RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the
Minutes of the November 20, 2024 Regular Meeting as presented.

B. Approval of Voucher Detail - December 4, 2024
RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the
Voucher Detail Report dated December 4, 2024 in the amount of $1,620,878.26.

C. Adoption of Local Law 21-2024, “A Local Law amending Chapter 270 (Zoning) of the
Village of Ossining Code”
WHEREAS, the Board of Trustees of the Village of Ossining (“Village Board”) has been
considering the adoption of Local Law -2024, titled, “A Local Law amending Chapter
270 (Zoning) by adding a new article XVIII (Electric Vehicle Charging Stations),
amending chapter 270, section 270-29 (signs) and amending chapter 270, section 270-7
(District boundaries); and
WHEREAS, the proposed local law sets out requirements for electric vehicle charging
stations in the village including signage and lighting and adds an additional rule for
determining boundaries of zoning districts where lot ownership is divided by one or more
municipal boundaries; and
WHEREAS, pursuant to section 270-59, the proposed changes to chapter 270 were
referred to the Village of Ossining Planning Board and a response was provided; and
WHEREAS, the proposed amendments were referred to the Westchester County
Planning Board and a response was provided; and
WHEREAS, a public hearing on the proposed local law was held on November 20, 2024
and members of the public were able to participate both in person and via the Zoom
platform as well as by submitting written communication to the Board of Trustees; and
WHEREAS, the public hearing was closed on November 20, 2024; and
WHEREAS, there are no impediments to adopting this local law; now therefore be it
RESOLVED, that the Board of Trustees of the Village of Ossining hereby adopts this
local law as Local Law 21-2024 and directs that said Local Law be filed and/or
distributed in accord with applicable law; and be it further
RESOLVED, that pursuant to New York Village Law section 7-706(5), the text of Local
Law 21-2024 shall be entered in the minutes of the Village Board; and be it further
RESOLVED, that sections 1 and 2 of Local Law 21-2024 (Article XVIII- Electric Vehicle
Charging Stations and section 270-29-Signs) shall become effective 60 days after filing
with the Secretary of State and that section 3 (section 270-7- District Boundaries) shall
become effective upon filing of this local law pursuant to section 27 of the Municipal
Home Rule Law.

D. Adoption of Local Law 22-2024, “A Local Law amending Chapter 229 (Streets and
Sidewalks) of the Village of Ossining Code”.
WHEREAS, the Board of Trustees of the Village of Ossining (“Village Board”) has been
considering the adoption of proposed Local Law -2024, titled, “A Local Law amending
Chapter 229 (Streets and Sidewalks) of the Village of Ossining Code”; and
WHEREAS, a public hearing was conducted on November 20, 2024 at 7:30 pm at the
Birdsall Fagan Police-Court Facility, 86-88 Spring Street, Ossining, New York and via
the Zoom platform affording members of the public an opportunity to be heard; and

WHEREAS, the public hearing was closed on November 20, 2024; and
WHEREAS, pursuant to section 617.3(f) of the State Environmental Quality Review
(SEQR) regulations, no determination of significance, environmental impact statement
or findings statement is required for Type II actions; and
WHEREAS, SEQR regulation 617.5(c) lists Type II actions including: i) routine or
continuing agency administration and management, not including new programs or
major reordering of priorities that may affect the environment and ii) adoption of
regulations, policies, procedures and local legislative decisions in connection with any
action on the Type II list; and
WHEREAS, the proposed local law is a Type II action requiring no determination of
significance pursuant to the SEQR regulations; and
WHEREAS, there are no impediments to approving the proposed local law; now
therefore be it
RESOLVED, that the Board of Trustees of the Village of Ossining hereby adopts as
Local Law 22-2024, A Local Law amending Chapter 229 (Streets and Sidewalks) of the
Village of Ossining Code; and be it further
RESOLVED, that Local Law 22-2024 shall become effective upon filing with the
Secretary of State pursuant to the Municipal Home Rule Law.
Local Law (Chapter 229- Streets and sidewalks- utility poles)
E. Overgrowth Assessment- 14 Park Avenue
WHEREAS, GM Home Design & Construction, LLC is the owner of property at 14 Park
Avenue (89.16-3-88.5) (“Property”); and
WHEREAS, pursuant to section 88-8 of the Village of Ossining Code (“Code”) the
owners were notified by the Building Department that overgrowth on the Property had
to be removed within 10 days of the notice; and
WHEREAS, the owners failed to remove the overgrowth; and
WHEREAS, pursuant to section 88-10 of the Code, the Village arranged to have the
overgrowth removed; and
WHEREAS, the overgrowth was removed by Diego’s Landscaping & Construction
Corp. on October 29, 2024 at the village’s request; and
WHEREAS, the owners were sent a Notice of Proposed Assessment of Costs and Notice
of Hearing noting the total amount due to be $840 consisting of the invoice for the work
performed ($700) plus a 20% administrative fee ($140);
WHEREAS, at the hearing on December 4, 2024 the Board of Trustees discussed the
assessment; now therefore be it
RESOLVED, that the itemized costs noted below are just and reasonable; and be it
further
RESOLVED, that if the amount so assessed is not paid within thirty (30) days after the
assessment by this board an action to recover the amount assessed may be maintained by
the Village against the property owner, or a special warrant may be issued by the board
for the collection of such assessment of the amount thereof to be included in the next
annual tax levy.

F. Overgrowth Assessment- Hunter Street Lot
WHEREAS, Hunter Lot LLC is the owner of Hunter Street Lot (97.07-2-70)
(“Property”); and
WHEREAS, pursuant to section 88-8 of the Village of Ossining Code (“Code”) the
owners were notified by the Building Department that overgrowth on the Property had
to be removed within 10 days of the notice; and
WHEREAS, the owners failed to remove the overgrowth; and
WHEREAS, pursuant to section 88-10 of the Code, the Village arranged to have the
overgrowth removed; and
WHEREAS, the overgrowth was removed by Diego’s Landscaping & Construction
Corp. on October 12, 2024 at the village’s request; and
WHEREAS, the owners were sent a Notice of Proposed Assessment of Costs and Notice
of Hearing noting the total amount due to be $420 consisting of the invoice for the work
performed ($350) plus a 20% administrative fee ($70);
WHEREAS, at the hearing on December 4, 2024 the Board of Trustees discussed the
assessment; now therefore be it
RESOLVED, that the itemized costs noted below are just and reasonable; and be it
further

G. Fiscal Year 2025 Budget Adoption
WHEREAS, the Board of Trustees of the Village of Ossining received from the Town
Assessor for the Year 2025, a combined total taxable assessment of real property and
special franchise properties of 2,837,077,739; and
WHEREAS, the Board of Trustees received the 2025 Tentative Budget on November 6,
2024 in accordance with Section C4-3 of the Village Charter and has since amended
same; and
WHEREAS, a Public Hearing on the Tentative Budget was opened and closed on
November 20, 2024; and
WHEREAS, the Board of Trustees, upon giving further consideration to requests and
recommendations of all department heads;
NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the Village of
Ossining does hereby adopt the Budget of the Village of Ossining for the Fiscal Year
2025, showing that there be levied and assessed upon the sum of taxable and special
franchise properties of the Village of Ossining, as hereinbefore listed, the sum of

$25,834,095 to be raised by Real Property Tax Levy, which sum is more completely set
forth in the budget for the Village of Ossining; and
BE IT FURTHER RESOLVED, that the Tax Rate rounded to the nearest penny and the
same hereby is fixed at $8.5742 per thousand dollars of assessed taxable valuation, and
BE IT FURTHER RESOLVED, the Adopted Budget for calendar year 2025 shall include
the appropriations and estimated revenues for the General Fund, Water Fund, Sewer
Fund, Section 8 Program Fund and Debt Service Fund as modified by the Board of
Trustees, as follows:

BE IT FURTHER RESOLVED, that the Board of Trustees does hereby authorize the
Capital Plan for the calendar year 2025 as presented (see attached), subject to follow-up
Board resolutions for Capital Projects to implement.

H. Adoption of Changes to Fee Schedule for 2025 – Other than Water and Sewer Fees
WHEREAS, the Village’s adopted Financial Goals and Policies requires, in part, the
establishment and periodic evaluation of user charges and fees to help reduce reliance on
real property taxes, and
WHEREAS, at this time Village management has recommended certain changes to the
adopted Fee Schedule for 2025, now therefore be it
RESOLVED, the Village’s Fee Schedule is hereby amended, effective January 1, 2025,
for the following user charges and fees:

And be it further
RESOLVED, all other user fees in the adopted Fee Schedule for 2025 shall continue in
effect until and unless changed by Resolution of the Board of Trustees.
I. Adoption of Changes to Fee Schedule for 2025 – Water and Sewer Rents and Fees
WHEREAS, the Village’s adopted Financial Goals and Policies requires, in part, the
establishment and periodic evaluation of user charges and fees to generate revenue
sufficient to support the costs of the Water and Sewer Funds, and
WHEREAS, at this time Village management has recommended a 5.0% increase to
water and sewer rates in the adopted Fee Schedule for 2025, and for Meter Fees and
related Service Connection Charges, now therefore be it
RESOLVED, the Village’s Fee Schedule for water and sewer rates and fees is hereby
amended, effective January 1, 2025, as follows:

J. Call for Public Hearing-Proposed Local Law -2024 titled “A Local Law amending
chapter 270 (zoning); section 270-17C (P-O Professional Office District; Conditional
uses) of the Village of Ossining Code.”
RESOLVED, that the Board of Trustees of the Village of Ossining hereby calls for a
Public Hearing to take place at 7:30 pm on December 18, 2024 at the Birdsall Fagan
Police-Court Facility, 86-88 Spring Street, Ossining, New York to consider proposed
Local Law -2024, titled, A Local Law amending chapter 270 (zoning) of the Village of
Ossining Code; and be it further
RESOLVED, that the proposed local law amends section 270-17C by revising the
minimum livable floor area for dwelling units in the P-O (Professional Office) zoning
district; and be it further
RESOLVED, that members of the public are invited to attend the public hearing in-
person at the above-referenced location; and be it further
RESOLVED, that those members of the public requiring a reasonable accommodation to
participate in the public hearing due to that person’s disability, shall notify the
Corporation Counsel no later than seven (7) days before the public hearing
(kahan@villageofossiningny.gov) to afford the village sufficient time to provide the
reasonable accommodation; and be it further
RESOLVED, that for those members of the public who want to attend/participate in the
public hearing remotely, access will be available via the Zoom platform; and be it further

K. Fire Department – Appointment – Independent Hose Co. #6
RESOLVED, that upon recommendation of the Fire Chief, David Keeney and Mateo
Coburn-Trabout, Ossining, New York were elected as active members of Independent
Hose Co. #6 for interior firefighting.

X. NEW BUSINESS OF THE BOARD
A. Authorizing Issuing Request for Proposals for Construction Management Services,
Village-Wide Capital Projects
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to issue a Request for Proposals for Construction Management Services,
village-wide capital projects.
B. License Agreement for Quimby Street East Lot
C. Authorizing the Village Manager to sign a license agreement with WB 30 Water Street,
LLC
WHEREAS, by deed dated October 24, 2024, the Village of Ossining transferred to WB
30 Water Street, LLC parcels identified by their tax identification numbers as section
89.19, block 6, lots 26, 27, part of lot 28 and part of lot 29; and
WHEREAS, WB 30 Water Street, LLC intends to develop these parcels to include a 109
unit wholly affordable residential building with residential space and community space, a
four-story parking garage with 45 spaces to be used by village residents, and an extension
of the Sing Sing Kill Greenway to Water Street; and
WHEREAS, the parcels have been accepted into the New York State Brownfield
Cleanup Program; and
WHEREAS, WB 30 Water Street, LLC wants to locate a grout batch plant for
environmental clean-up operations on Village-owned property located off Quimby Street
which property is identified by tax identification number section 97.07, block 1, lot 1; and
WHEREAS, WB 30 Water Street, LLC requests a license agreement with the Village for
the use of a portion of the Quimby Street property as depicted in the attached plan; and
WHEREAS, the proposed environmental clean-up operations would include routing
hoses under the street from the grout batch plant through the culvert; now therefor be it
RESOLVED, that the Village Manager is authorized to sign a license agreement with
WB 30 Water Street, LLC to use a portion of the village-owned property (97.07-1-1) for
the grout batch plant as depicted on the plan prepared by Renova Environmental
Company dated November 26, 2024.
