COMMUNICATIONS FROM THE MAYOR Special Proclamation for Manufacturing Month 2025 Mayor Aiello explained he is pleased to announce the Office of Community Oriented Policing Services (COPS) has approved an application submitted by the City of Olean for award under the fiscal year 2025 COPS hiring program in the amount of $2,015,424. He explained this funding will enable the City to hire six additional police officers, one of whom must be a veteran. He explained this covers the cost of salaries and fringe benefits for a three year period. He thanked Chief Richardson for putting this together and explained this will really play off. He explained the program period is October 1, 2025 through September 30, 2030 so we have five years to complete this. He explained this is for six new officers, which is a wonderful thing. He explained we also have two new officers, Patrolman Barr and Patrolman Renault who successfully graduated from the Alfred Police Academy on October 24, 2025 and are currently training with other officers here in the City. Mayor Aiello explained he has provided the Aldermen with a map of the catch basins that are being monitored for I&I, and explained this list will be put on the website tomorrow. He explained there are nine places being monitored and this is being done as a part of the $500,000 grant from the DEC. He explained there was a scheduled meeting with the taskforce today, and at the last minute President Seneca was called away for another matter so it will be rescheduled. ROLL CALL, AYES ALL. MOTION CARRIED. Mayor Aiello explained he provided the Council information on this. He explained he is taking this action for several reasons. He explained the City has financially invested int his project and the majority of our North Union Street merchants and businesses would like to see the project through to completion. The addition of the festive lights are in line with our Downtown Revitalization Initiative to make Olean’s business district vibrant and inviting. One Alderman, who was on site during testing, suggesting that due diligence on the testing was not completed. Finally, the Common Council has not given the Department of Public Works the opportunity to come up with a plan for the lighting and the current lights might be salvageable in the future. Alderman Robinson explained he understands why the Mayor would disapprove of the resolution, but for him, it just seems to be a huge waste of time and energy. He asked to look at the facts on the topic. First, we are talking about keeping a string of Christmas lights that look as if they were bought at Home Depot and use makeshift equipment, at a cost that we still don’t know, and to get these lights to run with no guarantees and no warranty. The reluctance from our own City Electrician and DPW Director were both heard by the Council via email and in committees. The irony is that the Council is constantly told that we don’t listen to the department heads. He explained they have spoken, and the Council listened. He explained in the Mayor’s “Notice of Disapproval” letter, it states that the Common Council has not given DPW the opportunity to come up with a plan for the lighting. Coincidentally, three weeks had gone by since the Council’s request for an alternative. In contract, the City managed to have six PL’s on our agenda with no prior conversation. He explained this has been pending litigation for so long, the Council has lost track from sporadic information on a now “failed” project, but he believes it started in 2022. On August 12, 2025, to save face from the project, a PL was presented for removal of the lights. It was mentioned that the downtown business owners are now starting to consider this an eyesore. September 9, 2025 was the third time postponing while waiting for testing that started sometime in July. September 23, 2025 it was mentioned that there were five of the 17 lights that didn’t work, there were quality issues with the equipment, and it appears the lights were residential grade and not designed for what was promised. This is the same night the Council requested the City to look into alternative commercial grated lighting, and the DPW Director mentioned an RFP may be needed. On October 7, 2025, the Council was informed the City was still working on an alternative solution. On October 14, 2025, Resolution #85- 25 was passed to remove the old lights. The Council stated again, which seemed unanimous, that we wanted the City to work on an alternative solution as everyone on this Council is interested in decorative lighting on North Union Street. It was also mentioned on numerous occasions in our discussions that this one was a bad investment and we’re looking to acknowledge that and move forward. Regardless of this veto passing or failing, too much time has been spent on this failed project and here we are voting again. As far as he’s concerned, this Council requested a solution to alternative lighting, which should’ve been the priority dating back to September 23rd, when the Council made the recorded request. Instead, ten days were spent drafting a veto letter.  Journal of Proceedings OF THE COMMON COUNCIL OF THE CITY OF OLEAN, N.Y. October 28, 2025 Rhetorical question, what is the current status of the Council’s request from September 23rd? With that, if the Council is voting no, they are voting to keep the same non- commercial lighting, adding more money, and guess-work equipment, with the hopes that it will work with no warranty. Alderman Anastasia explained in an email on October 11th from Director Sprague, he explained he had spoken to a lighting vendor at NYCOM that could help solve our issues. Alderman McCall explained that was for the LED lighting on the poles themselves, not for this decorative lighting. Alderman Bennion explained he had asked about changing the streetlights, and Director Sprague explained that email refers to the pedestrian lighting that was to be on the back of the poles facing the sidewalk, as well as to brighten the heads on the current streetlights. Alderman Anastasia asked about the lights being repairable, and Director Sprague explained they are like Christmas lights and if a bulb is blown, then the whole string is down. He explained the control we have is not rated for outdoor use. He explained they can be made to work, but the question is how long they would work and explained we do not have a warranty. Alderman Anastasia asked if Director Sprague thinks these should be taken down. Director Sprague explained they should be taken down, and a new design should be done. He explained we first need to address the lack of lighting on the street with the regular streetlights and the lights on the back of them for the sidewalk, as those were eliminated when the project was done. He explained the decorative lighting is just decorative. Alderman McCall explained she would question what business owners want to continue with these lights, as the ones she has spoken with only want the lights if they work. She explained she has faith in the City Electrician and DPW Director that have given us direction. She explained one figure the Council was given was $12,000 and with so many other things the City needs, it doesn’t make sense. She explained she feels City residents deserve to have lights that work with warranty to ensure they will work long- term. She explained she doesn’t know if we have pending litigation, and explained there is probably some information the Council is lacking about this whole situation. She explained this doesn’t seem like it was a project that was going to be successful from the beginning. She explained the residents and businesses deserve more than us utilizing equipment that doesn’t work and that may not work in the future. She explained she thinks we need to rely on the people who have more knowledge than she does, and we should take the lights down and go forward to find something that works. She explained we need to improve the street lighting first and foremost to make the street safer, as safety is more important than decorative lighting. Director Sprague explained the vendor he spoke with can do the string lighting also, although the street lighting is his main line of business. He explained he does street lighting all the time and is confident he can fix our issues. Alderman Bennion explained he hopes this is the last time we resurrect this horse that we keep beating to death. He explained this was brought up in early 2023, and in June 2024 and update was asked for. He explained this update stated the electrical division was very busy and was working on the controls designed to go into the poles since what we had didn’t fit and new bases needed to be constructed. He explained it seemed like a plan then, but it did not come to fruition. He explained the Council kept asking for updates and it kept getting pushed out. When people say the Council is laughable, this is the reason why. The City Electrician and DPW Director have expertise and we need to listen to them. He explained we don’t want to continue to put money into something that is broken and might not be fixed, that has no warranty.  Journal of Proceedings OF THE COMMON COUNCIL OF THE CITY OF OLEAN, N.Y. October 28, 2025 Alderman Crawford explained he does see this as a key feature of the downtown and he would like to see if we can update the current installation and, if not possible, install an entire new setup. He explained he feels this request is very straightforward. He explained like the delayed lighting at Forness Park, this is a fiasco. He explained he feels the most efficient way, when talking about efficiencies, is to do everything at once, whether we remove the lights, retrofit them, or replace them rather than to dismantle them now and hopefully replace them later. He explained his biggest concern, although he agrees with what most have said, these are a part of the vision but he is concerned if they come down nothing else will be put back up. Alderman McCall explained we would not be going out of our way to pull them down as they would be taken down when other Christmas lights are being put up. There would be no added expense to take them down. She explained she does agree that historically things get lost, but she doesn’t think leaving them up as a visual reminder of a failed project will encourage the City to anything faster. She explained we need to make sure that this moves forward and stays on our radar, as well as finding better lighting for the streets and pedestrians. Alderman Crawford explained we do have a small electrical division and have the best intentions trying to stretch taxpayer money doing things internally with larger projects, but that may not be the best way. AND THE CITY OF OLEAN FOR THE DESIGN PORTION OF THE SECURITY GATE IMPROVEMENTS PROJECT AT THE CATTARAUGUS COUNTY – OLEAN AIRPORT WHEREAS, C&S Companies has presented a proposal for required services for the Design portion of the Security Gate Improvements Project at the Cattaraugus County – Olean Airport with grant assistance from the Federal Aviation Administration (FAA) Airport Improvement Program (AIP) and the New York State Department of Transportation (NYSDOT); and WHEREAS, the proposal includes required services to design the Security Gate Improvements Project, which consists of the removal and replacement of the existing security gates adjacent to the terminal building that provides primary access to the airfield/apron, and includes an AOA slide gate and pedestrian gate, replacing the slide gate and including a mechanical gate operator that will be in conjunction with gate loops and keypads/access readers, and requiring electrical and communication utilities to provide power and fiber optic connectivity; and WHEREAS, C&S Companies shall also assist the City of Olean in the preparation of paperwork required to secure funds from the FAA and NYSDOT for the Project; NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Olean authorizes the Mayor to execute a Lump Sum Consultant Agreement with C&S Companies for the design portion of the Security Gate Improvements Project at the Cattaraugus County – Olean Airport. October 28, 2025 WHEREAS, C&S Companies has presented a proposal for required services for the Design portion of the Automated Weather Observing System (AWOS) Project at the Cattaraugus County – Olean Airport with grant assistance from the Federal Aviation Administration (FAA) Airport Improvement Program (AIP) and the New York State Department of Transportation (NYSDOT); and WHEREAS, the proposal includes required services to design the Automated Weather Observing System (AWOS) Project, which consists of the removal of the current Automated Weather Observing System (AWOS) which was installed in 1999 and has exceeded its useful life of 15 years, and replacing with an AWOS III P/T system in the same location; and WHEREAS, C&S Companies shall also assist the City of Olean in the preparation of paperwork required to secure funds from the FAA and NYSDOT for the Project; NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Olean authorizes the Mayor to execute a Lump Sum Consultant Agreement with C&S Companies for the design portion of the Automated Weather Observing System (AWOS) Project at the Cattaraugus County – Olean Airport. AND THE CITY OF OLEAN FOR THE DESIGN PORTION OF THE TERMINAL BUILDING SEPTIC IMPROVEMENTS PROJECT AT THE CATTARAUGUS COUNTY – OLEAN AIRPORT WHEREAS, C&S Companies has presented a proposal for required services for the Design portion of the Terminal Building Septic Improvements Project at the Cattaraugus County – Olean Airport with grant assistance from the Federal Aviation Administration (FAA) Airport Improvement Program (AIP) and the New York State Department of Transportation (NYSDOT); and WHEREAS, the proposal includes required services to design the Terminal Building Septic Improvements Project, which consists of the decommissioning of the existing septic tank and existing leach field, installation of new septic tank sized appropriately to accommodate the average flow rates currently experienced at the airport terminal, and installation of an appropriate leach field based on soil data testing that may require the implementation of a raised sand filter bed; and WHEREAS, C&S Companies shall also assist the City of Olean in the preparation of paperwork required to secure funds from the FAA and NYSDOT for the Project; NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Olean authorizes the Mayor to execute a Lump Sum Consultant Agreement with C&S Companies for the design portion of the Terminal Building Septic Improvements Project at the Cattaraugus County – Olean Airport. AND THE CITY OF OLEAN FOR THE CONSTRUCTION INSPECTION PORTION OF THE AUTOMOBILE PARKING AND LIGHTING IMPROVEMENTS PROJECT AT THE CATTARAUGUS COUNTY – OLEAN AIRPORT WHEREAS, C&S Companies has presented a proposal for required services for the Construction Inspection portion of the Automobile Parking and Lighting Improvements Project at the Cattaraugus County – Olean Airport with grant assistance from the Federal Aviation Administration (FAA) Airport Improvement Program (AIP) and the New York State Department of Transportation (NYSDOT); and WHEREAS, the proposal includes required construction inspection services for the Automobile Parking and Lighting Improvements Project, which consists of the construction of approximately 20,000 square feet of the automobile parking that abuts the terminal building, milling the existing bituminous concrete surface, placement of a truing and levelling bituminous concrete course followed by a nominal 2-inch bituminous overlay, ancillary drainage improvements and minor turf grading, sidewalk and parking spaces closest to the building being brought up to ADA standards for handicapped accessibility, as well as lighting improvements that include new lighting fixtures installed on the existing terminal building to illuminate the public automobile parking area; and WHEREAS, C&S Companies shall also assist the City of Olean in the preparation of paperwork required to secure funds from the FAA and NYSDOT for the Project; NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Olean authorizes the Mayor to execute a Cost Plus Fixed Fee Consultant Agreement with C&S Companies for the Construction Inspection portion of the Automobile Parking and Lighting Improvements Project at the Cattaraugus County – Olean Airport. RESOLUTION #118-25 PL #122-25 By Alderman Crawford, Seconded by Alderman Keary TO REQUIRE THE DEPARTMENT OF PUBLIC WORKS REQUEST AN EXTENSION FOR GRANT FUNDING ASSOCIATED WITH THE EV CHARGING STATION PROJECT, TO REQUIRE A TIMELINE, UPDATED WORK PLAN, AND BUDGET BE PRESENTED TO THE COMMON COUNCIL, AND TO AUTHORIZE AND DIRECT THE DIRECTOR OF PUBLIC WORKS TO CONTACT NATIONAL GRID REGARDING GRANT FUNDING FOR RUNNING ELECTRIC SUPPLY LINES TO THE EV CHARGING STATION LOCATIONS WHEREAS, the City of Olean received grant funding through the New York State Department of Environmental Conservation for costs associated with the physical units and infrastructure installations of electric car charging stations in City of Olean public parking areas, Grant DEC01-ZEVIN-2022-00267 for $250,855 and Grant DEC01- ZEVIN-2022-00278 for $248,355; and WHEREAS, the grant contracts have expired and require extension requests to be submitted in order to proceed with the project utilizing said grant funding; and WHEREAS, the Common Council desires to evaluate the timeline, updated work plan and budget for said project; and WHEREAS, additional grant funding for said project may be available to the City of Olean through National Grid to fund running the electrical supply lines to the EV Charging Station locations; BE IT RESOLVED, that the Common Council requires the Department of Public Works request an extension for grant funding associated with the EV Charging Station Project by November 15, 2025, to require a timeline, updated work plan, and budget be presented to the Common Council by November 18, 2025, and to authorize and direct the Director of Public Works to contact National Grid regarding grant funding for running electric supply lines to the EV Charging Station locations, with report back on possible National Grid grant opportunities to be made to the Common Council by December 2, 2025. RESOLUTION #119-25 PL #123-25 By Alderman McCall, Seconded by Alderman Keary TO AUTHORIZE THE MAYOR TO SIGN AND SUBMIT A GRANT APPLICATION TO THE DEPARTMENT OF HOMELAND SECURITY AND EMERGENCY SERVICES STATE AND LOCAL CYBERSECURITY GRANT PROGRAM WHEREAS, as part of the Infrastructure Investment and Jobs Act (IIJA) of 2021, Congress established the State and Local Cybersecurity Improvement Act, which  Journal of Proceedings OF THE COMMON COUNCIL OF THE CITY OF OLEAN, N.Y. October 28, 2025 established the State and Local Cybersecurity Grant Program (SLCGP) administered by the United States Department of Homeland Security through the Federal Emergency Management Agency (FEMA) and the federal Cybersecurity and Infrastructure Security Agency (CISA); and WHEREAS, the State and Local Cybersecurity Grant Program (SLCGP) is aimed at strengthening cybersecurity practices and the resilience of state, local, and territorial (SLT)( governments; and WHEREAS, the safe and secure functioning of our economy, critical infrastructure, and government services depends on our ability to protect digital infrastructure and sensitive information and as global cyberattacks increase in both frequency and sophistication, fueled in part by the professionalization of the global cybercrime industry, we must raise the bar for what is necessary to successfully defend systems and networks; and WHEREAS, cybersecurity attacks remain one of the most critical threats to our residents, businesses, and infrastructure; and WHEREAS, NYS Department of Homeland Security and Emergency Services, in collaboration with the statewide Cybersecurity Planning Committee has determined that deploying secure Multi-Factor Authentication (MFA) to essential systems is the primary need for entities to advance their cybersecurity maturity, and which is a foundational best practice that is the cornerstone of ensuring that information systems are appropriately secured, and the integrity of end-users is preserved; and WHEREAS, through the State and Local Cybersecurity Grant Program (SLCGP), New York State will award successful applicants a shared service offering in the form of secure hardware authentication tokens to implement Multi-Factor Authentication (MFA); NOW, THEREFORE, BE IT RESOLVED, that the Common Council authorizes the Mayor to sign and submit a grant application to the Department of Homeland Security and Emergency Services State and Local Cybersecurity Grant Program for a shared service offering in the form of secure hardware authentication tokens to implement Multi-Factor Authentication (MFA). PUBLIC COMMENT Alderman McCall explained she wants to thank all of the businesses that supported kids int eh community at the Trick or Treating event at the shops on Union Street, as well as some on East and West State Streets. She explained there were 100 kids that attended, if not more. She explained the hope is to make this an annual event. Alderman Robinson explained he would like the City to do what it did during COVID and give away candy in Lincoln Park for Halloween. He explained he enjoyed dressing up and handing our candy, and he did not even dress up when he took his own kids out trick-or-treating when they were young. Rebecca Price of 126 Arland Avenue thanked Alderman Bennion for finally getting her handicapped sidewalk issue taken care of. She explained he kept in contact with her and emailed her, and she wants to thank him for helping to get it done. Glen Wahl of Little Valley asked why anyone up for reelection would be so ineffective in taking a month to get an updated Order on Consent placed on the City website. He thanked the Mayor for giving more information on the I&I issues at the meeting tonight. He explained there is a lot that could have been done and been done sooner, and if the City would have moved faster they would have likely not been fined by the DEC.
