Applications must be complete and submitted to the Department of Planning by 12:00 pm

If an approval is granted by the Historic Preservation Commission, no construction shall
commence until all required approvals are granted and permits obtained through the

Applicants whose property is located in a historic district must simultaneously file and
application with the Board of Architectural Review.
Applications requesting designation of landmark or historic district or donation of a façade
easement: If a positive recommendation from the HPC is received, the Village Board of
Trustees will take up the application and will hold a public hearing.

Guidance on landmark and historic district designation
The Board of Trustees of the Village of Ossining, New York, has declared that it is a public purpose
to ensure that Historical and Architectural Design Districts and Historic Landmarks be maintained
and preserved to promote their use for the education, pleasure and welfare of the citizens of the
Village of Ossining (the “Village”), New York, and others (excerpted from the Village Code).
In furtherance of this, and to respond to numerous inquiries from Village residents regarding
landmark and historic site designation, the Historic Preservation Commission publishes the
following guidance.
Benefits of landmark designation
Landmark designation offers benefits for property owners and the Village including:
• Protecting and preserving historically significant buildings, landscapes, and sites for
future generations by discouraging and preventing demolition and inappropriate
alterations. It is important to note that landmark designation does not necessarily
prevent alterations made to update a property’s characteristics to conform with modern
living and safety standards but instead helps ensure responsible and considerate
change, allowing for updates and renovations while respecting the original character of
a structure.
• Economic benefits to individuals and the Village can include tourism (leading to
increased revenue for local businesses); potentially higher property values (according to
the National Trust for Historic Preservation); and access to funding and grants (including
tax credits specifically designed to offset the costs of rehabilitation and maintenance).
• Community revitalization, investment, identity and pride.
• Sustainable development by promoting the reuse of existing structures, reducing waste,
and lessening the environmental impact of new construction.
Landmark designation occurs at three levels: federal, state, and local. The following sections
points readers to the available guidance on this.
State and national level
The website of the New York State Historic Preservation Office (https://parks.ny.gov/shop/)
provides extensive guidance on preservation programs, including listing on the State and
National Historic Registers and information about tax credits and grants. The opening
paragraphs of the home page of this website state the following:

“What are the State and National Registers?
The State and National Registers of Historic Places are the official lists of buildings,
structures, districts, objects, and sites significant in the history, architecture, archeology,
engineering, and culture of New York and the nation. The same eligibility criteria are
used for both the State and National Registers. The National Historic Preservation Act of
1966 and the New York State Historic Preservation Act of 1980 established the National
and State Registers programs. In New York, the Commissioner of the New York State
Office of Parks, Recreation and Historic Preservation, who is also the State Historic
Preservation Officer (SHPO), administers these programs.
What are the results of listing?
1. Registered properties and properties determined eligible for the Registers
receive a measure of protection from the effects of federal and/or state agency
sponsored, licensed or assisted projects through a notice, review, and
consultation process.
2. Owners of depreciable, certified historic properties may take a 20 percent federal
income tax credit for the costs of substantial rehabilitation as provided for under
the Tax Reform Act of 1986.
3. Municipal and not-for-profit owners of listed historic properties may apply for
matching state historic preservation grants.
There are no restrictions placed on private owners of registered properties. Private
property owners may sell, alter or dispose of their property as they wish.”

assistance available to guide applicants through the process; and information on tax credits and
grants to assist with preservation and maintenance of historic properties. The site also provides
a list of contacts from whom and from which individuals can obtain more information on
historic preservation and the historic designation process.
In addition to the State website referenced above, the website of the Preservation League of
New York State (https://www.preservenys.org) is a valuable resource for those seeking
information on historic preservation. The site contains a trove of information on historic house
preservation and restoration and many links to books, resources, and information on
restoration, applications for designation, and tax credits.
Local landmark and historic site designation
Village requirements and guidelines for historical and architectural design districts and historic
landmarks are presented in Section 270-25 of the Village Code (the “Code”, which is accessible
from the home page of the Village’s website).

The process for designation of an historic landmark or district in the Village is detailed in section
270.25c of the Code. This section describes the application procedure, what happens after an
application is made (including review by the Historic Preservation Commission and the Board of
Trustees). Included here is a list of some of the characteristics of a building, structure, parcel of
land or area that would make a building or area worthy of landmark or historic district
designation.
Individuals seeking further information on the village’s architectural design recommendation and
best practices should also consult the Village of Ossining Architectural Design Guidelines which
presents a wealth of information on Ossining’s architecture and guidance on the development
and preservation of structures in the Village. The Guidelines can be accessed in the left-hand
column of the Historic Preservation Commission’s page on the Village website.

Originally established in 1921 by William and Bessie Globerman, the Depot Square
Hotel served railway commuters and travelers visiting Ossining. In 1956, it was
purchased by Samuel and Mildred Buchanan, who operated it as a hotel and
restaurant for nearly 20 years. The Depo Square Hotel became a key landmark in
Ossining’s Black community, offering safe lodging during segregation and appearing
in The Negro Motorist Green-Book from 1959 to 1963. Located near the railroad and
Sing Sing Prison, it also served as a base for journalists covering major events in the
village, including the 1934 bus tragedy. The Buchanans later expanded their impact
by acquiring and managing multiple apartment buildings rented to Black families in
Ossining.
