CALL TO ORDER Present: Mickelson, McCoy, Bacon, Vogt, Gilmore, Felter, and Essex Others in attendance were City Manager, Michael Wilkes, Deputy City Manager, Susan Sherman, and City Attorney, Ron Shaver. 2. EXECUTIVE SESSION Consideration of motion to recess into an executive session to discuss the following items: A. Preliminary discussion regarding the acquisition of real property pursuant to the exception provided in K.S.A. 75-4319(b)(6) pertaining to certain real property in northwest Olathe. Motion by Gilmore, seconded by Vogt to recess into an executive session preliminary discussion regarding the acquisition of real property pursuant to the exception provided in K.S.A. 75-4319(b)(6) pertaining to certain real property in northwest Olathe for 15 minutes, returning to the Council Chamber at 6:01 PM. Proclamation recognizing Nov. 11, 2023 as Veterans Day Page 1 of 4 City Council Meeting Minutes November 7, 2023 Mayor Bacon read and presented the proclamation to Commander Mike Harris of the American Legion Post 153. Commander Harris thanked the mayor and council for the proclamation. 8. CONSENT AGENDA Motion by Gilmore, seconded by Vogt to approve the consent agenda as presented. The motion carried with the following vote: Yes: Mickelson, McCoy, Bacon, Vogt, Gilmore, Felter, and Essex A. Consideration of approval of the City Council meeting minutes for the October 17, 2023 meeting. Approved B. Consideration of renewal drinking establishment applications. Approved C. Consideration of cereal malt beverage applications for calendar year 2024. Approved D. Consideration of a Travel Request Authorization for City Manager Michael Wilkes to travel to Topeka, Kansas, to attend a League of Kansas Municipalities meeting from December 7 to the 8th. Approved E. Consideration of Business Expense Statement for City Manager Michael Wilkes who attended a League of Kansas Municipalities meeting in Wichita on October 7-9. Approved F. Consideration of Resolution No. 23-1070 re-authorizing the ordering of vehicles for 2023 City-wide fleet replacements. Approved G. Request for the acceptance of the dedication of land for public easements for a final plat of Black Bob 151st Shops, Third Plat (FP23-0024), containing two (2) lots on approximately 7.03 acres; located at southwest of W. 151st Street and S. Black Bob Road. Planning Commission approved plat 6 to 0. Approved H. Consideration of Consent Calendar. Approved Page 2 of 4 City Council Meeting Minutes November 7, 2023 I. Consideration of renewal of contract with 911 Custom, LLC for emergency vehicle equipment. Approved 9. NEW BUSINESS A. Consideration of Ordinance No. 23-29 amending Chapter 6.06 of the Olathe Municipal Code (Environmental Quality) pertaining to summary and accelerated abatement of accumulated rubbish and garbage. Motion by Gilmore, seconded by Vogt, to approve Ordinance 23-29 as presented. The motion carried with the following vote: Yes: Mickelson, McCoy, Bacon, Vogt, Gilmore, Felter, and Essex 10. NEW CITY COUNCIL BUSINESS Councilmember Essex gave praise to the city's snow and ice operations, who were ranked #1 nationally by ETC. Ms. Essex also mentioned a million dollar Urban and Community Forrest Grant the city received from the USDA and noted Olathe was one of only two cities in Kansas to receive the grant. She also congratulated Sergeant John Moncayo, who was named AAA Kansas Drug Recognition Expert of the Year. Councilmember Felter stated the Olathe Honor Guard was amazing at the Chiefs game. Ms. Felter also noted city employee Ryan Arter, stopped to check on an individual who was on the ground and called emergency personnel to assist the individual. She also thanked the Johnson County Elections Office for their hard work during the election and to the individual candidates who put their names out there for seats. Councilmember McCoy noted the Trick or Treat on the Trail event at the Olathe Community Center was well received. He also mentioned the Community Prayer Breakfast scheduled for Friday, November 10th and thanked veterans for their service. Councilmember Vogt applauded all staff members because she recently attended a community event where there were there were no concerns from the citizens on how the city operates when she asked. She also thanked Planning and Development Manager, Kim Hollingsworth and City Engineer, Nate Baldwin, for their help on a recent neighborhood meeting on development and traffic issues. She thanked veterans for their service and wished candidates good luck Page 3 of 4 City Council Meeting Minutes November 7, 2023 in the election as well. Councilmember Mickelson thanked the veterans for their service. Mayor Bacon invited the public to the 2023 Veterans Day observance on November 10th. 11. END OF TELEVISED SESSION 12. GENERAL ISSUES AND CONCERNS OF CITIZENS Persons wanting to speak regarding a general concern must sign up no later than 30 minutes prior to the beginning of the City Council meeting. A person may sign up by notifying the City Clerk by calling 913-971-8521, emailing CCO@Olatheks.gov or in person at City Hall. The Council has allocated up to 3 minutes per speaker, and up to 30 minutes total for this portion of the meeting. Gail Shriver, 19592 W 121st Ct., spoke against the Woodland Rd. railroad crossing. 13. CONVENE FOR PLANNING SESSION If report items are present, they have been prepared for informational purposes and will be accepted as presented. There will be no separate discussion unless a Councilmember requests that a report be removed and considered separately. A. REPORTS 1. Report on a request for annexation of approximately 95.63 acres, located north of 167th Street and west of I-35 (ANX23-0002). Report Accepted 14.
