ROLL CALL Present: 7- Mayor Stephen H. Buxbaum, Mayor Pro Tem Nathaniel Jones, Councilmember Julie Hankins, Councilmember Jim Cooper, Councilmember Jeannine Roe, Councilmember Karen Rogers and Councilmember Steve Langer 1.A ANNOUNCEMENTS Mayor Buxbaum noted the General Government Committee met earlier this evening. He also stated there is not a business meeting next week, and, therefore, no public communications will be taken. 1.B APPROVAL OF AGENDA Mayor Buxbaum noted there is a request to add an item under Special Recognition to recognize the Neighborhood Graffiti Busters Program. Councilmember Langer moved, seconded by Mayor Pro Tem Jones, to approve the agenda as amended. The motion carried by the following vote: Aye: 7- Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Hankins, Councilmember Cooper, Councilmember Roe, Councilmember Rogers and Councilmember Langer 2. SPECIAL RECOGNITION 2.A 12-0581 Neighborhood Graffiti Busters Program Police Department Senior Program Specialist Amy Stull recognized members of the "Neighborhood Graffiti Busters Program" and detailed work done by this volunteer group. The recognition was received. 3. PUBLIC COMMUNICATION Mr. Dana Walker, 1310 8th Ave. SE, spoke against corporate personhood. Mr. Jake Gamble, 618 Puget St NE, spoke in support of the Graffiti Busters, Amy Stull, and the work of all the volunteers. Councilmember Roe said the General Government Committee reviewed a resolution and she will provide a report later in the evening. 4. CONSENT CALENDAR 4.A 12-0564 Approval of August 21, 2012 Special Meeting to Hold a Study Session Minutes The minutes were adopted. 4.B 12-0570 Approval of September 11, 2012 City Council Meeting Minutes The minutes were adopted. 4.C 12-0537 Resolution Setting Petty Cash and Change Fund Amounts The resolution was adopted. SECOND READINGS 4.D 12-0500 Approve an Ordinance Amending OMC 2.100 to Change the Number of Planning Commission Members from Eleven to Nine The ordinance was adopted on second reading. FIRST READINGS 4.E 12-0532 Amendment to 2012 Capital Budget Ordinance The ordinance was approved on first reading and moved to second reading on the October 2 agenda. 4.F 12-0534 Agenda Item: Amendment to 2012 Capital Budget Ordinance The ordinance was approved on first reading and moved to second reading on the October 2 agenda. 4.G 12-0535 Amendment to 2012 Operating Budget Ordinance The ordinance was approved on first reading and moved to second reading on the October 2 agenda. The motion carried by the following vote: Aye: 7- Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Hankins, Councilmember Cooper, Councilmember Roe, Councilmember Rogers and Councilmember Langer 5. PUBLIC HEARING 5.A 12-0510 Ordinance Granting a Telecommunications Master Permit to Electric Lightwave LLC (Integra Holdings) City Building Official, Tom Hill, provided background on this issue. The public hearing was opened. No one signed up to speak. The public hearing was closed. Councilmember Langer moved, seconded by Councilmember Cooper, to direct staff to finalize the draft ordinance granting a telecommunications master permit to Integra Holdings for first reading on the October 2 agenda. The motion carried by the following vote: Aye: 7- Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Hankins, Councilmember Cooper, Councilmember Roe, Councilmember Rogers and Councilmember Langer 6. OTHER BUSINESS 6.A 12-0520 Amend Title 4.44 and 4.50 of the Olympia Municipal Code relating to Uniform Civil Enforcement to have higher civil infraction penalties for repeat code violators City Building Official Tom Hill stated the Coalition of Neighborhood Associations has worked with City staff to bring forward this amendment to the ordinance. Deputy City Attorney Darren Nienaber clarified the changes to this amendment. Council Discussion: - Consider raising the fine for the first penalty. Council agreed to look at this in the future. - How does a person get a clean record? After 24 months, they are back to zero. - The intent of the neighborhoods was to increase the time frame from 12 to 24 months. - The penalties go with the entity not the property. Councilmember Cooper moved, seconded by Councilmember Rogers, to approve the ordinance on first reading and move it to second reading on the October 2 agenda. The motion carried by the following vote: Aye: 7- Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Hankins, Councilmember Cooper, Councilmember Roe, Councilmember Rogers and Councilmember Langer 6.B 12-0559 Approval of Graffiti Ordinance Senior Program Specialist Amy Stull reviewed the background of this issue. She encouraged people to call or email the Police Department when they see graffiti so police can document and take a picture of the graffiti to keep in a database in order to track similar markings. She noted that due to the reflectivity of street signs, individuals are not allowed to clean graffiti from the front of the signs. City Prosecutor Paul Wohl said the crime moves from a misdemeanor to a felony when the dollar amount for damages exceeds $750. He said in some circumstances, more than one incident of graffiti tagging may be combined, which could bump the crime up to a felony. Councilmember Langer moved, seconded by Councilmember Hankins, to amend the current ordinance and approve the creation of a separate ordinance to address illegal graffiti tagging on first reading and move it to second reading on the October 2 agenda. The motion carried by the following vote: Aye: 7- Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Hankins, Councilmember Cooper, Councilmember Roe, Councilmember Rogers and Councilmember Langer 6.C 12-0107 Oral Report - Olympia Criminal Justice System Briefing City Prosecutor Paul Wohl provided an overview of the criminal justice responsibilities and the criminal justice system process. Police Chief Ronnie Roberts reviewed how the police get involved and steps taken once an arrest is made. Mr. Wohl then reviewed the scope of responsibilities of the City Prosecutor's office. Municipal Court Judge Scott Ahlf provided an overview of the Municipal Court and services provided. He detailed the steps taken in the court process, reviewed the jail alternatives, and work crew programs. Interim Jail Manager Rick Anderson stated there are on average 43 people incarcerated and over 100 in custody each day. City of Olympia Page 4 City Council Meeting Minutes September 18, 2012 Mr. Wohl stated most domestic violence cases are misdemeanors. Mayor Buxbaum asked for clear data on mentally ill inmates so costs can be calculated. It was noted that a small number of people are committing a large number of crimes. The report was received. 7. CONTINUED PUBLIC COMMUNICATION - None 8. REPORTS AND REFERRALS 8.A COUNCIL INTERGOVERNMENTAL/COMMITTEE REPORTS AND REFERRALS Councilmember Langer reported highlights of the LOTT Clean Water Alliance Board meeting and noted they will meet again September 26. Councilmember Rogers reported she attended the Economic Development Council Business Resource Center meeting. Councilmember Cooper reported highlights of the Olympic Region Clean Air Authority Board meeting. He also reported on the Health and Human Service Planning Committee meeting. Councilmember Hankins reported she attended the Coalition of Neighborhood Associations (CNA) forum on the Boys and Girls Club. Mayor Pro Tem Jones reported he also attended the CNA Forum. He reported on highlights of the Thurston County Solid Waste Advisory Committee meeting. Councilmember Roe reported on highlights of the General Government Committee. She asked to schedule the Move to Amend item on the October 2 Consent Calendar. Council agreed. She noted there are new smart meters around town and said they are great and easy to use. Mayor Buxbaum reported he attended the Transportation Policy Board meeting and reported on highlights of the Finance Committee meeting. 8.B CITY MANAGER'S REPORT AND REFERRALS City Manager Steve Hall said the City has installed 36 smart meters around the City for a 90-day trial basis. He noted the City has received numerous requests for proclamations. Council agreed to send mayoral proclamations to Wolf Haven and Providence St. Peter Hospital and schedule the proclamation for Temple Beth Hatfilah's 75th Anniversary on a Council agenda. It was noted that next week's meetings will include the Transportation Benefit District meeting at 6:00 p.m. and a Study Session at 6:30 p.m. The next business meeting will be City of Olympia Page 5 City Council Meeting Minutes September 18, 2012 October 2. 9.
