Minutes of Work Session of the Ogden City Landmarks Commission April 18, 2024 Page 1 Minutes of the Work Session of the Ogden City Landmarks Commission held on Thursday, April 18, 2024, at 5:08pm, in Room 310 and via electronic means on the third floor of the Municipal Building, 2549 Washington Boulevard, Ogden City, Weber County, Utah. Members Present: Mary McMillen, Chair Sarah Langsdon, Vice Chair Judy Mitchell Tom Moore Tony Pantone Mandy Shale Carver Shaw Sue Wilkerson Members Excused: James Wilson Staff Present: Barton Brierley, Planning Manager Haylie Hale, Planner Marqae Martinson, Administrative Assistant II James Tanner, Assistant City Attorney (via zoom) Policy Enforcement: Ms. Hale explained that the Landmarks Ordinance gave the Building Official the power to enforce the code and suggested that it be considered to change that to the Building Services Manager with the code update, in revision. Commissioners and staff discussed penalty options including: a fine for each day the property is not brought into compliance; withholding building permits or business licenses; a higher fee schedule; and liens. Discussion continued regarding timeframes and prices for fines being issued and if daily fines could currently be issued for noncompliance. Mr. Tanner responded that the code allows for each day to be treated as a separate violation after an initial 14 days to comply. A comment was added to require Certificates of Historic Appropriateness to be displayed within view while work is being done. Commissioner Moore suggested signage to bring awareness to historic properties and districts. Design options, placement, and cost were discussed among the Commission. Commissioner Pantone asked what triggers a project to go through the Landmarks Commission. Mr. Brierley responded that many are caught through the building permit process while others are sent in through Code Services. The commission discussed the process for working with Code Services when properties are in noncompliance. The roof replacement of the Eccles Art Center and how the process can be improved in the future to ensure that the work is completed properly was discussed. Ideas included: displaying the Certificate of Historic Appropriateness, listing how the work should be complete; including a building inspector in the process; and adding a statement, noting any deviation and violations, to the Certificate. Mr. Tanner added that the responsibility to ensure that the work is completed properly lies with the property owner. Commissioner Wilkerson requested that samples be included again with all applications. Discussion continued regarding whether a contractor should be able to apply for a Certificate of Historic Appropriateness, or if it should only be the property owner. Mr. Tanner indicated that there should be a signed acknowledgement by the property owner that they understand the ramifications and must comply with the Commission’s conditions and approval.
