BEGIN TELEVISED SESSION – 7:00 P. M. 3. PLEDGE OF ALLEGIANCE 4. SPECIAL BUSINESS A. Proclamation recognizing September 24-30 as Family Week in Olathe. Mayor Bacon presented the proclamation to Jaymi Schap, Johnson County Community Prevention Coordinator and CTC member. Ms. Schap shared more information about Family Week and invited everyone to participate. B. Proclamation recognizing October 14, 2023 as Jared Coones Memorial Pumpkin Run Day. Mayor Bacon presented the proclamation to Tom Coones. Mr. Coones thanked the Mayor for the recognition and invited everyone to join the Jared Coones Pumpkin Run this year. 5. CONSENT AGENDA Approval of the Consent Agenda Motion by Gilmore, seconded by McCoy to approve the Consent Agenda. Consideration of a Real Estate Contract between the City of Olathe, Kansas and the Board of County Commissioners of Johnson County, Kansas, for the sale of land for the Black Bob Road, 159th to 167th, Improvements Project, PN 3-C-008-22, authorizing the Mayor to sign the Real Estate Contract, and further authorizing the City Attorney or designee to execute the closing documents. approved. E. Consideration of award of contract to TurnKey Mobile for Panasonic tablets for use by Fire Department Mobile Fleet. approved. F. Consideration of a one-year lease agreement for five (5) Caterpillar Skid Steer Loaders for the Streets and Stormwater Divisions. approved. 6. NEW BUSINESS A. Consideration of Ordinance No. 23-22 authorizing issuance of the City's taxable industrial revenue bonds in an amount not to exceed $62,000,000 for AP Multifamily Investors, LLC for the construction of 303 multi-family units on 17.4 acres at the northwest corner of Black Bob Road and Indian Creek Parkway. Motion by Gilmore, seconded by McCoy, to approve Ordinance No. 23-22. The motion carried with the following vote: Yes: McCoy, Bacon, Gilmore, Felter, and Essex No: Mickelson Absent: Vogt B. Consideration of Ordinance No. 23-23 authorizing issuance of the City's taxable industrial revenue bonds in an amount not to exceed $48,850,000 for Scannell Properties #634, LLC for the construction of an approximately 567,840 square foot industrial building in the I-35 Logistics Park development. Motion by Gilmore, seconded by McCoy, to approve Ordinance No. 23-23. Consideration of Ordinance No. 23-24 authorizing issuance of the City's taxable industrial revenue bonds in an amount not to exceed $13,400,000 to ArcBest Property Management, LLC for construction of a 28,330 square foot office, warehouse, distribution, and truck terminal facility at the Olathe Commerce Park on Pine and Dennis. Councilmember McCoy said he was glad that this property was being developed and creating new jobs. Motion by Gilmore, seconded by McCoy, to approve Ordinance No. 23-24. The motion carried with the following vote: Yes: Mickelson, McCoy, Bacon, Gilmore, Felter, and Essex Absent: Vogt 7. NEW CITY COUNCIL BUSINESS Councilmember McCoy thanked staff for all they did to assist Old Settlers. Councilmember Felter reminded citizens about National Hispanic month. She invited everyone to attend the groundbreaking for the new football stadium at MNU. Ms. Felter also invited everyone to come out to the next Olathe Live concert. She pointed out the newly painted mural at the Olathe Community Center and reminded citizens about the upcoming art fair on October 6 and 7. She said the NAACP banquet she attended was fantastic. She congratulated Taylor Bussinger, an Olathe teacher, for being a finalist for Kansas teacher of the year award. She also thanked Leadership Olathe for their work at the YMCA. Mayor Bacon invited everyone to attend the Olathe Live concert on September 29 and said veterans and Gold Star families would be recognized. 8. END OF TELEVISED SESSION 9. GENERAL ISSUES AND CONCERNS OF CITIZENS Persons wanting to speak regarding a general concern must sign up no later than 30 minutes prior to the beginning of the City Council meeting. A person may sign up by notifying the City Clerk by calling 913-971-8521, emailing CCO@Olatheks.gov or in person at City Hall. The Council has allocated up to 3 minutes per speaker, and up to 30 minutes total for this portion of the meeting. Rita Luetkemeyer, 1008 S. Cedar Hills Drive, shared a concern about an AirBNB in her neighborhood. Bridgette Moore, 1305 N. Leeview Drive, asked for sign language interpreters to be present at council meetings. Page 3 of 5 City Council Meeting Minutes September 19, 2023 Kathy Winters, 605 S. Valley Road, spoke about increasing property taxes. 10. CONVENE FOR PLANNING SESSION If report items are present, they have been prepared for informational purposes and will be accepted as presented. There will be no separate discussion unless a Councilmember requests that a report be removed and considered separately. A. REPORTS 1. Report on a request for annexation of approximately 130.94 acres, located southwest of 159th Street and Black Bob Road (ANX23-0001). Mayor Bacon had a question about the zoning on this property and Chet Belcher, Chief Community Development Officer, said it would be rezoned when it was annexed. B. DISCUSSION ITEMS 1. Quality of Life Focus Area Update. (20 min) Director of Quality of Life, Mike Sirna, gave an update on the department. Todd Kuhn, Community Enhancement Officer, shared about the new communication boards that will soon be installed at various City locations. Councilmember McCoy said he hoped there would be continued vision for affordable housing. Councilmember Felter asked if the auto strike would have any effect on the book mobile delivery date and Mr. Sirna said it shouldn't. Ms. Felter also asked about the tree grant and Mr. Sirna said it is a reimbursement program. Ms. Felter also said she loved the collaboration with the school district. Mayor Bacon asked about where the communication signs would be placed. Mr. Kuhn said the first one would be at the Olathe Community Center and eventually they hoped to have them at all parks and pools. 11. EXECUTIVE SESSION Consideration of motion to recess into an executive session to discuss the following items: Page 4 of 5 City Council Meeting Minutes September 19, 2023 A. Preliminary discussions regarding the acquisition of real property pursuant to the exception provided in K.S.A. 75-4319(b)(6) pertaining to the acquisition of certain real property in downtown Olathe. Motion by Gilmore, seconded by McCoy to recess into executive session for preliminary discussion regarding the acquisition of real property pursuant to the exception provided in K.S.A. 75-4319(b)(6) pertaining to the acquisition of real property in downtown Olathe for 15 minutes and returning to Council Chambers at 8:18 PM. The motion carried with the following vote: Yes: Mickelson, McCoy, Bacon, Gilmore, Felter, and Essex Absent: Vogt 12. RECONVENE FROM EXECUTIVE SESSION Motion by Gilmore, seconded by McCoy to authorize the City Attorney to finalize, and the Mayor to execute, a real estate contract for the acquisition of 120 E. Park Street. The motion carried with the following vote: Yes: Mickelson, McCoy, Bacon, Gilmore, Felter, and Essex Absent: Vogt 13. ADDITIONAL ITEMS Councilmember McCoy reminded everyone about the Taste of Literacy event on Saturday evening. Mayor Bacon asked if this Friday was again a Fourth Friday event and City Manager, Michael WIlkes, said it was. 14. ADJOURNMENT The meeting was adjourned at 8:20 PM. Brenda D.
