A moment of silence was observed. Joint Resolution 2015-1 recognizing Dale C. Campbell for his many years of service and significant contributions to Ogden City A memo from Council staff came before the Council to consider a joint resolution recognizing Dale C. Campbell for his many years of service and significant contributions to Ogden City. The memo stated the joint resolution recognizes the many contributions that Mr. Campbell provided to Ogden City through his work with R&O Construction. The memo indicated Mr. Campbell’s children and representatives from R&O Construction will be present to accept this joint resolution. Chair Hyer introduced in writing proposed Joint Resolution 2015-1, entitled: “A joint resolution of the Ogden City Council and Mayor recognizing Dale C. Campbell for his many years of service and significant contributions to Ogden City.” Council member Blair read the joint resolution, after which COUNCIL MEMBER BLAIR MOVED THE JOINT RESOLUTION BE ADOPTED, AND THE CHAIR BE AUTHORIZED TO SIGN THE SAME. MOTION WAS SECONDED BY COUNCIL MEMBER STEPHENS, ALL VOTING AYE. Council member Blair then presented two framed copies of the joint resolution to Mr. Campbell’s family and representatives from R&O Construction. Joint Proclamation declaring January 19, 2015 “Martin Luther King, Jr. Day of Service” in Ogden City A joint proclamation regarding the declaration of Martin Luther King Jr. Day of Service came before the Council for consideration. Council member Garner read the joint proclamation, after which COUNCIL MEMBER GARNER MOVED TO APPROVE THE JOINT PROCLAMATION. MOTION WAS SECONDED BY COUNCIL MEMBER WICKS, ALL VOTING AYE. Council member Garner then presented the joint proclamation to representatives of the Ogden Branch of the National Association for the Advancement of Colored People (NAACP). Reverend Stanley Ellington, NAACP Ogden Branch President Elect, thanked the City Council and Mayor for consideration of the joint proclamation; it truly tells the community how important it is to continue service. He challenged the Council and citizens of the community to volunteer their efforts to bring needed service projects to fruition. Adrienne Andrews, Weber State University (WSU) Special Assistant to the President for Diversity, stated this joint proclamation demonstrates the collaboration between the City, the Council, WSU, and other community partners and organizations that together it is possible to achieve more. She stated she could not be happier to see the team that is the Ogden City community come together to celebrate the Reverend Dr. King. She noted she looks forward to continuing the partnership that has been formed. Steven Fairclough, African American Heritage Committee at Hill Air Force Base, stated this would be a wonderful time for the Base to partner with the City of Ogden to offer any efforts they have to further the cause of the joint proclamation. Betty Sawyer stated she is the Past President of the Ogden Branch of the NAACP and also the former Director of the Governor’s Office of Black Affairs, where she worked to establish the Martin Luther King Human Rights Commission many years ago. She mentioned this is a special time for her and it provides opportunities for all citizens to ‘pay it forward’ and continue to build upon the legacy of Dr. King. She stated she is also the Education Chair of Delta Sigma Beta Sorority, Inc., and today is founders’ day for that organization. Today they celebrate 100 years as a public service sorority and they are all about giving back to and building the community. She thanked the Council and stated she is proud and honored to be part of this day. Joseph Nicholas, Past President of the Ogden Branch of the NAACP, commented his tenure in office ended last night. He said he is pleased to see the cohesiveness displayed tonight and to witness this historic moment of recognition of the life and legacy of a great American and humanitarian – Dr. Martin Luther King. He stated that maybe in the future it will be possible for the NAACP to work with the City. He expressed his appreciation for the concern the City has given the NAACP and the recognition will be held in a special place. Approval of Minutes Council member Blair stated he had reviewed the minutes of the Work Session of December 9, 2014 and found them to be accurate to the best of his recollection. COUNCIL MEMBER GARNER THEN MOVED TO APPROVE THE MINUTES AS PRESENTED. MOTION WAS SECONDED BY COUNCIL MEMBER BLAIR, ALL VOTING AYE. Proposed Resolution 2015-2 adopting the 2014 Water Conservation Plan as required by Utah Code Section 73-10-32 A memo from the Public Services Department Director regarding the Ogden City Water Conservation Plan came before the Council for consideration. The memo stated the purpose of this action is to update the 2009 Water Conservation Plan. A Water Conservation Plan is required by the State of Utah and updates to the Plan are required every five years and must be voted upon by the agency's governing body. The 2014 Water Conservation Plan accounts for current efforts being used by Ogden City. It also outlines planned future efforts. The attached plan is the 3rd iteration of this plan, and is broken down into seven main sections. Each section contains information that provides background on the City's history with conservation and its plan going forward. These seven sections are: Introduction, History of Ogden's Water System, Description of Ogden and its Water System, Population Growth and Continual Water Conservation, Internal Conservation Measures, External Conservation Measures and Water Conservation Goals. A portion of the Plan contains an outline of ongoing measures, measures being developed and planned future measures. Many of these measures have been occurring for some time. The new Water Conservation Coordinator has helped speed along the development of these measures. The memo concluded by stating staff proposes that the City Council adopt the 2014 update of the Water Conservation Plan; there is no fiscal impact associated with such adoption. Chair Hyer then introduced in writing proposed Joint Resolution 2015-2, entitled: “A joint resolution of the Ogden City Mayor and the Ogden City Council adopting the 2014 Water Conservation Plan as required by Utah Code Section 73-10-32.” A copy of the proposed joint resolution was deposited with the Deputy City Recorder and ordered that the City Recorder have at least one copy available for public inspection in her office during all business hours. The proposed Joint Resolution was then read by long title. COUNCIL MEMBER BLAIR MOVED A PUBLIC HEARING ON THE PROPOSED JOINT RESOLUTION BE HELD IN THE CITY COUNCIL CHAMBERS ON JANUARY 27, 2015, DURING THE CITY COUNCIL MEETING TO BE HELD AT 6:00 P.M. AND THAT THE CITY RECORDER BE DIRECTED TO PROVIDE NOTICE AS REQUIRED BY LAW. MOTION WAS SECONDED BY COUNCIL MEMBER GARNER, ALL VOTING AYE. Proposed Ordinance 2015-1 amending Ogden Municipal Code Sections 2- 2-3 and 2-3-6 to authorize annual adjustments to salaries of the Mayor and City Council A memo from Council staff regarding elected officials’ salaries came before the Council for consideration. The memo provided a brief history of elected officials’ salaries as well as a summary of the recent benchmarking survey and noted the current proposal is to amend Ogden City Code Sections 2-2-3 and 2-3-6, relating to compensation for elected officials, to provide the same annual increases as the City’s non-merit special employees receive. This will include both merit and cost of living increases. The differential pay of two thousand dollars ($2,000) for the chair and one thousand dollars ($1,000) for the vice chair will continue. In addition, the proposed amendment includes a requirement that Mayoral and Council compensations be benchmarked periodically against Utah cities with the same form of government and adjusted appropriately. Recognizing that the current Council salaries are well below the current total compensation benchmark, it is anticipated that the benchmarking adjustments for Council salaries will occur gradually as budget constraints allow. Adjustments to compensation will occur through the regular budget process. To ensure transparency, the Mayor’s and Council members’ salaries will be disclosed in the staffing documents of all future budgets. Chief Deputy City Attorney Brown summarized the memo and stated the proposed ordinance would re-implement a system that was in place prior to 2011 whereby the Council and Mayor’s salaries were directly connected with any adjustments provided to other non-merit special employees in the City. In addition, the ordinance authorizes benchmarking increases that could be considered during the annual budget preparation process. She noted the Mayor’s and each Council member’s salary is below the average wage paid for like positions throughout the State of Utah. The proposed changes to salaries will not take place until the beginning of the next fiscal year if the ordinance is approved; the pay differential for the Chair and Vice Chair of the City Council will continue. Chair Hyer introduced in writing proposed Ordinance 2015-01, entitled: “An ordinance of Ogden City, Utah, amending the Ogden Municipal Code by amending Sections 2-2-3 and 2-3- 6 to authorize adjustments to salaries of the Mayor and City Council; and by providing that this ordinance shall become effective immediately upon posting after final passage.” A copy of the proposed ordinance was deposited with the Deputy City Recorder and ordered that the City Recorder have at least one copy available for public inspection in her office during all business hours. Chair Hyer then called for public input regarding the proposed ordinance. No persons came forward to be heard regarding this matter. ON A MOTION BY VICE CHAIR WHITE AND SECONDED BY COUNCIL MEMBER BLAIR, ORDINANCE WAS PASSED AND ADOPTED AS OGDEN CITY ORDINANCE 2015-1 AND ORDERED POSTED AS REQUIRED BY LAW UPON THE FOLLOWING ROLL CALL VOTE: VOTING AYE – COUNCIL MEMBERS BLAIR, GARNER, GOCHNOUR, STEPHENS, WICKS, VICE CHAIR WHITE, AND CHAIR HYER. VOTING NO – NONE. The Chair signed the ordinance as passed and adopted and the Chair’s signature was attested by the City Recorder. The authenticated ordinance was then filed with the City Recorder for transmittal to the Mayor for review and consideration. Mayor Comments Mayor Caldwell stated he appreciates the City Council’s consideration of elected officials’ salaries. He then provided a report regarding an event that took place where a vehicle was stolen with a three year old boy in the back seat. He was very impressed with the efforts taken by the City’s public safety personnel to reunite the boy with his family. He publicly recognized Lieutenant Scott, Sergeant Kowalski, Officer Smith, Officer Howard, Officer Cantwell, Officer Kagel, and Officer Richins. He stated he could not thank them enough for their efforts. Council member Comments Chair Hyer echoed Mayor Caldwell’s comments regarding the heroism of the City’s Police Officers and added that the three year old boy reacted remarkably as well. He followed Police Officer instructions exactly and contributed to his own rescue. Council member Wicks noted the moral of the story is one should not leave their car idling anywhere at any time. Vice Chair White stated it is great that the City chose to honor Dr. Martin Luther King by declaring a day of service. She stated it is not necessary for one to have a formal setting in which to volunteer or provide service; they can do something as small as helping their own neighbors. Council member Stephens agreed and stated it was nice to see unity in the community surrounding this issue. He also added that Dale Campbell will be greatly missed; he provided a greater quality of life in Ogden City.
