Adoption of Local Law 7-2024, “A Local Law repealing Chapters 162, Article VI and Chapter 95 and adding a new Chapter 92” to the Village of Ossining Code. WHEREAS, the Board of Trustees of the Village of Ossining (“Village Board”) has been considering the adoption of proposed Local Law -2024, titled, “A Local Law repealing Chapter 162, article VI (Housing/Property Maintenance and Building Code Administration, Administration and Enforcement), repealing Chapter 95 (Buildings and Structures, Unsafe and Demolition of) and adding a new Chapter 92 (Building Construction and Fire Prevention Code Administration and Enforcement) to the Village of Ossining Code; and WHEREAS, a public hearing was conducted on June 18, 2024 at 7:30 pm at the Birdsall Fagan Police-Court Facility, 86-88 Spring Street, Ossining, New York and via the Zoom platform affording members of the public an opportunity to be heard; and WHEREAS, the public hearing was closed on June 18, 2024; and WHEREAS, there are no impediments to approving the proposed local law; now therefore be it RESOLVED, that the Board of Trustees of the Village of Ossining hereby adopts as Local Law 7-2024, A Local Law repealing chapter 162, article VI and chapter 95 and adding a new chapter 92 to the Village of Ossining Code; and be it further RESOLVED, that Local Law 7-2024 shall become effective upon filing with the Secretary of State pursuant to the Municipal Home Rule Law. Local Law -2024 (Chapter 92- Building Construction and Fire Prevention Code- Legislative Meeting July 17, 2024 Page 4 of 7  Administration) J. Adoption of Local Law 8-2024, “A Local Law adding chapter 205 (Rental Registry)” to the Village of Ossining Code. WHEREAS, the Board of Trustees of the Village of Ossining (“Village Board”) has been considering the adoption of proposed Local Law -2024, titled, “A Local Law adding chapter 205 (Rental Registry) to the Village of Ossining Code”; and WHEREAS, a public hearing was conducted on June 18, 2024 at 7:30 pm at the Birdsall Fagan Police-Court Facility, 86-88 Spring Street, Ossining, New York and via the Zoom platform affording members of the public an opportunity to be heard; and WHEREAS, the public hearing was closed on June 18, 2024; and WHEREAS, there are no impediments to approving the proposed local law; now therefore be it RESOLVED, that the Board of Trustees of the Village of Ossining hereby adopts as Local Law 8-2024, A Local Law adding chapter 205 (Rental Registry) to the Village of Ossining Code and directs that said local law be filed and/or distributed in accord with applicable law; and be it further RESOLVED, that Local Law 8-2024 shall become effective ninety (90) days after filing with the Secretary of State pursuant to the Municipal Home Rule Law. LL -2024 (Chapter 205- Rental Registry) K. Re-appointment of Special Counsel for Land Use matters RESOLVED, that upon the recommendation of the Village Manager and Assistant Village Manager, the Village of Ossining Board of Trustees hereby reappoints the firm of McCullough Goldberger & Staudt, 1311 Mamaroneck Avenue, Suite 340, White Plains, New York 10605 to serve as special counsel for land use matters, in accord with the proposal dated March 28,2024; and be it further RESOLVED, the following review by the Corporation Counsel, the Village Manager is authorized to sign a retainer agreement with special counsel. L. Authorizing legal action against Lothrup Associates LLP doing business as Aquatectonic WHEREAS, section C3-10 of the Charter of the Village of Ossining provides, in part, “It shall be the duty of the Corporation Counsel, or his or her designee, to appear for and prosecute and defend all suits, actions or legal proceedings of any kind brought by or against the Village…”; and WHEREAS, the charter further provides that the Corporation Counsel, “shall have no power or authority to settle, discontinue or compromise any pending suit, action or legal proceedings…without first being authorized to do so by the Board of Trustees”; and WHEREAS, following approval by the Board of Trustees, on June 15, 2022, the Village Manager signed a proposal from Lothrup Associates LLP doing business as Aquatectonic (“Lothrup”) whereby Lothrup would provide design and construction services in connection with the Joseph G. Caputo Community Center Natatorium renovation; and WHEREAS, the village incurred additional construction and design costs as well as loss of revenue due to Lothrup’s actions; now therefore be it RESOLVED, that the Corporation Counsel is authorized to prosecute an action against Lothrup Associates LLC dba Aquatectonic. M. Approve revisions to the village’s Significant Sites and Structures Guide WHEREAS, in April 2010, the village published the “Village of Ossining, New York Significant Sites and Structures Guide”; and Legislative Meeting July 17, 2024 Page 5 of 7  WHEREAS, the members of the village’s Historic Preservation Commission have reviewed the guide and have suggested some revisions; and WHEREAS, the revisions were presented to the village’s Planning Board, whose members supported the proposed revisions; now therefore be it RESOLVED, that the proposed revision shall be incorporated into the Significant Sites and Structures Guide. N. Approve revisions to Architectural Design Guidelines WHEREAS, Village Code section 270-25F(2) states, “The Historic Preservation Commission shall develop a listing of changes that may be commenced on buildings or sites classified as landmarks or historic districts. Such changes shall be such that the Commission feels they will not substantially cause to deteriorate or lower the overall architectural and historical ambience and character of the district. The listing of changes shall guide property owners and tenants in the district and the Historic Preservation Commission in determining whether or not a proposed exterior change will significantly affect the character of the Historical and Architectural Design District”; and WHEREAS, in May 2011 the village published the Architectural Design Guidelines for the Village of Ossining; and WHEREAS, the guidelines have two purposes:  For residents, developers and visitors, to describe community patterns and celebrate community strengths that can be the building blocks for future community development.  To assist Village residents, developers, volunteer boards and staff to plan change within the Village in a way that will preserve and intensify its unique character in environmentally responsible ways; and WHEREAS, the members of the Historic Preservation Commission reviewed the guidelines and presented some revisions; and WHEREAS, those revisions were presented to the village’s Planning Board, whose members supported the proposed revisions; now therefore be it RESOLVED, that the proposed amendments to the Architectural Design Guidelines for the Village of Ossining titled “Awnings”, “Solar Panels”, “Retaining Walls, steps, ramps and grade changes”, specific to the “Ramps” section shall be incorporated into the guidelines. O. Call for Public Hearing-Village of Ossining’s proposed 2025-2027 Community Development Block Grant (CDBG) projects RESOLVED, that the Board of Trustees of the Village of Ossining hereby calls for a Public Hearing to take place at 7:30 p.m. on August 7, 2024 at 7:30 p.m. at the Birdsall Fagan Police-Court Facility, 86-88 Spring Street, Ossining, New York for the purpose of receiving comments on the village’s proposed 2025-2027 Community Development Block Grant (CDBG) projects:  Walking path connecting Hunter Street and lower James Street.  Streetscaping along Ellis Place.  Streetscaping along William Street  Spring Street walkability improvements Phase II (Lafayette Street to Scarborough Manor); and be it further RESOLVED, that members of the public are invited to attend the public hearing in- person at the above-referenced location; and be it further RESOLVED, that those members of the public requiring a reasonable accommodation to participate in the public hearing due to that person’s disability, shall notify the Corporation Counsel no later than seven (7) days before the public hearing (kahan@villageofossining.org) to afford the village sufficient time to provide the reasonable accommodation; and be it further Legislative Meeting July 17, 2024 Page 6 of 7  RESOLVED, that for those members of the public who want to attend/participate in the public hearing remotely, access will be available via the Zoom platform; and be it further RESOLVED, that comments regarding the proposed Community Development Block Grant (CDBG) projects will be accepted by the Board of Trustees at BOT@villageofossining.org. Michael Horan VIII. CONTINUING BUSINESS OF THE BOARD IX. NEW BUSINESS OF THE BOARD A. Addition of Equalis Group as an approved purchasing consortium WHEREAS, the village’s annual procurement policy notes that among those items not subject to competitive bidding pursuant to section 103 of the General Municipal Law are, “Purchases under New York State and any NYS county or local government contracts, or through a purchasing consortium, provided that the contract is awarded in a manner that constitutes competitive bidding consistent with NYS law and made available for use by other governmental entities and subject to approval of the Village Manager and Corporation Counsel”; and WHEREAS, the policy lists a number of authorized purchasing consortia; and WHEREAS, purchasing consortia may be approved during the year by resolution of the Board of Trustees if found to benefit the Village; and WHEREAS, the Village Treasurer has been evaluating whether the Equalis Group should be added to the list of authorized purchasing consortia; and WHEREAS, the Village Treasurer finds that Equalis Group is aligned with the village’s procurement standards; now therefore be it RESOLVED, that the Equalis Group, 5540 Granite Parkway, Suite 200, Plano Texas 75024, is added to the list of authorized purchasing consortia used by the village; and be it further RESOLVED, that the village’s procurement policy is amended to reflect the addition of Equalis Group; and be it further RESOLVED, that upon review by the Corporation Counsel, the Village Manager and/or Village Treasurer may sign those documents necessary for the village to join the Equalis Group purchasing consortium.
