the screening fence or wall may be used for the customary front lawn or as an
entry garden or landscaped area including paved areas, sculpture, water features and trees.
(14) In a Mobile or Hud-Manufactured Home Park or Special Housing Arrangement
where the location of a fence or wall has been approved on the Site Plan so as to be located
within the required front yard, such fence or wall may be erected to a maximum height of
six (6) feet provided that the location and height of such fence or wall within the front yard
does not obstruct the clear vision of streets or sidewalks for a vehicle driver entering or
leaving the lot or tract.
(15) Lots in Single Family –Three (SF-3) Zoning Districts with a lot depth of one
hundred (100) feet or less shall have a twenty (20) foot front yard setback.
